Youstate the Bank has increased your monthly payments for no reason. You further state thatduring your previous dispute, we credited your account for the disputed amount, then removedthe credit. You state we issued credit for two late fees, but we are refusing to credit anyadditional. You would like the late fees removed.Please note, Comenity Bank has been the financer behind Express credit cards since theopening of your Express credit card account on January 19, 2007.During your previous dispute, you stated you would like a full accounting of actual purchasesthat you made with the card, and a complete billing history. Please be advised that ComenityBank retains billing statement records for the period of time required by law, as this timeframehas expired, we are unable to provide you with all copies of your statements; however,enclosed you will find the available billing statements which show the account activity thatcomprised the account balance and delinquencies which are reporting to the credit bureaus,and a copy of the account Credit Card Agreement (CCA).While our dispute team investigates billing disputes, we issue your account a temporary creditfor the disputed amount and, if applicable, any related finance charges. These credits appearon your billing statement as a "provisional credit" and a 'Finance charge credit". You will seeboth credits removed on your next statement, if the dispute was not resolved in your favor. You state that you were not able to log on to Account Center to make a payment, nor were you able to pay in store. We understand that you have not received a statement nor a credit card. You state that you contacted the Bank on two occasions regarding your purchase that was to be placed on a 12 month deferred promotional plan, and you received correspondence advising that your purchase was not disputed within 60 days. You are requesting the Bank clear the balance on your account. We would like to apologize for any inconvenience this matter may have caused you. Please be advised that on January 21, 2016, ZALES THE DIAMOND STORE® credit card accounts were converted to Comenity Capital Bank from Citibank. We have reviewed the information that was transferred from Citibank concerning your account. We were able to determine that your purchase for $1,244.85 should have been placed on the 12 month deferred interest plan. To correct this issue we have transferred the remaining balance from your purchase to the 12 month deferred interest plan scheduled to expire on April 13, 2017. correspondence, submitted to the Revdex.com, that in May 2016 you purchased a pellet stove that was offered with 12 months interest free financing. Per the first statement, your payment was due on June 20, 2016, which led you to believe you had until June 2017 to pay off the charge. You state you received a statement in May 2017 with interest charges of $763.72 due to the promotional balance not being paid in full before it expired.. You are requesting that the interest charge is removed due to you only had 11 months of interest free financing and not the 12 months of interest free financing as promised. Our records indicate on May 13, 2016, a purchase of $4,244.78 posted to your account and was placed on a 12-month deferred interest, payment required plan that expired on May 14, 2017. For purchases on this plan, the customer is required to make payments on the promotional plan balance based on the standard repayment terms for their account. Interest is accrued (calculated, but not added to the balance), and if the balance is not paid in full by the plan end date, the accrued finance charges, which were calculated from the date of the original purchase, will be added to the deferred balance, and this balance will be moved to the customer’s revolving balance. Please be advised that information regarding your promotional plan appeared on your monthly billing statements, under the heading, “details of your plans”. Additionally, beginning with the March 2017 billing statement, notification was provided which advised your promotional plan was expiring soon. I have enclosed your billing statements for your review. Please be advised that a statement was issued to you on April 24, 2017, showing a balance of $694.78 with a minimum payment of $30.00 due by May 20, 2017. Under the “details of your plans” section of your statement, it stated that the promotional balance of $694.78 needed to be paid in full by May 14, 2017, to avoid paying accrued interest. The Bank received a payment of $350.00 on May 1, 2017. As a result of the promotional balance not being paid in full by the plan expiration date, the accrued interest of $763.72 was assessed to your account on May 25, 2017, and the remaining promotional balance of $344.78 was moved to revolving, which is subject to normal monthly finance charges. As of the date of this letter, the balance on the account is $1,108.50 with a minimum payment of $39.00 due by June 20, 2017. In regard to your question of the promotional plan being only 11 months, please be assured the purchase was placed on a 12 month interest free promotional plan as the purchase date was May 13, 2016, expiring on May 14, 2017. Youstate the Bank has increased your monthly payments for no reason. You further state thatduring your previous dispute, we credited your account for the disputed amount, then removedthe credit. You state we issued credit for two late fees, but we are refusing to credit anyadditional. You would like the late fees removed.Please note, Comenity Bank has been the financer behind Express credit cards since theopening of your Express credit card account on January 19, 2007.During your previous dispute, you stated you would like a full accounting of actual purchasesthat you made with the card, and a complete billing history. Please be advised that ComenityBank retains billing statement records for the period of time required by law, as this timeframehas expired, we are unable to provide you with all copies of your statements; however,enclosed you will find the available billing statements which show the account activity thatcomprised the account balance and delinquencies which are reporting to the credit bureaus,and a copy of the account Credit Card Agreement (CCA).While our dispute team investigates billing disputes, we issue your account a temporary creditfor the disputed amount and, if applicable, any related finance charges. These credits appearon your billing statement as a "provisional credit" and a 'Finance charge credit". You will seeboth credits removed on your next statement, if the dispute was not resolved in your favor. correspondence, submitted to the Revdex.com, that in May 2016 you purchased a pellet stove that was offered with 12 months interest free financing. Per the first statement, your payment was due on June 20, 2016, which led you to believe you had until June 2017 to pay off the charge. You state you received a statement in May 2017 with interest charges of $763.72 due to the promotional balance not being paid in full before it expired.. You are requesting that the interest charge is removed due to you only had 11 months of interest free financing and not the 12 months of interest free financing as promised. Our records indicate on May 13, 2016, a purchase of $4,244.78 posted to your account and was placed on a 12-month deferred interest, payment required plan that expired on May 14, 2017. For purchases on this plan, the customer is required to make payments on the promotional plan balance based on the standard repayment terms for their account. Interest is accrued (calculated, but not added to the balance), and if the balance is not paid in full by the plan end date, the accrued finance charges, which were calculated from the date of the original purchase, will be added to the deferred balance, and this balance will be moved to the customer’s revolving balance. Please be advised that information regarding your promotional plan appeared on your monthly billing statements, under the heading, “details of your plans”. Additionally, beginning with the March 2017 billing statement, notification was provided which advised your promotional plan was expiring soon. I have enclosed your billing statements for your review. Please be advised that a statement was issued to you on April 24, 2017, showing a balance of $694.78 with a minimum payment of $30.00 due by May 20, 2017. Under the “details of your plans” section of your statement, it stated that the promotional balance of $694.78 needed to be paid in full by May 14, 2017, to avoid paying accrued interest. The Bank received a payment of $350.00 on May 1, 2017. As a result of the promotional balance not being paid in full by the plan expiration date, the accrued interest of $763.72 was assessed to your account on May 25, 2017, and the remaining promotional balance of $344.78 was moved to revolving, which is subject to normal monthly finance charges. As of the date of this letter, the balance on the account is $1,108.50 with a minimum payment of $39.00 due by June 20, 2017. In regard to your question of the promotional plan being only 11 months, please be assured the purchase was placed on a 12 month interest free promotional plan as the purchase date was May 13, 2016, expiring on May 14, 2017. Many times a payment is overlooked by the customer, anda reminder call is helpful to bring the account back to a current status. Due to potential negativeramifications for our customers if an account remains delinquent, we may call until our attempt tocommunicate is successful.Bank records indicate a billing statement was sent to you on March 22, 2016, with a balance of$900.91, and a minimum payment of $40.00, due by April 17, 2016. You contacted the Bank's Customer Care team to find out that your limit wascancelled based on multiple late payments. You believe that the Bank should reinstate your credit cardaccount or provide you with credits. as you were never advised that the account would be cancelled. Pleasefind a summary of the PINK/Victoria's Secret account below. I have enclosed a copy of the account CreditCard Agreement (CCA), as well as copies of your billing statements, which show the account activity thatcomprised the account balance and delinquencies.A charge for $180.37 posted to your account on September 30,2014. On October 7, 2014, a monthly billingstatement was sent to you, and payment of $25.00 was due on November 2,2014; payment was not received.A billing statement was sent to you on November 6. 2014, and payment of 1635.00 was due on December 2,2014. Payment far $50.00 was made at the store and posted to your aecount on December 3, 2014, whichbrought the account current.On December 7,2014, and January 7, 2015, billing statements were issued to you, and payments were due onJanuary 2, 2015, and February 2, 2015. Payment for $70.00 was made by telephone with the Bank and postedto your account on March 4, 2015. As a result of the late payment, the account became two billing periods pastdue and was reported as 30-days delinquent to the credit bureaus for February 2015.Furthermore, on March 7, 2015, and April 6, 2015, billing statements were issued to you, and payments weredue on April 2,2015, and May 2,2015. Payment for $316.43 was received on May 16, 2015. As a result of thelate payments, the account became two billing periods past due and was reported as 30 days delinquent to thecredit bureaus for May 2015. Also, at this time, the PINK/Victoria's Secret account was not terminated;however, the account credit limit was suspended and decreased to zero.As no Bank errors were found, we are unwilling to automatically reinstate the credit limit, or issue credit to theaccount.
