I am the homeowner on Brassfield Road, and Monterey Bay Raleigh LLC of ***
*** bought the three acre lots behind our home
Our home has a fence around the entire property that has been in there since we moved into the house, approximately yearsWe planted a hedge of Leyland Cyprus trees/ Cryptomeira on three sides of one acre/corner lot property in When the builder broke ground on the first home and started clearing trees, 2016, we purchased and planted Crytpomeria evergreen trees (at approximately $to $wholesale prices) to finish the back of the property
Monterey Bay Raleigh LLC built one home on the middle lot and broke ground on a home on a lot directly behind our homeAt that time they contacted us that our fence was encroaching on the lotThey asked us as well as our neighbors to move the fenceThey didn't clearly mark where the property line was, and asked we figure that outI asked the builder representative, *** at that time if we needed to move the Cryptomeira as well? And he told me no, they would leave those trees as a barrier for the home and nice landscapingWe moved the fence in good faith and left the Cryptomeira The builder contacted us and told us out of the post with foot sections -four of those sections were still encroaching on the property by inchesWe asked him to clearly mark the property line and he did not mark the lineThe next thing we heard was from a lawyer via *** to move the fenceWe asked the builder again via text to please mark what part of the fence was on the line, he did notWe hired a NC Certified Surveyor to assess the line and he marked the line, we again moved those four post and sections of fence
We arrived home March 17th and the builder had dug up the Cryptomeira and moved several to other places in the back of the property to build a screen in the rear of the homeI called *** and asked him why he went back on what he had said and informed him, just as we moved the fence we were taking the Cryptomeira back to our side of the property line to keep the hedge between the lotsWe did call the *** County Sherriff department when we did this for a record of what had occurredAt that time *** was on site and did admit he took our trees for his own use
Today we received a call from his attorney that we needed to move our fence threatening us to file injunctions and court appearances if we don't move our fenceAt that time the lawyer was not aware of the details and seemed concerned by the feedback he was getting from the builder in regards to how much if any our fences was still on the property
We explained what had transpired 3/17/and we had to call the Sherriff for him taking the trees and at that time he had told the Sherriff here are four pickets encroaching less than an inch on his property lineI feel like he was upset that he had to pay his lawyer for us to comply with moving the fence the second time (which we moved) and he then took and moved our trees
In closing I would like to write a complaint through the Revdex.com for consumers who may want to use the services of this builder to beware
