Hello [redacted], Mr. [redacted] came to our office on XX-XX-XX and was upset with our office staff due to us not notifying him that his rent was due. When Mr. [redacted] moved in to our community here at Monte Azul he was explained to and given a...

copy of his lease contract stating on when and how much his rent is due for every month for the deration of his lease term.
Rent is due on the 1st of every month and we give every resident a 5 day grace period to pay rent either to the leasing office or through our resident portal (online).
Here at Monte Azul we do not contact our residents or send them any notification that their rent is due. Mr. [redacted] did sign up online so he can pay his rent and Mr. [redacted] didn't pay his rent for December till 12-18-15, which now included a late fee of $100 which he was responsible for.
If rent isn't paid in full by the 5th of every month we charge a late fee of $100 on the 6th.

For one thing I find the entire response from Monte Azul Apartments grossly deceitful.
As an example, the statement from Monte Azul Apartments, "Here at Monte Azul we do not our residents or contact them when their rent is due," is a flat misrepresentation. The parent company, Trinity leasing, except for December had and since always has sent me the bill for the rent due promptly on each first of each month on every month that I had and have been there except for December. December was the exception. Even on this January 1, the following month, well after the incident, I received the usual bill that included the $900 for the rent.
In December, though, I received a smaller bill. That bill I busily and hurriedly paid promptly on line with my credit card on or about December 1, it was my intention to to visit their office to find out why the bill was so small. (Then the happenings followed as indicated in my original complaint.)
The date that Monte Azul gave for the rest of the December payment was also a gross misrepresentation. That payment of $1,000 ($900 plus the disputed late charge of $100) was paid on or about December 8 by a bank draft because their system was down and could not credit card payments. Also because their own system was down, my payment was not processed by them until December 18. (In other words the balance of the rent was paid on our about December 8 but was not processed by them until December 18, and they know it.
Yes it was originally agreed that my payments would be due on the first of each month, but their billing practice clearly gave me the false impression that the procedure would be that I would pay by rent in response to the bills sent to me on line, not assume something else
As for proof of the bills, I would have to research my past e-mails, but I believe that I have them all and could produce them my unlimited email storage at GoDaddy.com
Of course there is the possibility that the problem is arising from the computer problems that Monte Azul or Trinity Leasing, the parent company, was obviously having at the time, but to me that would make little if any difference in the situation or to my complaint. They have to accept responsibility for both their own computer problems and the resulting deceptions that they cause to others. In this case they are accepting no responsibility at all for their deceptions but instead capitalizing on them at others' expense.
Also their opening statement, "Mr. [redacted] came to our office on XX-XX-XX sic (The date should be 12-8-15.)and was upset with our office staff due to us not notifying him that his rent was due," is an equally gross misrepresentation. I instead came in politely with questions about a "pay rent or quit" notice first to find out why I was receiving such a notice in that way when I had paid the full amount given to me in my bill, and to find out why the bill had been so small. In fact did not get upset until the office staff members began "talking down" to me and showing no concern at all from their end for the problems that they had caused through their confusing and deceptive billing.
The issue was thus never that they had not sent me a notice that my rent was due, and they know it. I did not need one because I had received a bill. The issue was instead their deceptive billing, their misrepresentation about it, and their failure to accept any responsibility for their deception regardless of whether the misrepresentation was deliberate or due to their own computer problems.
