Complaint: ***I am rejecting this response because: We had only called to know our options, we never specifically told him to cancel the present apartmentHe had told us that we can take in equity residential apartments in bellevue, but later told us that we need to pay the holding fees againWhen we called him back to take back the same unit we had booked, he said we need to pay holding deposit againHow can he cancel it without we telling him to cancel the unit ? It would be great if they can share any proof that we had asked to specifically cancel the unit. Sincerely,*** ***

Complaint: [redacted]I am rejecting this response because:The whole point of this complaint is to inform you guys that the process din't go smoothly. 1. I confirmed with my wife many times. She only told the apartment when she called that we are thinking of changing the plans. 2. Yes it would have been only $300. It was my mistake, I thought it was $400. I agree to this. But this doesn't change anything.3. I attached the clause of present apartment. The holding deposit will be refunded in full, if cancelled within three days. So I don't think I'm talking about non-local apartments. I would want to see the washington law, incase you guys are abiding to that.4. I think you are trying to divert this whole topic, by laying out some facts. But I did call back and the information was not clear. Intially I was told that I can find an aparment with in equity residential and holding deposit will be waived off. Later on, I was told that I had to pay it again.The team at Moda was far from providing us a pleasant experience. We are happy that we din't choose Moda. In any case I'm fine if you guys want to remain as such and not change your ways. I don't even need back my money after hearing all this. Sincerely,[redacted]

The Applicant "[redacted]" applied online 05/17/2015. During the application process, they read and agree to the Holding Deposit Agreement "See Attachment".The Applicant "[redacted]" was notified on 05/19/2015 by e-mail that they were approved for the apartment.The Applicant "[redacted]...

[redacted]" called the office on 5/21/2015 to cancel. Due to the fact that the apartment was not canceled within 24 hours of approval as per the Holding Deposit Agreement, the Holding Deposit of $300 was forfeited.The amount of $400 would have been the Security Deposit, not the Holding Deposit. The amount paid was only $300 Holding Deposit by Credit Card Online and $80 Application Fee for a total of 2 Applications by Credit Card Online. The Application Fees are non-refundable at any time. The $300 is only refundable if canceled within 24 hours of being notified that the Applicant is Approved. We feel bad that [redacted] is unhappy with their experience at Moda Apartments. However, everything was properly followed by the requirements posted.

However, it appears that you have some miscommunication happening with your wife on what has been done over the process of this event.05/19 the Application was Approved and Notifed.05/21 [redacted] called and specifically canceled the apartment. The employee even double checked with her asking to confirm that she cancelled. She confirmed that another place had been found in Bellevue as it was closer to work.05/28 You called back to Moda wanting to reserve the apartment once again as plans had changed. Yet at that time, the apartment had already been rented. Our team was very helpful and even sent pictures to you of 2 available homes by e-mail.We understand that losing $300 can be tough. Yet, we clearly note the requirements that you agree to in writing online when applying. Since the start, the information you have provided has been different than facts. You claim $400 Deposit when we only took a $300 Deposit.You claim other communities offer 3 Days Cancellation. There are non locally that do unless they are by private ownership that we do not know. You claim that you called back to inquire about if you were to cancel or change locations. When in fact it was your wife. Our team at Moda does everything we can to bend over backwards to help our Residents, Future Residents and Past Residents.However, we must stick to the exact guidelines for everyone. The holding deposit was very clear and agreed to by you.
