The facts: This customer signed a contract to complete a van with a 50% non-refundable deposit and very specific requirements and a planned diagram of the final resultWe proceed with work based on those agreementsThey contacted us with a change order that significantly changed the scope and outcome of the projectThe work was asked to be frozen at that time BY THE CUSTOMERThis change order and the unknown timeline to design the change order was explained to them in detailBetween the customer asking for the project freeze and our re-design, the project was delayed (with their blessing) many monthsWhen the change order was presented to them they decided to ask to close the projectThat is their choice and the work that had been competed up to the moment the change order went into effect was what we would expect to see based on a typical projectHowever, their deposit is CLEARLY and contractually non-refundableWe worked diligently with this customer to make sure the process of closing the project was both legal and tenable for both partiesAt each and every stage of this process, the decisions were that of the customer and we were following the agreements set forth in our contractThe customer chose to ask to receive their van back having seen progress to that point IN PERSON and knowing that their deposit was non refundableAccusations of our services being a scam are tantamount to libelWe take care to make sure that our projects move forward with very specific agreements, that all significant requirements are tended to, and that the customer has a well documented plan for the project outcomeThis is the only and final response we will make regarding this

We made no offer in our responseWe stated that the consumer has made threats and demands and that we will not respond to threats and demandsThe consumer has finally submitted facts and a warranty issue that does need to be addressedWe are proceeding with addressing that concern, as long as they do not respond with more threats and demandsWe are currently in post project acceptance phase with this customerThis means that we will consider warranty or other concerns under the scope of the warranty agreementIf they have made other complaints in the past it is our opinion that they have been made as demands and under threat which is not an acceptable way to communicateThey have accepted their project and if they have continuing concerns, need to submit those concerns as warranty itemsAs stated before we will respond to warranty claims and issues if presented in an appropriate mannerWe encourage the customer to continue to present claims under the scope of our warranty agreement

Company has still not addressed outstanding damages and claims. No release of these claims has been made by me, and they remain valid. I am proceeding with legal action.

This is the only and final response we will make regarding this.

I am rejecting this response because: Mobius states the contract I signed for a non-refundable deposit. I do not dispute that. However I paid a 50% deposit on a job where details were not fully elaborated. I repeatedly asked for details to make it clear what was to be built would function. Mobius did not provide these details. I therefore flew to Colorado to visit the shop, and after discussing with the owner's partner, came to a build plan that was simpler. Mobius took a month to provide a change order, in which total cost was increased by over 50%.Mobius has done nothing illegal because I signed the original contract and because I signed a termination agreement without thorough inspection; my mistake. However, what they have done is profoundly unethical, and judging by the similarities between my experience and one of the company's very few other customers [redacted], it appears this kind of unethical practice is what is to be expected.

The customer accepted and paid for their van project. Any issues a customer has after accepting a project we consider reviewing under the warranty. However, they have done nothing but threaten and make demands as per any issues they perceive they are having. We have a warranty process which has been...

explained and they refuse to present a legitimate claim with the information we need to move forward with an assessment, and they continue to make threats and demands. The customer needs to appropriately present us with the information we have requested so that we can review and respond to any warranty requests.
