supporting documentation can be provided to you upon your request I am quite surprised and disappointed in ***'s complaint We have had a successful marketing partnership with *** and ** *** for many years For the last number of years, *** has had the desire to out smart and out market her competitionMoney Pages is a direct mailed magazine filled with local discounts and our goal is to create an exciting and valuable magazine that the entire community enjoys using Part of our strategy is to change the look of the publication each month by moving clients from front to back, left to right pages, top to bottom placement etc..For the longest time *** wanted to be one of the first *** *** clients in the magazineAfter many conversations and much negotiation, *** was able to negotiation an amazing contract for her company ** *** That contract included a discounted rate and page placement This contract has ben in effect for five months with no problem at all As of recent, Money Pages *** *** *** *** was notified by *** with the request to change her contract to a different sized ad and a different and lower investmentWe were told that this was under the advice of her *** due to time of year and end of year tax planningThe only way Money Pages conducts business is by Contracts/Agreements Contracts/Agreements are important to us because we have to pre order paper, press time and freight delivery and set page countsTherefore when ***'s request was made to change her contract we declined that requestOne thing that should also be pointed out at this time is, the ** category of Money Pages is one of the most competitive categories we have and normally do not negotiate special deals with that category at all but due to the good relationship we have with ***, I signed off on her deal she wanted and negotiatedAfter *** was told no for her request to change the contract/agreement, she like others, got her back up about it and said she just wants to cancel her contract all together and simply do a small ad form here on Our *** *** sent her an email restating her contract and did show her how she could cancel her contract/AgreementThe issue with *** is that she does not want to pay the un-discounted rate adjustment for the months of the contract that have already ran It's pretty black and white from our sideWe have a contract that was signed and never was *** ever mentioned to us and never brought up to us or been a problem for the last five months.In short, to date we still have not received written cancellation from *** for her contract and will be glad to terminate her Agreements it if that is what she desires All the termination verbiage is clearly stated on our agreement My goal is to continue to work with *** and ** *** That is a very important client to us and we would hate to see ** *** go away but I understand business is business.
