The dealership response is incorrect. When I drove off with my new 2016 Kia Forte on April 22nd, 2016 I had my full approval and in the state of Texas, from doing my due diligence there is no such thing as "funding" on a car. I have been in contact with the State of Texas Consumer Credit Commission and they stated that Texas state law is that I have a legal and binding contract. They have looked over ALL of my contract and paperwork and stated that nowhere does it state that my contract was ever contingent upon financing. They stated also nor is it contingent upon Moritz Kia selling my loan to another company and that if financing cannot be made then Moritz Kia becomes the finance company and carries the loan. It was made clear in the process of applying for my loan that I was an temp employee from 12/28/15 with Accounting principals while working on assignment with Justin brands and I went permanent with Justin Brands 3/28/2016. I even provided Moritz Kia copies of check stubs from accounting principals along with Justin Brands paystub along with my last year tax return. Doing the math, that total would've been a perm employee 1 month with Justin Brands and temp 3 months for a total of 4 months working there and [redacted] had no problem giving me an approval April 22nd 2016. I was then texted April 27, 2016 by [redacted] in finance and he stated that due to the Harley I traded in the payoff was a $252 difference and I needed to come in and redo my paperwork but that it would not change my approval. I went in April 30th and resigned documents. I ended my employment from Justin brands April 28th which was after the time I purchased my new car with my approval and started my new job at Sunset Logistics thru [redacted] April 29th which was a wonderful opportunity making more money and knowing the position was only a 5 weeks temporary and then I would be signed on permanent with Sunset Logistics. [redacted] called me May 12,2016 to do as what I was under the assumption was a welcome call but was blindsided when they told me that due to me switching employment even though I was making more money that due to their policy they would not honor their approval. In the past few weeks I have come to learn that the dealership sold my Harley I traded in and has had to recover it. I spoke with [redacted] their finance manager May 18,2016 and he claimed that Moritz Kia has taken it upon themselves to take the 2006 Harley to Harley Davidson for some repair work that I never authorized and looking online the payoff for the Harley was cleared May 16, 2016. [redacted] said they had stopped payment on the check but as of today May 19, 2016 the Harley still shows paid off.The payoff to [redacted] for my 2011 Kia Sorrento with a broken fuel pump and slipping transmission I traded in was paid May 9, 2016 and then reversed May 13, 2016. [redacted] called me Saturday May 14, 2016 and stated that if a payment was not made by Monday May 16, 2016 that they would be reporting negatively on my credit. I spoke with Matt Decodey the Moritz Kia general manager May 13, 2016 along with their sales manager and they claimed they had more work to do with this and would get back with me. I spoke with [redacted] the finance manager May 14, 2016 and informed him of this info from *** and he claimed he would take care of that payment to keep that from happening and wanted the weekend to try to find another lender to obtain financing so I didn't have to return the car. Monday May 16, 2016 came and went and no payment was made and here I am now with this reporting negatively on my credit due to Moritz Kia yet again not following thru on their promises. I made a payment today May 19, 2016 of $391.00 on my 2011 Kia Sorrento I traded in April 22nd 2016 and that is in the possession of Moritz Kia just to make sure this issue causes no more negativity on my credit. I do know that both parties have to come together and agree for the contract to be cancelled and hopefully we can come to an agreement in the future. Regards, [redacted]

We have been in contract with Ms*** and have explained why the loan can not be fundedShe quit her job while the loan was in the funding process and the lender will not fund because she has not been on her current job for at least monthsThe approval was based on the information that was
provided by her on the credit application and the lender will not approve the loan because she no longer works where she did when she applied for the loanBecause of this, the vehicle needs to be returned to the dealershipWe have agreed to make the payment for her open loan with *** in good faithUnfortunately, we have no control on the lender's guidelines and where not aware that she was going to quit her jobHad we known that, we would not have moved forward with the deal

We have been in contact with Mr*** and believe we have resolved this issue to the customer's satisfaction

*** ***c, the General Sales Manager has spoken to the customer and has arranged to replace the windshield at no cost

We are working to resolve the customer’s complaintWe have called multiple times and sent an email to reach out to the customer but we have not heard back at this timeWe will continue to try to contact the customer to address the complaint and will update our response as soon as we are able to
get in touch with the customer

The Enterprise bill was paid and satisfied by me, billed to my debit Visa on "Fri, Jul 08, 1:pm" for the amount of $and I have email confirmation that includes my receipt.Mr*** *** has now given versions of his storyTwo of these he recorded on my voicemail over the weekend while the misses and I were out at the Peach Festival. • 07/01/- His original promise that Moritz Kia would be covering the additional three days as they let they tech leave early Friday of the July 4th holiday weekend without completing the repairs on my vehicle • 07/05/- That he made no such agreement and rejected the bill Enterprise sent overAt this point the lies and those involved (who may be called as witnesses) are beginning to pile up. • 07/08/- He told me that he and I had never spoken, he had never made that promise, and perhaps it was someone else in another department that had claimed to be him on 7/1. • 07/09/- That he didn't know to pay it and couldn't be sure it was the right invoice that had been sent over (As he claims in his first voicemail left.). • 07/09/- That the Enterprise bill was paid by Moritz Kia (both on my voicemail in his second message and whomever claimed it in their response to the Revdex.com.), which is a bold lie as I have a receipt from Enterprise and a statement from my bankBoth of which I will have certified for a judge to view. I am unable to update this claim, but I did meet with the Moritz Kia general manager Mr. [redacted]c and was reimbursed for the overcharge and giving an extensive apology for the behavior of his subordinates.   If it is possible to update the file to reflect this I would appreciate it.   Cheers, [redacted]

We have tried to contact the customer to resolve the complaint but have not had a call or email back. The phone number we have is ###-###-#### and the email address we have is [redacted]. We have investigated this case and feel we have come to an amicable solution. The customer has agreed to come in and buy the car. This should resolve the complaint.

I went yesterday 5/24/2016 and signed a new contract because Moritz Kia was able to obtain financing thru Kia motors at a lower interest rate and lower payment. They have worked very hard to get this done and I am now very pleased with the outcome.Thank you,
