RE: Reply to the Complaint of Mr*** *** Case #***
Dear Mr***:
We are in receipt of the complaint filed against us by Mr*** ***Mr
*** purchased a Dodge Dakota from Budget Car Mart on June 3, for $2,plus tax and feesThe vehicle had 107,miles on the odometer and Mr*** and was over years oldMr*** complains that his Dodge Dakota has developed serious transmission issues that have cost him $1,to repair
No vehicle sold at Budget Car Mart comes with a warranty of any kindVehicles undergo a minimal inspection prior to their sale, and are not guaranteed in any way after they are driven off the lotAll vehicles are sold "As-Is"
Mr*** was aware he was purchasing the vehicle "As-Is" with no warranties or representations of any kindMr*** admits in his complaint that he understood that he was purchasing the vehicle "As-Is"As a business we could not have made our "As-Is" policy any more clearI have attached three documents where Mr*** signed and acknowledged that he was buying his vehicles "As-Is"Also, at no time do we place additives in transmissions to make them function better for a limited time
The business plan is straight forward we sell vehicles at wholesale prices to the public for cash only, we don't finance, we don't sell warranties and we don't offer warrantiesWe encourage all consumers to take the vehicles to a third party for inspection prior to purchase, and we put that offer in writing to them
We understand that this is an unfortunate situation for Mr***, however, we are unable to offer any type of reparations, as it is clear that at the time of purchase he was fully aware of our "As-Is" policiesIf there are any further questions, please contact me at ***
Sincerely,
Jeff M

Mr*** ***, Consultant Revdex.com of Akron WMarket Street Akron, Ohio March 28, RE: Ms*** ***, Compliant ID# *** Dear Mr***: We are in receipt of Ms*** ***’s Complaint Ms*** purchased a
Chrysler on February 23, with 172,miles on the odometer from salesperson *** *** for a total of $including tax and title She test drove the vehicle and mentioned to Mr*** she felt there were issues with the car. Mr*** explained that the vehicle was being sold “As-Is” for half of market value. He offered to let her take the vehicle to a mechanic for inspection. She declined and agreed to the purchase Ms*** was aware she was purchasing the vehicle “As-Is” with no warranty or representations of any kind. She signed multiple documents indicating she agreed to purchase the vehicle “As-Is”. Supporting documents are attached. She was also verbally told by Mr*** that the vehicle was being sold “As-Is”. Lastly, Ms*** was advised that she could bring the vehicle to a mechanic to inspect it prior to purchase should she wish to do so. Selling inexpensive vehicles “As-Is” without guarantees of any kind is the whole thrust of our business plan. As a business we could not have made our “As-Is” policy any more clear; every vehicle on our lot is sold “As-Is” with no warranties of any kind. We certainly do our best to present quality used vehicles on our lot, but it is impossible to make guarantees of any kind for vehicles of this age without charging a premium. Ms*** had the opportunity to have the vehicle inspected prior to delivery, and declined to do so If there are any further questions, please contact me at *** *** Sincerely, *** *** General Manager Budget Car Mart

RE: Case#[redacted] (Ref#[redacted])
Mr. [redacted],
We are in receipt of Ms. [redacted]'s complaint....

Ms. [redacted] traded in a 2013 Subaru Impreza valued at $12,600 and purchased a 1998 Honda Accord from Budget Car Mart on March 23, 2016.
Ms. [redacted] was aware she was purchasing the vehicle "As-Is" with no warranty or representations of any kind. She signed multiple documents indicating she agreed to purchase the vehicle "As-Is". Supporting documents are attached. She was also verbally told by salesperson Craig Newcombe that the vehicle was being sold "As-Is". Lastly, Ms. [redacted] was advised that she could bring the vehicle to a mechanic to inspect it prior to purchase should she wish to do so.
Selling inexpensive vehicles "As-Is" without guarantees of any kind is the whole thrust of our business plan. As a business we could not have made our "As-Is" policy any more clear; every vehicle on our lot is sold "As-Is" with no warranties of any kind.
All vehicles on this lot are sold "As-Is" with no warranty or representations of any kind. We certainly do our best to present quality used vehicles on our lot, but it is impossible to make guarantees of any kind for vehicles of this age without charging a premium.
We do sympathize with Ms. [redacted]'s situation. As a goodwill gesture we would like to offer her up to $200 towards the cost of the brake repair. She may send me a copy of the repair invoice and a receipt and I will issue a check directly to her.
If there are any further questions, please contact me at [redacted].
Sincerely,
Jeff M[redacted]
