My company purchased a large amount of product from www.monisway.com and the order was handled by Joseph K and Monika K. When I received the product in the mail it arrived in four boxes and all boxes were completely damaged and leaking liquid product from the appearance of the exterior of the boxes before we opened them. I notified the company right away about the damages and requested for this matter to be resolved promptly. Once we opened the boxes they were clearly not packed correctly and no cushion was provided to prevent damaged from occurring. The product was not sealed correctly by the company and that is what lead to the damages. They did not purchase extra mailing insurance coverage due to more cost on their end, & also knowing my order total was well above the coverage amount ($50) that they purchased. The company was unwilling to give me a refund and when we tried to come to a resolution they did not hold up on their end of the terms. After a few months of trying to resolve this issue I came to a point where I had to file a dispute with my credit card company due to the issue not being resolved. A few months later Joseph & Monika K went and reverse the charge providing false and insufficient information to my credit card company and I was unaware of this decision made until I got a letter in the mail. By the time of reviewing the letter it was past the due date they provided for me to turn in my evidence against the company. I am now taking legal action against this company and I will never do business with them again. They are a dishonest and heartless company and all they care about is getting money that isn't theirs. I advice anyone and everyone to stay away and do not order product or do business with this company!!

This was a large issue for Moni's Coconut Scrubs, and *** does not even come close to explaining the situation correctly.

With regards to the product received, her assistant picked up the packages at the local post office. She stated that when she picked them up from the post office, there was leaking product all over the outside of the packages. When we spoke directly to the post office regarding the shipment issue, they stated that it was virtually impossible for packages to leak that much as described by *** without affecting other mail and packages, and there were no other complaints for any shipments arriving that date. In fact, they did not even give us refund for all of the boxes, as *** states incorrectly.

*** states that her assistant brought the packages back to the office and then all the product was gone through. This is a question as to why they would bring these liquid damaged cartons back to the office without complaining at the post office-which we know had not received any complaints.

*** continuously states that there were no packaging, bubble wrap, or insulated protectors in place for shipping--this is completely false, as we package all of our shipments the same and have had zero complaints. In the pictures that *** provided us of the damage--there is also OBVIOUS and CLEAR showings that packaging was in place!! They are in the pictures.

We made a plan with ***, and though we do not believe the error was on our part--we believe the items were somehow damaged while in that company's care. The plan was that we would ship all products that her customers ordered directly and she would keep the money from each order. This was something that we put into place because *** herself stated that she did not want replacement product shipped to her as she didn't feel comfortable with the post office shipping.

Moni's honored this agreement and shipped product to her customers as the orders came in. We had originally planned for us to recoup individual shipping costs for each of the customers, but upon ***'s request that she keep the shipping as well-we even honored that. We were going to ship the orders to her customers up to the amount of the original order to make things fair.

Due to ***'s company not having enough business-she abruptly put a stop to this agreement. She demanded money back for the order. We wanted to continue the way it was agreed upon. She then fraudulently put a chargeback through on her credit card for a refund of the full amount of the order. She fails to give all the details once again. When I asked her if she would then refund us back for the numerous products we have already shipped her customers for no charge since she had received all the money back in her fraudulent claim, which she stated by the way, she never received any product, she said that she "Will never pay any money back to Moni's" and that she was keeping everything. She than instructed me to Never to speak or contact her or any representatives again.

We then filed a counter claim to her credit card company with the details that were required. This is something that is asked to do from the credit card company anyways, as they need record of what happened. After I submitted all details, e-mails, pictures, etc to the credit card company-HER CREDIT CARD COMPANY REVERSED THE CHARGE BACK and sided with Moni's--this is almost never done. Therefore, her own credit card company decided that *** was in the wrong and reversed the charge back.

I continue to be harassed by *** and her lawyers, to which every time we get a legal letter from her lawyers, the stories of what happened changes each time. I don't even bother to answer these lawyers any longer as I know we are in the right and there is no case. Her credit card company even sided with us. It is obvious she is trying to take advantage of our kindness because she did not have enough business.

Moni's has a 6 year history of servicing customers with ZERO complaints for over 1000's of customers. ***'s complaint was a first and even though we do not even believe ***i's story of what happened-we even tried to offer a fair and extremely reasonable option to make this right. She continues to call us a fraud and sham company she continues to lie and cheat us out of more. We honored the agreement that both parties decided on.

When speaking about frauds and shams it would bring about thoughts of a company or person taking advantage of another. In the end, *** got free product in the beginning as we don't even believe things were damaged as she says, she then got free product to her customers, she then tried to get a FULL refund in a fraudulent claim to her credit card company-and then when she thought she received this full refund-she told us that we were out of luck for any of the money we spent in shipping to her customers.

This has been a long and drawn out situation to say the least. I call her company a fraud and a sham-and have honestly been deciding on legal action from here-not to sue for any money, but a begin a criminal complaint of chargeback fraud when she only liked throughout that process and brought a claim against us that was not true.

Please do yourselves a favor and if you are reading her complaint on this board-or the many, many other outlets that she decides to spout on about, read this response to her complaint. Realize that the post office said there were NO ISSUES on that day in question, the pictures she sent of "damaged" items clearly show packaging and insulation that she continues to state wasn't there, and her own credit card company denying her fraudulent claim charge back-which in the industry is extremely rare. If you don't want to be taken advantage of, make sure you don't work with her company-save yourself a lot of heartache and headaches.

I am not even bothering to add any files that I have showing proof of all this--it is a tiring process and if she feels like continuing on this road she can. ***-if you continue to threaten a law suit-just do it already. Continued letters by different lawyers do not do anything. I assume though-that you know you will just be wasting your money as you will lose any law suit and have to pay your attorney and I will counter suit for my attorney and legal costs as well as time and effort I have had to put into this as you defame our business.

I have reviewed the response made by the business in reference to complaint ID, and find that this resolution does NOT satisfy me.

I have attached all the information and communication myself and Moni’s Coconut scrubs have exchanged in between this whole timeline until todays date. There was no contract stating that myself or my company would be responsible for any damages upon shipment of product coming directly from the sender “Monis Coconut Scrubs.” I ordered products from this company and do not believe at all that I should be responsible for damages coming from from their end of shipment. The damages occurred clearly before any of the boxes were opened from the appearance of the exterior of the boxes, also stated in my order timeline. Myself and/or my company will not take responsibility for the entire order of any damaged products we have received from Moni’s Coconut Scrubs. This should be the responsibility taken care of by the sender. I have never heard of a customer being responsible for damaged products received by a company by fault on that companies end.The packages were not brought back to USPS because Joseph stated he would take care of communicating with USPS directly on behalf of Monis coconut scrubs. Joseph stated in email- “We will handle to USPS and if we can get any refund back from them, we will use it to soften the loss that we will have on our end. Doing it this way will insure that you don't have any losses on your end of things and we hope that you will want to continue to use Moni's as you move forward with your shoppe.” He also stated “From what I got from the post office is that only the shipping company can make the claims.” Joseph is the one who shipped out all the product, therefor USPS held him as the responsible party for the damages as well as not providing extra insurance coverage for the products he had sent out. After I read this statement emailed to me I had come to the conclusion that myself or my company would not take any loss from the order I had placed.As I repeat saying this again, the packaging was not properly done by this company. Products are supposed to be properly and professionally sealed before they are advertised for sale to the public. Considering this is “food grade” skincare products they should be sealed completely shut before distributing each product out to the public. The safety seals were not completely shut closed when Moni’s Coconut scrubs packaged all of the products they had sent to me. This should be a red flag and safety concern brought up to health officials. Every company I have ever worked with all ensure their products are sealed shut and guarantee no leakage upon delivery. Joseph and Monika have failed to ensure proper packaging before delivering the product.Joseph came up with an idea that instead of sending me a full refund of $837.00 or resending me the product right away he would ship product out to customers until I sell the amount that I paid to Moni’s coconut scrubs for the product. The agreement was Monika and Joseph were supposed to send out my orders right away and keep me updated with details about my orders being placed with their company. This is where the issue to his solution he offered fails. Joseph and Monika failed to send out product right away to my customers. And another issue was when customers received product, the orders that Moni’s Coconut Scrubs fulfilled arrived to my customers leaking or the safety seals were not completely shut. This has caused loss on my end where I have to make it up to my customers by refunding them for the product or sending out a product in exchange for the issues they had encountered with product sent by Moni’s Coconut scrubs. This is where I know I am not the only individual or company that has received damaged product from them. I take pride in my company and value my customers, I would never ask a customer who orders product from Beauty Glow Bar to be responsible for damages that have occurred in the hands of my company or during shipment. As for Joseph saying my company Beauty Glow Bar did not have enough business and he thinks this is why the agreement did not work out. This is completely false and only his opinion. The agreement we decided on did not work out because he was not able to hold up on his end of this agreement made. Selling products on my website was not an issue. My company was fairly new so I did ask him for advice about upselling Moni’s Coconut Scrubs. Due to not having actual product in hand to show customers I was at a disadvantage. On October 9, 2019 I had no other choice but to file a dispute with my credit card company due to Moni’s Coconut scrubs not being able to give me the option for a refund and continuing to provide me with lack of communication as well as no solution to this issue. On October 28,2019 Joseph wrote a letter back to my attorney after he had received a notice in the mail demanding to provide me with a refund for $837. I provided all hard documents and written communication for evidence which Joseph and Monika have been unable to do this whole time because they knew they were at fault with what has happened.Joseph stated in this letter- “As of this date, Makani has received full refund from her credit card company” “I would politely request that this matter be closed” “We are not going to send Makani any additional funds as she has already received a full refund from her credit card company”Joseph knew that I had filed a dispute with my credit card company. After admitting he knew I had gotten the funds returned to my account he had asked for this matter to be closed. I thought everything was settled from this point. A few months later I was unaware that Joseph provided documentation to my credit card company about this case being disputed. He altered and omitted important facts in emails to make the credit card company side with him. The information provided by the merchant is not the full details of each communication that took place between us and I feel he did that on purpose to get his money back. Had he provided ALL details, I do not feel the credit card company would have made the decision to charge me back. I was unaware of this charge back until I had arrived home in Hawaii in February of 2020 and opened the documents provided by Barclays credit card company. In this letter they stated I would have 10 days from receiving it to provide documented evidence to reassert my claim with this dispute. I was unable to provide these documents to Barclays in that matter of time due to traveling and this is why WWW.MONISWAY.COM had that advantage of getting that chargeback to their account and the case was closed promptly after those 10 days. Joseph and Monika were given multiple notices from attorneys which he admits to ignoring because he thinks “They are in the right and there is no case.” Normally letters written by attorneys are sent out because there is an issue that has been found and the case needs to be stated and solved. I have no shame in providing all documentation as evidence to support my case. I hope they Joseph and Monika can realize this as I know for a fact I am not at fault and they need to take responsibility for their wrong doings and actions.Till this date I have not received any type of refund. The Merchant Monis Coconut scrubs does not want to come to a fair agreement on providing me with a refund for the damaged products they have sent to me. I don’t believe that they ever were willing to work with me or wanting to provide a fair solution they could keep up with.

This is getting exhausting, and there are way more important things in the world right now like Covid 19, to bother continuing this farce.

This will be my last time reading, and responding to anything on this subject.

THERE WAS an agreement in place to assist with ***s issue. We performed accordingly to that agreement.

There is absolutely no proof that anything was damaged prior to ***'s ***s getting her hands on the product.

She has filed fraudulent claims as to this issue. Because of lack of business, she decided that she wanted her money back, even though Moni's supported and adhered to the terms in the agreement. This is all shown by the very e-mails that *** has attached to this complaint.

She simultaneously had her lawyer threaten to sue us for the full amount of the shipment at the same time she fraudulently applied for a chargeback through her credit card company.

When I asked her if she got the money back from her credit card company, would she then pay us the amount of product we sent to her customers for free-she stated that she will not pay, and does not have to pay and then thinking she had scammed the system on this to get the money, she went on to insult me and our company believing that there would be no recourse. This shows the length she will go to in order to take advantage of anything she can. If she believes it fair that we refund her--why does she think she should not be responsible to pay for the items we sent her customers?

Simply put-the post office does not agree with her claim, her own credit card company does not agree with her claim, and we do not believe her claim. Moni's tried to craft an appropriate agreement to make her happy as a client-which she was, until she decided months later that she did not want to adhere to this agreement.

I would strongly urge anyone reading this to think twice about working with Beauty Glow Bar and ***.

To the Revdex.com, I apologize but this has gone on way to long, with *** offering the same old lies continuously. She is never going to stop this, and never going to cease trying. She is reaching for something that she should not have. WE have tried to do everything we could to keep her happy-as we would with any customer-the difference with this being *** is just not happy with anything that is fair, right or legal. She wants to win and screw over my company at the same time.

Moni's will cease communications on this now. To the Revdex.com, if there is additional legal action that you take on this subject, I will of course act appropriately, but if it is just to answer these false claims over and over again, we are not going to respond. We are not giving her anything else and we are certainly not refunding her. We have tried to make it right for her, even though we know, and she knows, that she is trying to get away with this fraud and sham she has created.

My attorney has a cease and desist letter ready to send *** as this is just getting out of hand. I will copy the Revdex.com and all appropriate entities on this cease and desist when I have it served.

I am rejecting this response because:

I stand firm on this claim. I would like to resolve this adequately. The merchant WWW.MONISWAY.COM does not want to come to a fair agreement. Why should I be responsible for giving away $837.00 to a company and receive damaged product. Joseph should know better than to think I would just give up on giving their company that much of a large amount of money and not receiving any type of relief back. I will fight for everything that is rightfully mine. The money given to pay for specific product advertised was not josephs to begin with. So, what is he to say this money is his to keep?The statements he has made from day one is his opinions, they are not true facts he is providing. Had he come up with a fair solution months ago that he could abide by, this wouldn’t be happening. I have all the facts to say he and his company have not been fair or truthful with what is going on. I don’t agree with anything at all he is because it has come to a point of his word against mine except I have all the documents to prove what has happened. I am not talking about anything else happening in the world but the issue stated itself. Again, I am saying this matter has not been resolved, this needs to be brought to attention. I stand firm on my claim, decision, and evidence provided.
