Complaint: [redacted] I am rejecting this response because: I have read the response from MrL*** and would like to address some things My last communication with the business was November At no time prior did the owner suggest I quitInstead he continued to take my money and train meAt our last meeting in November we came to a mutual agreement to stop trainingAt this point, the owner was angry and refused to communicate further or offer any mutually agreeable outcomeAfter our meeting, I discontinued my membership with the gym where he trains, and have had no contact with him in any form since that day This is in no way harassment As far as Duty of Care, I believe that MrL [redacted] breached thatA Duty of Care is defined as a legal responsibility not to cause harm All fitness professionals have a duty of care to their clients when providing instruction or advice, to ensure that reasonable steps are taken so that harm that could reasonably be expected to occur is avoidedA breach of duty occurs when one person or company has a duty of care, but fails to live up to that standard, resulting in the client suffering harm because of what the person did or didn't do I was injured multiple times during personal training, resulting in months of doctor, physical therapist and orthopedic surgeon visits MrL [redacted] says no business was conducted under The Lift House since spring of I am unsure of when he stopped doing business under that name and began doing business under Monsters of StrengthHe did not discuss the change with me, but continued to train me in the same programs without any lapse between the two businessesI would like to submit a complaint with the Revdex.com regarding his second business At this time I continue to request a refund in the amount of $for the following: $1,for personal training $1,for boot camp $for the conditioning class $for Strongman Saturday training I reached out to the business in November to come to a mutual agreement and a positive outcomeMrL***’s response then and now shows me a lack of concern or responsibility on his partI was hoping by reaching out to the Revdex.com that we could resolve this without further actionI would like to thank the Revdex.com for helping assist me in this matter and for making additional suggestions regarding this situation Thank you, Sincerely, [redacted]

reiterated this to her several times.  At one point, I clearly stated I thought it was better for both of us if my services were terminated.  But, she insisted on continuing, to the point of harassment.  This harassment has not yet ended.  Contrary to claimants assertion, no duty of care was breached.  Additionally, no business has been conducted under the Lift House since spring of 2015 and the application for dissolution has been filed with the State of Oregon.

I have read the response from Mr. L[redacted] and would like to address some things.
 
My last communication with the business was November 2015.  At no time prior did the owner suggest I quit. Instead he continued to take my money and train me. At our last meeting in November we came to a mutual agreement to stop training. At this point, the owner was angry and refused to communicate further or offer any mutually agreeable outcome. After our meeting, I discontinued my membership with the gym where he trains, and have had no contact with him in any form since that day.  This is in no way harassment.
 
As far as Duty of Care, I believe that Mr. L[redacted] breached that. A  Duty of Care is defined as a legal responsibility not to cause harm.   All fitness professionals have a duty of care to their clients when providing instruction or advice, to ensure that reasonable steps are taken so that harm that could reasonably be expected to occur is avoided. A breach of duty occurs when one person or company has a duty of care, but fails to live up to that standard, resulting in the client suffering harm because of what the person did or didn't do.  I was injured multiple times during personal training, resulting in 11 months of doctor, physical therapist and orthopedic surgeon visits. 
 
Mr. L[redacted] says no business was conducted under The Lift House since spring of 2015. I am unsure of when he stopped doing business under that name and began doing business under Monsters of Strength. He did not discuss the change with me, but continued to train me in the same programs without any lapse between the two businesses. I would like to submit a complaint with the Revdex.com regarding his second business.
 
At this time I continue to request a refund in the amount of $3660 for the following:
$1,560 for personal training
$1,200 for boot camp
$750 for the conditioning class
$150 for Strongman Saturday training
 
 
I reached out to the business in November to come to a mutual agreement and a positive outcome. Mr. L[redacted]’s response then and now shows me a lack of concern or responsibility on his part. I was hoping by reaching out to the Revdex.com that we could resolve this without further action. I would like to thank the Revdex.com for helping assist me in this matter and for making additional suggestions regarding this situation.
