As per the Montorio Homes purchase agreement that was signed we do not build retaining wallsA retaining wall was not part of the purchase agreement
As a courtesy the owner of our company said that he will assist these purchasers with the
construction of the stone retaining wall with our instock Montorio supplied landscape blocks and only charge labour
The customer decided that he did not like the selection of landscape blocks that we were to provide and then bought their own materialAt this point the decision was made to no longer complete the work
It was also offered to them that we would build a temporary wood retaining wall and they could build what they want after the rough grade passed
It was decided that Montorio Homes was no longer willing to complete the job as they were requesting, the homeowners were notified and of course they are not happy with that decisionI have been in direct contact with them by email several timesThe decision by management has been to not compensate them for this retaining wall as per the purchase agreement

Re: Case Number: XXXXXXX - XX [redacted]

Dear Kathlene,

We are in receipt of your...

letter dated June 2, 2016 and writing in response to the following address: [redacted], [redacted]

Please note that this rough grading has failed on Mr. [redacted]'s property simply because, "Front yard is at final grade sod (issue final grade certificate)". Unfortunately at this time the only thing we can do is removal of the front yard landscaping in order for this to pass rough grading. The homeowner is free to proceed with rear, final grading and landscaping.

It is important to note that the builder has 9 months after occupancy occurs to complete and receive the rough grade approval. There has been bylaw changes as of recently; one year is also allotted for the final grading to be completed and approved.

Montorio Homes has done its due diligence; we have spoken to the homeowner on several occasions and unfortunately we have to be vague with our rough grading completion dates. Rough grading is dependent on weather and ground conditions. We have to trust our staff onsite. We have responded to Mr. [redacted]'s requests on [redacted] and now The Revdex.com.

We have attached a copy of the most recent rough grading report dated June 2, 2016 for your review.

Also, we have noticed that we did not receive notification from the Revdex.com electronically and are wondering if this is the process?

If there is any further action you would like to see occur, please do not hesitate to contact us at (XXX) XXX-XXXX, extension [redacted]

Sincerely;

Angela R[redacted]

I have rough grade now. So the matter is closed. I am not happy with how long it took. They didn't even call me to say that rough grade had been re inspected I found out from this Revdex.com response

Initial Business Response /* (1000, 5, 2015/12/02) */
Montorio Homes offered a fix that was not acceptable to the homeowner. We recommended that he contact the [redacted] for resolution.
I have attached to an email the report from the [redacted]...

that states the the garage slab meets all acceptable conditions as stated in their guidelines and that no further action is required by the Builder.
