Review: April 15, 2013 I had purchased A Honda Accord 2006 from Modesto wholesale. The company took the car back and will not refund me my 1,000 deposit.

April 15, 2013 I had purchased a Honda accord 2006 from Modesto wholesale sales rep [redacted], (209)[redacted]. I haven't had it for more than 30 days, I put a deposit down of 1,000 for the car. I was was waiting for the finance company to approve my loan, which they have not contacted me yet. On 5-19-13 I woke up at 8:45am to a Tow company called four star recovery in Modesto ca, towing my car I asked what was the reason, they stated wholesale auto put out a repo with no notice. I then called [redacted] personal line because the office was closed. He did not answer, I then called off a different number he answered I asked him why they were reposing my car He stated he had no Idea. He gives me a call back 30 mins later and says the reason why is because the finance company didn't approve the loan. I then asked him can I come down 5-20-2013 to pick up my deposit money he says yes noon is fine. on 5-20-2013 I head down to wholesale auto when I get there the dealership is closed. I then give [redacted] a call he say hes on lunch an will be back in 30 mins. I ask him if he has the money he states hes not the manager and the manager is in the mountains. I arrive back at 1:40pm to Speak to another man to get my deposit back he said he had no idea about the repo. He then stated that I wrote checks on a closed account but I paid cash for my deposit. He then stated that I will not be able to get my deposit back. He says [redacted] is the one who put the repo out for the car, and that [redacted] was the owner as well. [redacted] then stated he was not the owner. I stated if its going to be a conflict I just want my money back, he says that he would have to see what the damages where done on the car and that I would have to pay the repo fee as well as the overnight stay. the repo fee is $330 and a night is $25.00 a day.

THEY COULD HAVE CALLED ME OR [redacted] (THE CO-SIGNER) AND TOLD US THE FINANCING DIDN'T GO THROUGH AND WE WOULD HAVE BROUGHT THE VEHICLE TO THEM, THEY HAD NO REASON TO HAVE THE CAR REPOSSED.

WELL THE LAW STATES IF YOU ARE PURCHASING A VEHICLE THE CAR DEALER AND PURCHASER HAVE 30 DAYS TO GET IT FINANCED AND IF THE FINANCING DOES NOT GO THROUGH YOU GIVE THEM THE VEHICLE BACK AND GET A REFUND ON YOUR DOWN PAYMENT. BY LAW THEY CANNOT KEEP MY DOWN PAYMENT. THEY HAVE THEIR VEHICLE AND I AM REQUESTING THAT THEY RETURN MY DOWN PAYMENT.Desired Settlement: 10,000

We sold a 2006 Honda Accord on April 16th 2013 to a [redacted]. Contrary to Ms. [redacted]'s statement, at the time of the purchase she gave us checks on the down payment that were written on closed accounts, which bounced. You can see the attached copies. Her co signer [redacted], which was her boyfriend's mother, ended up backing out of being the co signer. They were initially approved at Finance and Thrift. When Ms. [redacted] went into Finance and Thrift to sign the loan papers, they asked her for proof of income and wanted 2 current pay check stubs. She only produced one of what they asked for, and when they called her employer she no longer had a job.

We repossessed the car due to default in contract. The car has body damage and she also drove the vehicle 3,000 miles in the 34 days she had possession of it. We are going to sue her in court for repo fees/storage and paint and body repairs. Also for full reconditioning and full detail. She can pick up the car by paying the balance of contract which is $9,866 - plus the money we have not received on the down payment because of bad checks.
