Initial Business Response / [redacted] (1000, 6, 2015/12/17) */ Contact Name and Title: Scott [redacted] President Contact Phone: XXX-XXX-XXXX Contact Email: [redacted] @gmail.com Moore Custom Homes was contacted by [redacted] and her boyfriend, [redacted] in early January to restore her home after a fire occurred on 1/1/During this time it was uncertain whether the insurance would pay for said repairs/restoration as Mr [redacted] was publicly called a "danger to the public" by Porter County Deputy Prosecutor and charged with numerous felony drug charges and an allegation of bomb building after substantial suspicious items were found at the site of the house fireRegardless of this, Moore Custom Homes put together an estimate to restore home and ultimately the estimate was put into a contract that was agreed upon by Ms [redacted] and Scott [redacted] President of Moore Custom Homes, IncAll repairs per contract have been repairedAll material used is quality material that has met or exceeded local and state building codesAll inspections have been thoroughly completed by appropriate building inspection team members and have been passed with green tagsThere is no damage to the marble floor from any heavy materials involving our repairsThe existing side deck was compromised when the cleaners had a dumpster delivered and the driver accidentally hit the deckMs [redacted] was immediately notified and a report was created and sent to the dumpster companyAs a result, the damaged areas of said deck were rebuilt with better quality materials than the original deck containedRegarding the accusation of "burnt studs": Any and all burned studs, rafters, sheeting, etcwere removed and replaced with new woodAbsolutely NO burnt studs were covered in drywallThe home is very old and some of the studs are substantially aged, thus many of these aged studs are dark in appearanceThese are the studs Mr [redacted] tried to say were "burnt"I can assure, no building inspector would pass an inspection and allow for drywall to be installed over compromised studs, nor would I, a quality contractor, proceed in such a mannerPer our contract, Smoke odor has been sealed in necessary areas throughout homeThere have been delays due to acts beyond our control, Ie; weather, scheduling of ordered items, etcRegarding the accusation of "rain water entering into exterior of residence"; I have not ever been notified that the exterior of the home was left open, nor do I see evidence of said water or mold damage that was not a preexisting issue prior to start of restoration workIf this was indeed an issue, I have to ask why the Homeowner, (who has keys to the home and frequents the home often), would not secure the home in order to alleviate said conditions? Also, it should be noted that the sump pump located in the basement is a "make shift" pump assumingly made by Homeowner or boyfriend, this could potentially be part or all of the problemIt should also be noted that my scope of work does not include anything having to do with potentially faulty make-shift sump pump or water issues in basementRegarding the accusation of "stolen items"; MrPilipovich stated he was missing items he believes were stolen, however none of the extensive photos on file seem to show any of said items were ever in the home when restoration work beganI suggested they file a police report for any items they believe to be stolenAt least one of the items he claimed to be stolen was out of the garage in which our firm has never been inAt the time of the filing of this complaint, paint was still in progress, therefore, any "drips" or drywall issues have been resolved during paint phaseAll electrical inspections have thoroughly been inspected and passedThe complaint stated "water pipes leak throughout", however water was not turned on in this home until 12/12/15, over a week AFTER this complaint was filed - it should be noted there was NO water in the home until 12/12/The Chesterton Building Department is well aware of the permit and dates issuedWe have been in constant contact with the Building Department in order to ensure all inspections have been successfully passed in order to ensure completion of this projectIn fact, final inspection commenced early this morning and a green tag was issued for occupancy todayUnfortunately, MrPilipovich, although not listed on the mortgage or as an insured, has been exceedingly hostile throughout the projectHis actions and accusations have been far from professionalHe has even resorted to making accusations in attempts to slander my good company name through social mediaAfter reading the compliant, It is believed that Ms***, the initiator of this complaint, and MrPilipovich likely are looking to receive additional money for nothingThis project is complete and Ms [redacted] is able to move into her restored homeThere is one GFI currently being installed, however, we are in possession of a green tag for occupancyIt is my hope that the hostility will end and no further attempts of slander will commenceMoore Custom Homes, Inchas retained an attorney and will proceed with legal action should any further attempts of slander commenceThere will be a lien placed on this property until final payment is receivedContrary to initiated claim by Ms***, Moore Custom Homes, Inchas not been paid in full for this project OFFER:

Initial Business Response / [redacted] (1000, 7, 2017/01/28) */ January 27, Revdex.com of Northern Indiana Response to complaint activity report case #XXXXXXXX General Contractor’s response to Consumer’s original complaint: In regards to the Homeowners statement, “the cement porches are all pitched toward the house, causing the need to rip out newly laid hardwood floorsSeveral attempts to repair were inadequate of front door porch – other porches were told would not be fixed†RESPONSE – Initially there was a problem with a small 3’X4’ section of flooring located inside the home near the front door porchThe Homeowner hired a flooring contractor to replace the small section of wood flooring and the General Contractor paid to have said work completedNext, the General Contractor along with the concrete contractor evaluated the front door porch to determine if and why water was sitting on porchIt was determined that an issue existed and an attempt was made to resolve the issueThis attempt was not successful and therefore another remedy was initiatedThe second remedy proved to be successfulThe concrete contractor acted in a timely manner, as weather dictated, in order to repair and restore accurately It is paramount to mention the significance of properly placed downspoutsDownspouts should direct water AWAY from a home siteOptimally, one would extend the terminal end of the downspout several feet away from the home’s foundation or onto a concrete or vinyl downspout extensionIf a downspout is not run properly, directing water away from the home site, or it is not maintained and has sustained damage; a home owner could be setting their home up for potential damageThis is part of “regular homeowner maintenance†and should not be underestimated as it is an important part of protecting the integrity of the foundation from erosionUnfortunately, this is an existing problem at the [redacted] home siteDuring the summer of 2016, Chad Nuest of Nuest Concrete met with the homeowner and the G.Cin regards to the homeowner’s complaint about the concrete porches being pitched toward the homeA laser was used to determine that all pitches on all porches were accurateIt was observed at that time that all down spouts as well as the sump pump discharge were improperly placed, thus NOT directing water away from the homeIn fact, water was actually being directed to the home and causing visible soil erosion underneath the concrete slabsPhotos were taken at that meeting by the concrete contractor and the homeowner was told for a second time, of the importance of directing water AWAY from the homeHomeowner was also told that the issues he was experiencing were due to improper placement of downspouts and sump discharge as the concrete porches met code and were sloped accurately In response to homeowner stating “flooring was to be put in garage attic build but was not done†RESPONSE: Per the signed contract between homeowner and G.C., Section xxi there is no stipulation of an interior build out of a “storage area†beyond framingThis contract language is extremely clear and both homeowners had the opportunity to add to the contract prior to framingThis particular concern was never brought up or put into writing by either homeowner Regarding doors – the door supplier has met with the homeowner and carefully articulated a resolution plan [redacted] of Carter Lumber has acted as a liaison with Jeldwen, the manufacturer of the custom made 8’ tall doors in questionIt should be noted that while the homeowner states no resolution has ever been made, there has been a date set between the homeowner and Carter Lumber to replace the doors since December of The first attempt to resolve the issue with the doors was made by the GC in late December of Jeldwen was contacted and an onsite inspection in January of revealed the door slabs were warpedJeldwen replaced these slabs and the GC hired a trim carpenter to readjust doors after installation of new slabsAfter completion of said work, homeowner did not contact GC again about the doorsHowever, upon receiving this Revdex.com report in January of 2017, it was discovered that homeowner had contacted Carter Lumber unbeknownst to GCCarter Lumber has advised that they met with homeowner mid-December of and advised home owner that a rep from Jeldwen and [redacted] would schedule to take doors off hinges, realign jambs, shim hinges for tighter fit, replace and install weather stripping as needed, and install necessary hardware (strike plates, astragal hardware, and plates that seal top of door into the head jamb) [redacted] advised homeowner that above said work would be contingent upon weather and set a date of 2/7/to schedule said work In regards to the statement made in report about the decking: “decking and handrails are drooping with a noticeable drop off in areas of deck flooring†RESPONSE: This is the first time the GC has heard of such a claimAs always, proper protocol is to communicate any issue directly with the GCThis may be done via phone, email, or mailGC is responsive and will hold all trades to warranty of their workIt is always the first and foremost goal of the GC to rectify any and all issues with homeowners in a timely and efficient manner In regards to the statement made in the report about a crack in the concrete; “Large crack in cement basement, garage floor, and garage pad†RESPONSE: Homeowner consulted with GC about basement crack prior to closing in March of During said consultation, the crack was evaluated and measuredThe crack was between 1/16†and 1/8†in width and posed no evidence of shifting or allowing moisture into basementHomeowner was advised that in all likelihood, this was a settlement crack and posed no hazard to the structure or integrity of the foundationHomeowner was also told to contact GC if moisture issues or separation ever occurredIn regards to the garage floor or the garage pad – homeowner has never brought this concern to the GC prior to this reportWe urge the homeowner to follow protocol and contact GC via phone, email, or mail, in an effort to schedule an evaluation of said areasAgain this is part of proper homeowner maintenance and disregarding proper protocol is not advised In regards to the statement in the report about depth of foundation; “not pouring foundation deep enough requiring several thousand extra paid by us and only getting a [redacted] credit for retaining wall that was omitted†RESPONSE: Prior to excavation, Homeowners met with excavator and GC to set the location of their home on their propertyHomeowners designated exactly where they desired their home site to be located on their lot and corner stakes were set accordinglyThe elevation of any home site is ALWAYS determined by the LOCATION of the homeWith that said, it is important to understand that the location of the home site as well as topography of the lot directly influence elevationTo say a foundation was “not poured deep enough†reveals ignorance pertaining to the subjectPut another way, had this specific architectural plan been excavated to a greater depth, as the homeowner suggests it should have been, parts of the home would quite literally be below-gradeThis was explained to both homeowners repeatedly in an effort to educate them that the depth of their foundation was accurate in correlation to the location they choose on their lotThe depth of their foundation in no way, shape, or form, resulted in any additional funds to be paid outThe homeowners raised subjective, aesthetic concerns about wanting additional stone to cover part of a wall that was above grade, however additional stone was not necessary and based on the homeowners personal preferenceIn regards to the credit issued for the retaining wall – section B of the contract states that a credit would be issued if a retaining wall was not neededThis credit was issued In regards to basement claim of crack/hole: RESPONSE: Homeowner has repeatedly disregarded proper drainage maintenance techniques and has been warned repeatedly of the repercussions and potential hazards that existPhotos have been taken by concrete contractor as well as GC in order to substantiate and document correlating issuesIt should be noted that NO landscaping was included in the contract to build this homeA “rough†grade is provided to the homeowner in order to pass inspection and obtain occupancy – this was provided by the GCHowever, a Landscape contractor provides the “FINAL†gradeDue to the fact that no landscaping was part of this contract, any concerns regarding the final grade should be directed to the landscaper the homeowners hired In regards to garage door never painted – RESPONSE: This door was scheduled to be painted but due to inclement weather was not completedThe GC would like to schedule this door to be painted, weather permitting, in April of We request the homeowner to email a set of at least dates that will work in order to schedule said work In regards to the statement of “seals on door bottoms being destroyed†– RESPONSE: During the commencement of construction, main doorways were predominately used to enter/exit the homeNo such visible damage was ever observed nor brought to the attention of the GC prior to this report; however, these are the same doors that are scheduled to be replaced on 2/7/Therefore, as previously stated, all weather stripping will be replaced on said doors In regards to “cracking of exterior stone†– RESPONSE: This is the first time GC has heard of such an issueHomeowner is requested to follow proper protocol and contact GC via phone, email, or mail, in an effort to provide more information; location of area in question, size of area, etcAs always, GC is responsive and eager to resolve all issues in a timely and efficient manner In regards to cabinet doors – GC ordered said doors through Kitchens Etcvia the representative named Elliot shortly after closingUpon receiving the Revdex.com report, GC initiated a call to Kitchens Etc, and it was discovered the representative no longer works for this companyTherefore, another attempt has been initiated to order said doors and a follis scheduled for Monday, January 30th, Homeowners are requested to provide dates, via email, for a February delivery and installation of two kitchen cabinet doors Lastly, in regards to the basement handrail – RESPONSE: Homeowner instructed GC not to install standard, round handrail used to pass inspection in basement area due to the fact that he was going to purchase and install a “special†handrail beyond the standardGC acknowledges that homeowner is entitled to the standard; It is my hope that the hostility will end and no further attempts of slander will commence. Moore Custom Homes, Inc. has retained an attorney and will proceed with legal action should any further attempts of slander commence. There will be a lien placed on this property until final payment is received. Contrary to initiated claim by Ms. [redacted], Moore Custom Homes, Inc. has not been paid in full for this project.

General Contractor’s response to Consumer’s original complaint:
In regards to the Homeowners statement, “the cement porches are all...

RESPONSE – Initially there was a problem with a small 3’X4’ section of flooring located inside the home near the front door porch. The Homeowner hired a flooring contractor to replace the small section of wood flooring and the General Contractor paid to have said work completed. Next, the General Contractor along with the concrete contractor evaluated the front door porch to determine if and why water was sitting on porch. It was determined that an issue existed and an attempt was made to resolve the issue. This attempt was not successful and therefore another remedy was initiated. The second remedy proved to be successful. The concrete contractor acted in a timely manner, as weather dictated, in order to repair and restore accurately.
It is paramount to mention the significance of properly placed downspouts. Downspouts should direct water AWAY from a home site. Optimally, one would extend the terminal end of the downspout several feet away from the home’s foundation or onto a concrete or vinyl downspout extension. If a downspout is not run properly, directing water away from the home site, or it is not maintained and has sustained damage; a home owner could be setting their home up for potential damage. This is part of “regular homeowner maintenance” and should not be underestimated as it is an important part of protecting the integrity of the foundation from erosion. Unfortunately, this is an existing problem at the [redacted] home site. The elevation of any home site is ALWAYS determined by the LOCATION of the home. With that said, it is important to understand that the location of the home site as well as topography of the lot directly influence elevation. To say a foundation was “not poured deep enough” reveals ignorance pertaining to the subject. Put another way, had this specific architectural plan been excavated to a greater depth, as the homeowner suggests it should have been, parts of the home would quite literally be below-grade. This was explained to both homeowners repeatedly in an effort to educate them that the depth of their foundation was accurate in correlation to the location they choose on their lot. The depth of their foundation in no way, shape, or form, resulted in any additional funds to be paid out. The homeowners raised subjective, aesthetic concerns about wanting additional stone to cover part of a wall that was above grade, however additional stone was not necessary and based on the homeowners personal preference. In regards to the credit issued for the retaining wall – section 11 B of the contract states that a credit would be issued if a retaining wall was not needed. This credit was issued.
In regards to basement claim of crack/hole:
RESPONSE: Homeowner has repeatedly disregarded proper drainage maintenance techniques and has been warned repeatedly of the repercussions and potential hazards that exist. Photos have been taken by concrete contractor as well as GC in order to substantiate and document correlating issues. It should be noted that NO landscaping was included in the contract to build this home. A “rough” grade is provided to the homeowner in order to pass inspection and obtain occupancy – this was provided by the GC. However, a Landscape contractor provides the “FINAL” grade. Due to the fact that no landscaping was part of this contract, any concerns regarding the final grade should be directed to the landscaper the homeowners hired.
In regards to garage door never painted –
RESPONSE: This door was scheduled to be painted but due to inclement weather was not completed. The GC would like to schedule this door to be painted, weather permitting, in April of 2017. We request the homeowner to email a set of at least 3 dates that will work in order to schedule said work.
In regards to the statement of “seals on door bottoms being destroyed” –
RESPONSE: During the commencement of construction, 2 main doorways were predominately used to enter/exit the home. No such visible damage was ever observed nor brought to the attention of the GC prior to this report; however, these are the same doors that are scheduled to be replaced on 2/7/16. Therefore, as previously stated, all weather stripping will be replaced on said doors.
In regards to “cracking of exterior stone” –
RESPONSE: This is the first time GC has heard of such an issue. Homeowner is requested to follow proper protocol and contact GC via phone, email, or mail, in an effort to provide more information; location of area in question, size of area, etc. As always, GC is responsive and eager to resolve all issues in a timely and efficient manner.
In regards to cabinet doors – GC ordered said doors through Kitchens Etc. via the representative named Elliot shortly after closing. Upon receiving the Revdex.com report, GC initiated a call to Kitchens Etc, and it was discovered the representative no longer works for this company. Therefore, another attempt has been initiated to order said doors and a follow-up is scheduled for Monday, January 30th, 2017. Homeowners are requested to provide dates, via email, for a February delivery and installation of two kitchen cabinet doors.
Lastly, in regards to the basement handrail –
RESPONSE: Homeowner instructed GC not to install standard, round handrail used to pass inspection in basement area due to the fact that he was going to purchase and install a “special” handrail beyond the standard. GC acknowledges that homeowner is entitled to the standard; round handrail typically used per code to obtain occupancy – therefore, this standard handrail will be delivered along with the kitchen cabinet doors.

Moore Custom Homes prepared a lengthy response and addressed each and every concern received from [redacted] and [redacted] on 1/27/17. The response outlined proper protocol for legitimate warranty issues. Within the initial complaint received, MCH found only 2 legitimate issues; (1) one garage service door needs to be painted and (2) two kitchen cabinet doors need to be replaced. It should be noted that BOTH issues require scheduling with the Homeowner. Again, the Homeowner must contact MCH and schedule an appointment. To date, neither [redacted] nor any representative acting on their behalf have contacted MCH. At this point, MCH requests that any and all contact be via email only in order to track correspondence.
