ID [redacted] September 11, To Whom it may Concern, In reply to the complaint made about the Mazda RX8, we are addressing the complaints as follows: Our salesman Joe, has spoken to [redacted] and to his mother and told them that there was not a problem with the carThe vehicle was test driven by [redacted] and a friend, then a second test drive with [redacted] and his motherThere was no problem with the car [redacted] was having a hard time driving the car due to his lack of experience in driving a manualHe was advised to bring the car in and our salesman, our mechanic and I, myself the owner all drove it and our technician did a diagnostic evaluation and could find no problem whatsoever [redacted] told us he was using regular gas and we informed him that he should be using premium gas per the factory recommendationsThere was no defect in the car before he purchased it or when he brought it back in complaining [redacted] then wanted us to absorb the cost of spark plugs because he was told by a parts store that is what was neededWe would certainly not be advised to just start replacing things when there was no diagnostic performed by a technician to come to that conclusion [redacted] was never told that he had a day warrantyEnclosed I am sending you a copy of the warranty that both [redacted] and Victor Ficorilli signed, which clearly states that this was a 50/warranty on the engine , transmission, and steering for days or 1,miles whichever occurs first Please advise us if you need any further information Sincerely,

drive with [redacted] and his mother. There was no problem with the car. [redacted] was having a hard
time driving the car due to his lack of experience in driving a manual. He was advised to bring
the car in and our salesman, our mechanic and I, myself the owner all drove it and our technician
did a diagnostic evaluation and could find no problem whatsoever. [redacted] told us he was using

told by a parts store that is what was needed. We would certainly not be advised to just start
replacing things when there was no diagnostic performed by a technician to come to that
conclusion. [redacted] was never told that he had a 90 day warranty. Enclosed I am sending you a
copy of the warranty that both [redacted] and Victor Ficorilli signed, which clearly states that this
was a 50/50 warranty on the engine , transmission, and steering for 30 days or 1,000 miles
whichever occurs first.

Review: Seller is not disclosing defects on vehicles being sold nor are they honoring warranties provided at the time of sale. Seller is in breach of merchantability warranty, fitness warranty and limited warranty. They are not returning calls or responding to emails during the 90 limited warranty period. They have engaged in false advertising (advertising a vehicle as CLEAN) and deceptive selling business practices by not disclosing accurate inspections, conditions and defects with the vehicle during the sale of the vehicle and further by stating that there is a 90 day warranty and then once the sale is completed suddenly changing the terms and stating the warranty is a 50/50 split on repair costs. The vehicle was not sold "AS IS" however they are non responsive and non cooperative with honoring the warranty.Desired Settlement: We would like the vehicle defects repaired so that it is operating as described at the time of sale. Alternatively, we will have the repairs made by another vendor and would like reimbursement of repair costs.
