*** and *** contracted us for $3,not for the amount he indicated so that is the first bit of misinformationAnd the additional funds charged were for a digital package that was created and deliveredSo I'm not sure why *** is seeking a refundWe made it clear that we do no refund
engagement fee's because they are not attached to performance but rather help absorb the expense of promoting a product line in several key statesWe also represented *** in Ethiopia and Dubai at no additional charge but at our own loss. Another problem is that *** was informed that their product's wholesale was too high and that was the sole reason they were not experiencing a good responseI advised *** on numerous occasions that he needed to provide a lower price point for wholesale purchase as well as suggested MSRPOriginally we were given price point of $wholesale pricing and $34.99-$for MSRPMost people are not going to pay that much money for a product that has absolutely no brand equity, no name recognition and no retail presence*** did not take our price adjustment advisement seriously until a year had passed with little progressThen when we got a price point that was slightly more manageable *** decided to wait until he knew I was leaving the country for two months to file a complaint demanding back monies that he is not entitled tooMy agency has lost money over the past year trying to present and market this grossly overpriced line and once they finally decide to make the needed price adjustments rather than giving our team a chance to promote with the new price points they file a complaint. In addition, *** and *** have touted themselves as an FDA approved shampoo as it states in bold lettering on the marketing material they supplied us withHowever, each time we've requested paperwork documenting this we've never received anythingThis puts us in a compromising position if there are ever any complaints related to health issues from a line we've represented that doesn't have sufficient paperwork to prove their products are safeWe will not continue representing the *** brand unless they cease all claims and slanderous assertions about our company.*** ***

*** ** and *** skincare have completely fabricated almost every detail within their complaintFirst of all, the engagement fee of $3,is in no way tied to performance and is specifically for travel and lodging expenses related to presenting the clients products throughout a six state
regionWe have a standard agreement that we use for every client that only differs in region and pricing but never on what the engagement fee's are to be used forThe only monies tied directly to performance are commission on orders generatedWe had *** ** sign the signature page of our agreement and we also signed the signature page of "our' agreement*** ** has been circulating an agreement that is not ours and can be proven to not be our because the state governing the agreement she has been circulating is California whereas our business is physically located in IdahoSo it would not only be absurd for us to assign California as a governing body to any agreements we produce, but would also not be practical for us to drive to California to resolve contract disputes. Furthermore, *** ** informed us that her product had an FDA approval and that she could provide paperwork stating such and as of yet we have never received this paperworkSo that misrepresentation was a clear breach of contractHowever, we are still under agreement with *** ** until and would be more than happy to fulfill our agreement as soon as she removes all slanderous statements to the Revdex.com and on our social media sites and everywhere else that she has been spreading vicious lies about our companyWhen and if she agree's to do this we will continue representing her product lineIf she fails to do so we will be forced to defend ourselves and respond with full disclosure about her character and the truth about her product line and why it doesn't currently have any true retail presence.Marcus M***

Complaint: 12208087I am rejecting this response because:Please see emaill communication showing promise but nothing… see attachements and notes below.. Hi ***, Nice talking with you todayLooking forward to a very rewarding relationship for both of our companies in the years to comeHere is what we need to get started:Make check for $3,out to Montgomery Media Group and fedex to:Montgomery Media Group*** ** *** ***
*** *** *** I also will need samples, order forms and any other marketing materials sent to the same address above. We've agreed on the following markets:-California (entire state)-Idaho (entire state)-Oregon (as far as Baker City)-Utah (as far as Salt Lake City)-Washington (as far as Seattle)We've agreed to 15% commission on all orders we generate.I've attached a simple marketing agreement we typically use that states the same. Please let me know if you have any questions Ajay. God Bless, *** ***

I due hereby summarily reject all that Mr*** has falsely claimed here. And this back and forth is really futileIn the first place I think Mr*** need's to take a close look at our master agreement where it clearly states that the engagement fee is for travel and other expense reimbursement for marketing his line in the six states we agreed toIn fact, the amount of naivety on Mr*** part to think that these campaigns could be done any cheaper is really alarmingSo to be clear ENGAGEMENT FEE'S ARE NOT PERFORMANCE BASED. Furthermore, we are still under agreement with Mr*** whereas he has never followed the master agreement protocol for agreement terminationIn regards to Mr*** claims about us marketing his line is Ethiopia without his consent that is a bold faced lieIndeed we were not officially marketing his line in Ethiopia but on more than one occasion prior to my trip to Ethiopia MrPatel and I discussed my going to Ethiopia and I asked if he would like me to take a few brochures and samples just to gauge interest in the event that they decided to expand there in the futureHis response was a big YES, THAT WOULD BE GREAT!! So for Mr*** to act shocked and alarmed that we shared a few brochures in Ethiopia is ridiculous. Now lets discuss marketing materials that by agreement Mr*** is supposed to provide for our teamI stated in no uncertain terms that all marketing materials MUST have MY contact information for obvious reason'sBecause if it had Mr*** information what is to keep him from just fulfilling orders and cutting us out of our due commissions claiming that the order was generated and placed through them not usTo date the only marketing materials that we've ever received contain Mr*** contact information and his alone. If Mr*** would like us to continue representing his line and to fulfill purchase orders he needs to immediately stop making claims and contact us to discuss how we can move forward amicably.Sincerely,*** ***
