profiling.Response to this Complaint:In May, 2017, the complainant and his wife visited our SCHOOL for a tour and to inquire about any positions available for the 2017-SCHOOL YEAR for his year old SON, not daughter After touring the SCHOOL, not DAY CARE, they decided to complete an Application for Admission and submitted a check in the amount of $to reserve a spot for their year old SON, not daughter In good faith we reserved a spot for their year old SON which would begin on August 21, In July of I sent out emails to all of the parents that had submitted an Application for Admission and informed them that the Registration fee, Material fee, and 1st months tuition was due on August 1, Our contract is a month contract beginning on August 1st After submitting my email to the complainant I received no response so I resubmitted the email to remind them that the registration, material fee, and 1st months tuition was due by August 1st, The email was submitted to the wife of the complainant this was the only email submitted on the application for admission I received a response from the wife of the complainant after August 1st telling me that her husband would be in contact with me to take care of the fees due During the week of August 7-11, anyone who did not respond to the email was called The complainant was called times during that week and we received no response from the complainants I made a final call to the husband on Tuesday, August 15, 2017, to let him know that the spot that he had reserved for his SON was no longer available since he had not responded to the emails or phone calls and no payment had been made His response was not what I expected ..he stated he had already paid the fee ONLINE and quoted me the amount It was not the amount due from the invoice that was submitted to his wife in July and August I stated that we do not have an ONLINE payment system set up for our SCHOOL He was very confused and asked if he could call me back to see what was going on When the complainant called back he could not really explain what had occurred, but it was obvious to us that he had enrolled his SON in another SCHOOL and was not going to be sending him to our SCHOOL for the 2017-school year In good faith, we reserved a spot for his year old SON and therefore did not fill that spot with another student We were notified on August 15, 2017, that his SON would not be attending our SCHOOL (NOT DAY CARE) for the school year During the conversation he asked if his daughter could attend our SCHOOL in lieu of his son I told him that I would need to look at my attendance and that I would get back with him I called the complainant back and told him that we would accept the enrollment of his year old daughter and forward the $deposit originally submitted for his SON towards the enrollment of his daughter In order to attend our SCHOOL one of the stipulations is that your child must be potty trained, or in the process of being potty trained and be able to communicate those needs to us, in order to attend our SCHOOL Their child was not potty trained or in the process of being potty trained This was not disclosed to us in the beginning The complainants came to our SCHOOL on August 21, 2017, and submitted all of the enrollment forms for their daughter to enroll into our SCHOOL It was the first day of school and I was busy teaching my class so was unable to visit with at that time I did have their contract ready to sign and they signed the contract We did go over each statement in the contract and had the parent initial and sign and date They told me that their daughter was not going to begin her first day until Monday, August 28, They also told me that she would only be attending half days for the month of September from 8:– 11: The wife would be picking the daughter up during the month of September at 11:am each day The signed contract and enrollment packet stated that the child would be in attendance for the school day 8:15-3: We agreed to allow the child to attend half days for the month of September at a reduced rate, which we did not have to extend to them since their contract was for months at the rate disclosed to the parents at the beginning of the contract school year It states that the mother is currently a “housewife” and not employed when the enrollment packet was submitted on August 21, Therefore, I do not understand the monetary loss that they claimed incurred while the full time worker parent was seeking a daycare, not SCHOOL It clearly states in our handbook that if a child has been in our program for a minimum of three weeks they may be asked to leave due to the following reasons:Unable to comply with the rules of the classroomUnable to control their behavior, their own body, or hurts othersParent is unwilling to help their child with therapy outside of the program offered at the schoolConsistent behavior causes the classroom not to be conducive to learning for the other studentsThis child was suffering from separation anxiety from her mother She had never attended another child care facility, mother’s day out program, or school and cried continually whenever her mother walked out of the building In fact, the child began crying before she even walked into the door and upon the mother’s exit she began screaming My assistants and myself tried many types of redirections to get her involved in the activities that we were participating in She cried non-stop from the moment she was dropped off until the mother picked her up at 11: We even tried giving her one-on-one instruction and she continued to cry even louder It was impossible to conduct a classroom with a child who cried continuously The mother asked if she could stay for one day during the instruction period and I agreed to see if this would assist with the transition into a new school The child never left the mother’s lap and would not have anything to do with the teacher, director, assistants, or other students She had no interaction with anyone except the mother I allowed this to continue for more days and the same behavior occurred each time This was not assisting the child at all and was not getting the child to become interactive with anyone at the school When she began to leave her by herself, we received her crying and she departed crying The crying was continuous throughout the entire time that she was in attendance We are a SCHOOL ..not a daycare and learning needs to take place for ALL children Learning cannot occur when a child disrupts the entire working session with continual crying and screaming My suggestion to the parents was to take the remainder days in September to work with their child on anxiety separation from the mother I suggested some places to take the child so that she could interact with other children and invited the parents to come back to the school on October 2, 2017, to see if there was improvement in the behavior that the child was displaying It was stated that I rejected her admission ..the admission had not been rejected Since it is stated in our handbook about therapy outside of the school .that is what I offeredWe are a culturally diverse SCHOOL who offers an educational learning institution to any child In conclusion:Child was not potty trained, nor in the processChild was unable to comply with our classroom
