This tenant presently resides at a property in *** The building was purchased by new ownership at the end of *** MOD had it's first inspection with the *** of *** as part of their routing system of inspecting rentals at the
end of *** *** At that time the city requested repairs be made to the metal deckingThey also had 3-items per unit that needed to be corrected as wellAll items for each unit were corrected and passed by the city in *** with an extension to *** granted by the city to complete decking repairsTemporary work to the metal was completed in *** to cover sharp edges and try and prevent additional rust while a permanent long term solution is bid and implemented
Please note:
The metal installed as a walkway over the decking was done by the prior owner vs a proper repairThe new owner is working to correct the problem and improve the buildingThis condition existed at the time the tenant saw the unit before occupancyIf it was not satisfactory they should have looked elsewhere for housingThe tenants will not be given free rent for thisThey will not be let out of their lease earlyThe tenants have been given copies of the city requirements with which the owner and landlord are in full complianceThere is no section of the lease being violated
With regard to this tenants previous occupancy at one of our *** properties they were let out of their lease after complaints about the flooringWe made no repairs to this flooring as none of our flooring contractors recommended any repairsWe let the tenants out of the lease because we were not in agreement over what was acceptable for the flooringOur opinion was based on the recommendations of professional contractorsI will not retroactively rebate rent for this property either

I have the reports from the city of *** showing that they failed the second inspection as well in regards to my unitThe walkway has rapidly deteriorated since I had first viewed the property and I had been promised by *** that the walkway would be repaired within a month the of my viewingAs far as Mod Properties professionals telling them repairs were not needed on the first unit I will simply say that I had an actual expert look at the flooring rather than one of the seriously substandard contractors Mod employs to save money.He is ready to testify against them in court as to the safety of both units.Mod properties own repair man at the first unit told me himself that new flooring was required but that Mod would never pay for such expensive repairsHe is no longer employed with mod and it can only be assumed that he was either let go for being honest with them on what really was needed to repair their properties or that he got tired of using bandages on wounds that needed a tourniquetI am also after the moving costs associated with both moves that will be required and having spoken with my neighbors both past and present considering class action with them as remedyMod properties is finally going to see their tennants stand up to their *** lord practices

The *** of *** laws of Colorado do in fact entitle us to a return of the rents paid on any uninhabitable by statute residence as well as moving expensesI have the documentation of the second failure in hand from the city of WestminsterThis business tries bullying tactics to solve disputes rather than doing what is correct but unfortunately for them, I am well versed in dealing with bulliesPerhaps they should talk to their lawyer as we have been talking with oursIf they had a clue as to the mountain of evidence we have they would realize they want to settle BEFORE this reaches court

Again the resident is requesting free rent which I am not able to offer as we have not violated the lease, have not been found to have breached any laws regarding Warranty of Habitability and we are working on correcting this problemThe Warranty of Habitability is intended to protect tenants from landlords who ignore problems not to punish landlords or provide month after month of free rent to tenants when the landlord is actively correcting an issue
