In the following response Mohawk Lumber provides an accurate explanation of the events, The client contacted Mohawk Lumber and asked us to look at the standing timber that he ownedWe met with the client and received permission to evaluate the woodlandsDue to the emerald ash borer that inhabits
the ash trees it was determined ash trees should be removed as these trees were still harvestable despite being in various stages of dyingIn addition to the ash trees there were trees numbered 1-of various species to be harvestedThe client also requested to have trees removed along the edge of the field which consisted of sugar maple, hickory and walnut treesAll trees were marked with paint including the numbered trees which were numbered with paint*These trees were detailed in the contract(*Trees are marked with paint to identify the trees that are to be harvested as agreed upon by the company and landowner) The client and Mohawk Lumber came to an agreement on a price for the trees mentioned above as stated in the contractWe then signed a contract for the said trees on 5-13-and paid the amount in full on the same day upon signing of the contractMohawk Lumber then proceeded to harvest the ash trees in approximately late May and into June/ July of We then returned in the fall of approximately September/ October to harvest the remaining treesAfter the harvest Mohawk Lumber came back to the client and gave him an additional 14% above the original price agreed upon in the contract in two separate checksThis was done in honesty and good faithThe client accepted both checksWe then received a letter from an attorney representing the client claiming that there was an additional 186,bdftof timber removed and unaccounted for and he believes that to be accountable at about cents per board footThe client’s claim was based on his assumption of approximately sixty loads of logs being removed at 7,000-8,board feet per loadA legal load of logs contains approximately 3,500-4,board feet depending on the speciesAt 3,500-4,board feet the average truck reaches Ohio’s legal limit of 80,lbsThe client also contacted Mr*** from the Ohio Forestry Association and Mr*** tried to correct the client’s claim that a legal load can contain 7,000-8,board feetThis was done to no avail as the client disregarded Mr*** explanation that a legal load contains approximately 3,500- 4,board feetMohawk Lumber attempted to explain to the client of the legal load limits and board footage per loadThe response we got from the client was, “I stand by my claim of 7,000-8,board feet per load.” Our attempts to resolve the claim were met with disregard from the clientIf you would like to speak with Mr*** from the Ohio Forestry Association we can forward his contact informationIf you have any questions contact us via e-mail or the phone number belowThank you!
