Hello there , my name is Gary *** and I am the owner of Mobile Window Washing Inc ! Mobile window washing Incis a S corporation
In southern California I started my business in Oct 1st And in my experience working for home owners , I have had
the pleasure of meeting wonderful and respectable client , all over Southern California , which includes Los Angeles , Orange County , inland Empire , and all of San Diego ! That being said ,it has come to my attention over the years that working in the industry , you CAN'T always PLEASE everyone !
On march 22nd *** *** @ *** *** *** * *** *** * **
Found my advertisement in one of the local papers and called to get some info on my services !
She came off to be really nice and sweet over the phone like most clients are !
She asked me the typical questions about my services , and I answers all of her questions in subject , and we made an appointment for
3-28-@ 11:pm ! Of which was my 2nd job of the day , and was located just a few miles away from my 8:00am client !
One of the question she had was regarding my specials she found in the ad! I explained to her that the special was for a story home sq or smaller !
She described her home as sq story !
I stated no problem and the charges for all interior / exterior would be somewhere in the ball park of considering her home is twice the size !! She understood the nature of the work involved , and was excited to get a early start on Spring Cleaning !
On Friday Mar 28th 11:15am I arrived to her residence , and just so happened she had work going on in home , and she was standing on her porch ! The flooring crew were sanding / buffing , and polishing her marbel floors ! 100% of the 1st level !
Now I'm not sure if you have ever experienced This process , but you really make a wet mess before you achieve shinny floors ! She walked down the driveway , introduced herself to me in a surprise justure to say thanks for being early , and in uniform !
She mentioned in the past its been hard to find company's show up on time !
I agreed ! She then asked if I had ins , I showed her my mil inscertificate , and also stated I'm one of the only window company's she would find locally that a (s) corp !
Soon after she explained the wet mess taking place in the home and asked if my helper and I could both start upstairs while the guys finished up her floored ! No problem what so ever ! I didn't bother walking around the exterior of the home to take a visual as in most cases ! I started upstairs in her office !
The first window I came to had window tint that was 20yr old , scratched , and so faded from years of wear/tear ! As always I asked her if she had a minute to come and see for herself , I explained that most of the screens are in really bad condition , and I would give her a referral for repairs /replacement she was greatful for the advise !
I then continued on my way to finish up the upstairs interior , the windows on sides of the upstairs were over 40' in the air of which most ladders won't work , her home sat on a raised foundation so the 2nd story truly was considered a 3rd story !
The Windows's were in really bad shape! They had broken seals , moisture in between the pains , and 75% of the screens were shoot out , ripped , faded , and had brooked corners ! All of which I showed her and explained different times !
75% of all the upstairs windows I had to clean from inside because of the height ! So it turns out to be much slower of a job !
When I started the downstairs , my helper told me that the basement had been completed ! I then got concerned how many windows this 2800sq home had as she may have given me incorrect information of the home !
I looked the home up on Sanicore MLS and te county Zoning showed it to be sq ! I then respectively found Mrs *** outside and told her I didn't know the home was sq story home ! And the price was gonna be different then what we talked about ! Of which I really don't like to practice that ! I call it the Bait n switch ! I don't like it done to me and I'm not in the business to try and pull this off to my client !
So when explaining the difference of a story vs story I told her , look I would normally charge for this home , but because we started already ,not knowing its a 3rd story , let just meet in the middle and make sure all party's are happy with ! She then frowned and said how's ! I was ok with that !
We then went back to work , and in total we worked about hrs ! Because of the the home was so tall we didn't use a ladder at all except to access the windows above the garage !
The condition of the tent , old windows ,
And having to be easy on the screen from all the damage they had , the job took longer ! Also we had to work around guys that had 3
24" floor sanders downstairs ! Not a problem !
Now remember the whole time we were working her husband was sleeping in the master bedroom , so I had to be really quite , because I new he was older and I didn't want to wake him !
*** had a great attitude about the damaged windows , the screens , and understood it was truly taking longer to clean all the upper glass from inside !
I thought she was great to work for at this point and that's why I didn't really want to change that attitude with a up charged bill !
I'd rather charge less and have more repeated then anything !
She told me different times how good the windows looked before I corrected her on the correct zoning of her sq home !
When I approached her with my invoice , she asked if I wouldn't mine walking around with her to re-look some if the work !
She wanted me to use her 1gal of Bleach and wipe her frames of her screens !
The screens were white powered coated , that had rusty Oxidations and the White was 20yr aged and the color was gone !
I explained in a respectful manor that there's nothing on the market that will bring the color back ,
I told her the tint , damage was so bad you couldn't tell how bad it was until the exterior was cleaned !
She could agree about that ! Her attitude went south ,
I spent 45min walking around window window showing her
Inch by inch what I had observed while cleaning !
I then realized , in most cases when I get asked about my ins , I know im gonna be dealing with a problem client !
It's no different when a client tells you he's a Lawyer before he tells you his name !! Lol
Any way , when realized that there truly wasn't anything I could say or do to make *** realize her windows weren't
Gonna look new just because they were cleaned , I asked her to just go ahead cut me a check , she stated I wouldn't pay
You 50% ! And that the work wasn't worth !
I then said if that all I'm worth then go ahead and get you check book out and let's move on !!
She retrieved a check for 115.00
I then handed it back to her and said !
Go ahead and keep my money !! This jobs on me !
I told her I'd rather impose a Machinic'sLien on her home then
Take cent from her ! I told her to have a nice day ! And I left !
At no time did I get rude , mad , or show any type of bad attitude !
For all of you that's reading this long story , in yrs I have maintained
A+ rating with the Revdex.com I have had NOTHING but positive reviews !
But this client has truly gotten the story wrong !
Never used a tall ladder
Husband was asleep
Lied about the arrival time
Lied about my lic#
Lied about the Original contacted price
Lied about Machinic lien not being legal , but then asked me to remove it ! Lol
Lied about my helper showing up latter then I did ! We drive together !
PsAfter reading the complaint that Mr.*** stated , the question still remains in my mind !
Why would mr *** even file a incorrect claim with the Revdex.com when he wasn't even wake to testify what happened !
Why didn't *** file the claim !
Having *** *** comment on her behalf would be like have my neighbor respond to his complaint when there not even involved !
*** your a great guy for stepping up for you wife , but sad to say I'm not dropping my lien for the sure fact of the disrespect your wife showed me !

Behalf ! I really do think you have gotten wrong information from your wonderful wife !
The 1st thing that she asked the moment we showed up was questioning me if I had general ins ? I pulled out my phone and opened up my Doc App on my iPhone !
Why your trying to twist the truth , would be for the sure fact , that its far from the truth , and I had a wittiness that stood there and watched me show her !
She even stated that the smart phone were great for that info !
Regarding finishing your job , every window got cleaned , even all the broken screens got cleaned !
Except for the window on the left side of your master bed , because of the 45' drop , and its a fixed pained window
And the stairs below , we just couldn't reach it !
I did explain that to Mrs.*** regarding that window , but you wouldn't of know , you were sleeping !
To say I even spoke to you while you were in bed , I wouldn't even be able to pick you out of a line up if I had to !
Regarding my (s ) corp
Log onto California corporation and you will find it there !
Regarding my Lic # it's on the business card I gave your wife the moment I showed up !
Please get your stories straight , and try to keep it to the truth !

My lien is valid , it will remain on your Title report with the county recorder and will continue to accrue interest until it paid to
Mobile Window Washing Inc !
So at this point unless your willing to settle your charges for the work your wife order, you will not be able to refinance your home , or sell it !
As stated on Mar 28th I would really recommend replacing all of your damaged windows before you replace the broken screens, or remove all the damaged window tint , or even waist your time and money hiring a cleaning company ! The moisture in the glass will never dissipate !
I'm sorry I didn't respond to your claim in a timily Manior , I had family's I've ben hosting the past days during the wild fires , they got evacuated and still can't go back to there homes !!
I won't be responding to anymore of your untruthful claims ,
Please contact my lawyer above if you still think your correct regarding
Machinical liens !!
In the P.R business you just can't make everyone HAPPY !!

Mr. [redacted] continues his unprofessional conduct, and making false statements in an attempt to defend himself. He apparently lacks  the ability to read,  for himself, the law concerning Mechanics Liens, and has received legal advice from an attorney who has misinformed him. He states that the lien is going to stay. He is unwilling to solve this in the proper venue, Small Claims Court,  probably because he knows he is in the wrong, and would loose.There is no paper work for me to submit,  as the was never anything put in writing. This is obviously a situation where there is no solution,  and nothing the Revdex.com can do to help.  When I finish with him in court, I would like to advise the Revdex.com, so that the final result of  his misuse of the law, and the bad advice he has received, is made public,  incase he tries this with someone else. It will also serve to educate people on California's Mechanics Lien law.

I'm going to try to keep this short. In response to Mobile Window Washing, Inc's. response,  let me first say that I'm not going to waste time responding to each of the many inaccuracies in it. It's typical for someone who has done wrong,  and knows that they have done wrong,  to try to defend themselves by countering with an almost overwhelming amount of excuses,  and blaming the other party for everything. It is, after all, just one person's word against another. Mr. [redacted] can say anything he wants to try to turn this around and place the blame on us. Of course he is this wonderful individual, and wouldn't,  couldn't be guilty of not finishing the job. I expected nothing less out of him, and I commend him for his work in fictional literature. 
That being said,  here's the deal:
Firstly,  yes there was other work going on in the house,  which is why I was upstairs in the master bedroom. However I wasn't sleeping,  I was watching tv, when Mr. [redacted] knocked on the door,  and asked to come in to clean the windows. We spoke with one another while he was working on the windows in the master, and he knows that. 
I wrote the complaint based on what my wife told me transpired.  I would certainly trust her word over his.
He wasn't asked to provide proof of insurance,  as he states,  but for his license information,  as his website states that he is licensed.  He still hasn't responded to that. Is he licensed or not?
 If so, as what,  and what is his number? 
I stand by the rest of the complaints. The reader can decide who they care to believe.  This was simply a matter of finish cleaning the window frames and sills and get paid. Don't finish and you won't. If you don't have time,  come back. 
As far as the lien goes, of course I asked him to remove it. He obviously doesn't understand the Mechanics Lien law in California, and needs legal help. Just because the County allows you to do the paper work and record a lien, doesn't mean that you are qualified to file it and that it is legal.  It's not the clerk's job to advise you. In order for you to legally put a lien on someone's property,  the work you perform for them must add tangible value to the property itself.  If it doesn't,  you have illegally filed the lien, and must remove it. If you don't,  and court action is required,  you are liable for costs.  If Mr. [redacted] had installed the windows, finished the job, and not been paid, he has added tangible value to the property,  and would be qualified to file a Mechanics Lien. Someone who cleans the windows adds no tangible value,  and therefore if they file a lien,  its illegal,  and must be removed.  That is why I "requested"  that Mr. [redacted] remove the lien. If he refuses to remove it voluntarily,  he will be forced to remove it by the Court,  and it is stated very clearly in the Mechanics Lien law, that he will be required to pay all legal costs,  and possibly punitive. This is a very powerful device designed for use by the construction industry,  and the Court takes a very dim view of it's misuse.
 If Mr. [redacted] thought he had been wronged (he hasn't),  the place to take it up should have been Small Claims Court, but I suggest he may have gotten away with this type of act before,  with people who were ignorant of the law and intimidated by the words "Mechanics Lien". I'm not, so I ask again for it to be removed by Mr. P[redacted],  or I'll have the Court do it, at his expense.  Not a threat,  just a factual statement. Read the law. Save yourself a bunch,  and then, if you still want to persue this, take me to Small Claims Court. 
I apologize, this ended up being much longer than I had intended it to be.
