In September, I booked a car with Modo. My credit card number changed and the booking wasn't able to be charged to my card that they had on file. I received one past due notice about it, and unfortunately forgot about it. I understand it is my responsibility to pay this, however without any other warnings (no phone calls, emails, or letters) the company sent a bill of about $75 to collection. I paid the bill directly to them the second I realized it had been sent to collection, and asked them to contact the collection agency to remove the account. The company refused. When I asked why, they told me that they had sent numerous emails but they were unable to prove that they had done this -- the customer service associate I spoke with said they were "sent by an automated system" and he was unable to prove it, telling me it's not their responsibility if I didn't get the emails. The account never would have gone to collection had I received a second warning.
People are busy. our lives are chaotic. I had a few things happen during that period and I forgot about the bill. I paid it the second I realized what had happened. I want my credit report fixed.
joined Modo at the end of May 2019. He selected a membership account type that requires a $6 per month administrative fee and payment by credit card for each use of a vehicle soon after completion of a booking, to a credit card put on file by the member. His last use of a Modo vehicle was on August , 2019, not September as indicated in his complaint.
Since June 2019, *** has received seven notices regarding failure to pay amounts due on time. The first as early as June *, 2019, days after joining Modo. The first three such messages included the notice that, "We could not complete your most recent credit card payment. As a Monthly member, you need to have an active and valid credit card on file to continue booking with Modo." After the first two such notices he processed payments.
The last four notices related to outstanding amounts for the administrative fees for July, August and September and the use of a vehicle on August *** 2019.
The first two messages delivered on September *** included, "Our records indicate that as of the date of this email, your last Modo invoice for account *** is still outstanding."
The third message delivered on September *** included, "Our records indicate that as of the date of this e-mail, you have an overdue invoice for account #***. As this remains unpaid following two notices of arrears, we have suspended your booking privileges until your account is paid" and "Please note members with unpaid balances may be sent to a third party collections agency".
The fourth and final message delivered on October *** 2019 stated, "Please accept this as your fourth notice of arrears. Our records indicate that as of the date of this email, your overdue invoice for account #*** remains unpaid. We have cancelled your bookings until your account is paid in full" and "Please note members with unpaid balances may be sent to a third party collections agency".
The account was sent to collections 15 days after delivery of the fourth and final notice. *** paid the amount owing on October *** 2019, apparently after he was contacted by the collections service.
All emails were sent to the email address put on file by ***: *** has verbally confirmed that he did receive other emails from Modo to this email account.
