This letter is in response to the consumer complaint related
to *** ***, complaint ID ***.
Nation’s
Lending Corporation (“NLC”) has spoken with the complainant and
investigated the complaint internally in order to fully and promptly address
the situation
After speaking with the complainant and reviewing his concerns
related to the transaction, it was determined there was a breakdown in
communication. As soon as the
underwriter conditioned for the Sherriff’s deed, the deed should have been
requested from the borrower and reviewed immediately. Had the deed been reviewed immediately by NLC
staff, the borrower would have been informed he did not qualify for the
loan. Thus, the borrower would not have
been out his $in earnest money
After careful consideration and review, NLC has decided to
refund the borrower the requested amount of $he spent on his earnest money
deposit.
At Nations Lending Corporation, we strive to provide a
superior customer service experience and we apologize that this potential borrower
did not receive an experience that meets our high standards

reached out to both the borrower and loan officer to obtain a complete understanding of the issue at handPer the complaint the borrower requested a refund of the appraisal charge that was paid to the appraisal management company and months of compensation for time spent providing documentationFor various reasons, some loan applications can become more complicated and time consuming than others. This particular loan file had several issues, but NLC feels the loan officer worked diligently to resolve these issues in a timely manner and NLC does not feel at fault to compensate for the borrower’s time spent addressing these issuesHowever, after reviewing the loan file notes, NLC management does feel that the complainant addressed concerns regarding his credit profile before the appraisal was orderedIn conclusion, out of goodwill for the miscommunication, Nations Lending will cover the cost of the appraisal fee that was ordered through the third party vendor. Our Goal at NLC is to provide a positive customer experience no matter the end result of a loan applicationWe take all customer complaints very seriously and work to resolve each issue both swiftly and efficiently

I will state again that the initial agent Gerald *** was aware of the fact that our property had been re-titled back to us in January of when we first began the qualification information needed to apply for any loan with NLC. At no time did anyone question that fact or that it would make any difference in obtaining the loan. We were the initial owners and had paid off the first mortgage on the property and have lived on the property for the last years. We have been contacted by Carolyn ***, an employee of NLC, who offered us $in resolution, not $450.00 To my knowledge there has been no money refunded as I made it very clear to Miss *** that was not an acceptable resolution, and flatly refused her offer. As far as another review from NLC in the future, we would not qualify for their loan or any other loan from a lender due to the long loan process with NLC, the status of our credit score, (from the time of applying to loan denial our credit score dropped points.) At this time we are financially unable to pay our basic living expenses and are considering bankruptcy since dealing with NLC. Had NLC been more truthful and transparent we might now have our finances taken care of and our credit saved. We tried desperately to make that happen, and because we were dependent and trusting in what NLC lead us to believe we now are facing a financial crisis

At the time the concern was received via the Revdex.com, a member of the NLC management team was already in review of the loan after being contacted directly by the consumer In 2016, the consumer began a loan application with a branch of Nations Lending. Once it was discovered that NLC could not proceed with closing the current loan, the consumer contacted the branch requesting reimbursement of her third-party appraisal fee. After speaking with the branch manager, it was agreed that the consumer would receive a refund of $and the check was sent to the mailing address listed on her signed loan application. The branch was not aware the consumer never received the check until the consumer later contacted them in It was discovered that the property address was incorrect, and the issue was quickly rectified by mailing another check to the newly confirmed address. During this time, the consumer was also in contact with NLC management who spoke with the consumer to confirm receipt of the checkDuring that conversation, she requested the full refund for her appraisal due to recently discovering she had previously received an NLC Loans Year Rate Guarantee for her prior loan. At the time of loan application in 2016, the Personal Mortgage Advisor was unaware that the consumer’s prior loan was through NLC, and the consumer had made no mention of the 5-year loan guarantee program. Because of the misunderstanding, NLC issued a full appraisal refund back to the consumer At NLC, we take all consumer concerns very serious and our goal is to provide a positive experience. A member of the management team reached out to the consumer and verified that she is fully satisfied

Nations Lending Corporation (“NLC”) received the submitted concern, and a member of the management team immediately began a review of the loan file. NLC considers all allegations of exploitation very seriously, and respects all consumers regardless of age. We conduct business in a
professional manner and treat all consumers equally. NLC is committed to helping our veterans achieve their dream of homeownership. On the appraisal report, the appraiser noted that home improvements would need to be made to satisfy *** guidelines. NLC does not appraise homes nor does it determine values, condition or any improvements associated with homes to determine their eligibility for any program that NLC offers to its customers. Those improvements were not required by NLC, nor did NLC direct the consumers to physically complete those repairs on their own. In addition to the appraisal issue, it was determined while the loan was moving thru the process, the title company discovered that the consumer owned the land for many years, but title was not in their name the entire time. Title ownership recently changed into their name, but was not in the consumer’s name for the previous months. The program that the borrower had been applying for requires the borrower to be on title to the property for the previous months Nations Lending Corporation takes pride in treating all consumers with high regards and providing a positive experienceAfter review of the file, NLC has determined that other than the initial appraisal amount of $there should not have been any additional charges to the borrowers and those fees have been refunded. We have informed the consumer that we would be happy to review a new application once the month vesting in title requirement is met

officer and processor were contacted in an attempt to gain a better understanding of the concerns raised.   The loan processor assigned to the file was mistakenly under the impression that the particular investor associated with the complainant’s file, required the dwelling coverage to be equal or in excess of the total loan amount.  With this particular case, that was simply not correct.  The processor later clarified this requirement with the underwriter and let the complainant know that his coverage amount was sufficient.   The complainant was not satisfied with the response and still wished to withdraw his loan application.  Per his request, NLC withdrew his application as requested and ceased correspondence.  After the complaint was received from the Revdex.com, a member of the NLC management team verified that no representatives would contact the complainant or other parties involved in the transaction.    NLC transferred the appraisal to the complainant’s new lender as requested. Later, a member of the management team verified the new lender had received the transferred appraisal.    Our goal at NLC is to provide a positive customer experience no matter the end result of a loan application. (“NLC”) has reviewed and investigated the Better BusinessBureau complaint filed by the consumer on 11/17/17, and received by NLC managementon 1/3/18. To further understand the consumers concern, a member of managementmade several attempts to speak to the consumer, however, no call was returned.Management then reached out to all parties involved to get an understanding of thismatter.When the consumer began the loan process with NLC, an initial credit report was pulledwith no indication that the consumer had an existing FHA loan. As NLC continuedreview of the loan file and proceeded towards loan approval, a Credit SupplementReport was pulled as one of the last requirements prior to issuing a final loan approval.When reviewing the Credit Supplement Report, the consumers current mortgageappeared as an FHA mortgage loan. Per FHA guidelines, a consumer cannot have morethan one FHA mortgage loan simultaneously, unless they meet one of the fewexceptions, which the consumer did not. As a result, the consumer was not eligible foran FHA loan. The Personal Mortgage Advisor and Branch manager made many attemptsto speak to the consumer regarding other loan options, however, no contact wassuccessfully made.Nations Lending Corporation takes pride in treating all consumers with high regard andproviding a positive experience. Should the consumer choose to contact NLC, we aremore than willing to continue working with them to consider their loan options.

and consumer were contacted in an effort to gain a better understanding of the concerns raised. After a thorough review, NLC management determined that the subject property had been built within the same year the consumer completed the loan application with NLC.  Due to the time frame, the home did not meet an FHA guideline requiring a 12 month seasoning of newly constructed homes. A follow up was scheduled for the beginning of March.  However, due to unforeseen circumstances, the loan officer was out of the office and was unaware that the borrower had reached out to continue his loan application. Once the loan officer returned, he reached out to the consumer to continue the loan process with NLC, but the consumer had already initiated a loan with a different lender. Due to the circumstance regarding the FHA guideline, NLC has decided to refund the third party appraisal fee back to the consumer. Our goal at NLC is to provide a positive customer experience, no matter the end result of a loan application is. investigation.  The loan file was reviewed and the loan officer and consumer were contacted to obtain a better understanding of the concerns.As indicated in the complaint, the consumer had a discussion with the loan officer requesting NLC send a Notary to their home to provide and sign the initial loan disclosures.  During the loan process, there were concerns of how the property was titled and NLC was unable to verify that until the preliminary title and appraisal were received.  The consumers concern stems from a miscommunication regarding the property ownership.  Due to the circumstance, out of goodwill for the consumer, NLC has decided to reimburse them for the third-party appraisal fee.   Nations Lending Corporation takes all consumer concerns seriously and works diligently to resolve each one in a timely fashion. complaint submitted by the consumer on 11/20/17.  Nations Lending Corporation (“NLC”) received the complaint on 1/3/18 and a member of the management team immediately began researching the consumers concerns.  When contacting the consumer regarding the concerns, she stated that this matter was handled promptly, prior to NLC receiving the filed complaint.  The borrower mistakenly believed that the Personal Mortgage Advisor (“PMA”) chose the appraisal company to appraise her property.  At NLC, all conventional appraisal orders are submitted through an approved third-party Appraisal Management Company (“AMC”).  The AMC works with a list of approved Appraisers and selects an Appraiser qualified to complete the appraisal report.  The fee associated with the appraisal is based on many variables, including property location, property type, etc.  When the consumer began the loan process with NLC, the PMA provided her with initial documentation quoting $725 for the completion of an appraisal report, considering many of those same variables.  As it turned out, the cost provided by the AMC was only $600.  Following the completion of the property inspection, the Appraiser noted the consumer did not own the land.  As a result, the consumer did not meet the required conventional guidelines for a manufactured home to proceed with the loan.  NLC does not instruct any consumer not to make their obligatory monthly mortgage payment to their current lender during the loan process.  NLC takes pride in providing excellent customer service and a positive consumer experience.  When the Branch Manager got involved and discussed the circumstances with the consumer, he realized a question could have been asked at the time of application that would have prevented the appraisal all together.  For that reason and in good will, he promptly refunded the cost of the appraisal to the consumer.  A member of NLC management team followed up with the consumer and she is thoroughly satisfied that this concern was resolved prior to NLC receiving her filed complaint.

After filing our initial response, NLC management was able to complete an in-depth review of the filed complaint.  The loan officer, branch manager, and support staff associated with the loan were interviewed to clarify the situation and allow NLC Management to gain a better understanding of what happened.  In order to fully complete the investigation, NLC management needed to speak with the borrower in more detail.  Management attempted to reach the complainant multiple times and eventually he responded via email.  Mr. [redacted] declined and stated that he was "advised by both my lawyers not to speak with anyone from NLC."

Nations’ Lending Corporation (“NLC”) has spoken with the complainant in order to fully understand and address the situation and determined that there was a miscommunication between the loan officer and borrower during the loan process regarding the borrowers’ F-1 [redacted] work status.
