Hello Marie,I apologize for my delay to this email, as I was out of town with limited phone and no internet access. I have asked my attorney to respond directly to Ms***, as her communication outside of this forum has continued to be threateningAs stated in my previous response, she is a friend of a former family member and not a clientWhile on vacation I used my personal camera to take pictures of my family members, and included some of my former family member's friends while all of our families were at the beachNone of whom were clients (no contracts, no payments)The trip was a personal trip, not a business tripWhile on this vacation, I captured hundreds of images of my family, my children, and at the former-family member's suggestion, I used my personal camera to capture a few images of her friend, Ms***This was not a professional portrait session in conjunction with my Arizona-based businessMy children were present, my family member's children were present, and everyone was playing at the beachAgain, there was no portrait contract (something I require of all of my clients) and no payment rendered, as Ms*** is and was not a client of my businessIt appears that she is upset that the images I captured of my family and hers were lost in a hard drive failure, and is attempting to harm my business out of contempt. When we returned home, I attempted to upload and edit the imagesShortly thereafter, I experienced a computer hard drive failure, which resulted in a total lossI had to purchase a new computer, as the old one was not salvageableI lost all of the images from the beach of my family and those of Ms*** when this hard drive failure occurred with the exception of a few of images that were deleted and in the recycle bin and communicated that to her. Ms*** responded with threatening phone calls, messages and behavior my attorney has deemed to be both cyber-stalking and threateningSince filing the Revdex.com claim, she has responded with additional threats, including that of coming to my homeMy attorney is currently reviewing the emails and threats that have been made. Had Ms*** been a client, I would have been able to refund payment, offer future session credit, or worked out additional solutions for rectifying the situationHowever, she is not a client, no portrait contracts were signed, no payments were made, she is not located in Arizona and due to the hard drive failure there are no quality images to exchangeThe candid images I captured of my children, my former family member's children and hers were not associated with my business, but rather a trip to the beach while on vacation with my family. I certainly am not happy with the outcome of any of this, as the personal images of my own family cannot be recreated eitherThe entire situation is unfortunate, but I am not sure how to proceed, again, as Ms*** is not a client and there are no quality images to deliverBecause this complaint is regarding a personal vacation and not my business, I would respectfully request that this complaint be removed from my business recordPlease advise.Thank you for your consideration and assistance.Kind regards, Lizzy M***

I was a customer of Lizzy'sPlease see the attachment's of the very first email's she sent to me back in June of The very last time I heard from her was in October (oops, not September stated in my original complaint) of In that email she sent me a link to view the [allegedly] deleted photos that she [allegedly] recovered. She also stated in that email that she would send me a consent/copyright release form to sign and that after she receives it signed from me that she would then send me the downloadable images(I attached a screenshot of one of the images of me with her watermark on it.) I never received that form to sign nor the downloadable imagesI just want her to email me the images that she does haveThey are of a sensitive nature(pregnant belly exposed, etcand my daughters are also in the pictures.) I have tried to email her several times since then asking why she hasn't sent them and asking her to send them with no responseI would much rather not of had to file a complaint with the Revdex.com but like I said she will not respondMy kids and I can't get that time back in our livesI don't understand why she didn't follow through after I heard from her in October, This will be fully resolved once I receive my images
