Review: On May 17, 2013 a contract was enter into between [redacted] and Moret Construction Co, Inc. to construct an addition to my business. Moret Construction Co, Inc. was provided blueprints from the architect firm of [redacted]. These blueprints had been submitted to the City of Arnold, and approved prior to entering into this contract. At present, the work has not been completed as agree. Moret Construction Co, Inc. has failed to honor the contract enter into by:1) Not completing the work within 90-days. 2) Failed to install a second drive thru loop for drive thru, second loop was on premises, but Moret Construction without consulting me to only install one drive thru loop. 3) Failed to replace the exterior door and install new hardware, once again without consulting me, Moret Construction Co, Inc. decided to not install the exterior door, but give me a credit. Contract called for replace of two doors, not one. 4) Failed to seal the opening in the cement wall were the gas line was run into the building. The opening was approximately six inch, and was not detected for nine months. During the remainder of summer and winter months, my electric and gas bills increased because of their incompetence. My Ice Machine pump burst because of the cold air entering, resulting in purchasing a new pump for $280.00.5) Floor tiles were not laid properly resulting in them lifting up and cracking. Had to be replaced by me.6) Failed to install a drive-thru sliding window per contract, but install a commercial window. 7) Failed to install a fix visual window per contract, but install a sliding window. 8) Install the bathroom sink improperly resulting in my inspection of the business to fail. Moret Construction Co, Inc. then lowered the sink resulting in holes exposed in the bathroom tile instead of replacing it.9) Wired the bathroom heater improperly resulting in blowing the main fuse box if you turned the heater on.10) New cement floor installed is sinking.11) Etc.Desired Settlement: Job completed correctly as specified by the contract enter into by [redacted] and Moret Construction Co, Inc. From the workmanship I have witness completed by Moret Construction Co, Inc. I would prefer a new contractor to correct the problems.

Response:
Please be advised that I represent Moret Construction Company, Inc. in connection with the above
referenced complaint. My client disputes the allegations set forth in the complaint submitted by [redacted]
[redacted] and submits that the project was substantially completed in accordance with the contract.
Attached you will find a copy of a letter from [redacted], architect of the firm of
[redacted]. It is Mr. Johnston’s opinion that the project was fairly complete and the building
occupied and a certificate of occupancy for the project was issued on October 2, 2013. It is my
client’s position that Mr. and Mrs. [redacted] owe the sum of $9,213.50 representing the balance of the
construction contract price.
You should further be advised that because of their failure to pay, my client was forced to file a
mechanic’s lien against the real estate.
I sincerely hope that Mr. and Mrs. [redacted] will now pay the balance due on the contract price and
that this matter can be amicably resolved.
Should you have questions or require additional information, I ask that future correspondence be
addressed to my office at the above address.
