Complaint: [redacted] I am rejecting this response because: I advised the property management that while the printed photos did not have a date/time stamp I could show proof of the date the photos were taken as they were taken on my phoneI also sent a screenshot of the photos on my USB drive and each photo shows the date/time each photo was takenRegardless of that fact that the property address is not shown you can tell from the photos that it is in fact the propertyI do have a date, time and location stamp on my cell phone, on which the photos were taken to show proof that they were taken at the property on the date we first gained occupancy to the propertyFurthermore the the business argues that there were no time stamps nor address; however, the pictures that they sent me also did not contain an accurate time stamp as the camera time stamp did not accurately match the date in which the business indicated they took the photosTheir photos also did not include an addressOne of the photos I sent is of the front of the house, although the address cannot be seen I would like to also note that I emailed all photos to the business in which the date/time stamp can also be seenThey claimed they did not receive these although I cc'd myself on the emails and got them with no problemWe completed a condition report upon moving into the property which also supports the photos that we took, and although the business accepted the condition report, they refuse to take that into consideration when considering the condition of the property upon our occupancyI also advised the business that we do have witnesses who were present when we moved in that can vouch for the condition of the property upon occupancyIt was not clean so I'm not sure what their contractor advised them, but they property was not clean as reflected in the condition report and photosI'm perplexed that they are alleging that the photos may not be of the place and were not taken at move in, since they are the ones that have tried to scam us out of $of our depositThey also inaccurately charged us for over $(in addition to what they still owe us) including stating that we had a dog on the premises and charged us carpet cleaning feesWe never owned a dog and upon making several requests to the business, they refunded us those chargesThe point here is that they have tried charging us for things that they should not have and this is another example of thatI have sent all necessary documentation to them on several occasions yet their only response has been that in their opinion, the charges are accurateThey refuse to even discuss this matter with me over the phone to try and resolve any confusion, which tells me they are not interested in resolving this, but only in keeping the money they legally owe usWe again, respectfully request a full refund of the remaining money owedI do have the proper documentation for the photographs we took upon moving in as well as several witness so if the business wishes, we can resolve this in court and I will provide the necessary documentation to show the date/time and location the photos were taken Regards, [redacted]

We have responded to Ms***'s questions and letters on numerous occasions In reference to the cleaning matter, we interviewed the contractor who completed the make ready at the property prior to Ms***'s move in date as well as the inspector who inspected the property after Ms***
moved out The photos that were provided by Ms*** are not dated and the property address does not appear on the photos The contractor and inspector both question the validity and accuracy of the photos and feel that the photos were not taken prior to the move in date We feel that the cleaning charge of $ is accurate

I am rejecting this response because: I advised the property management that while the printed photos did not have a date/time stamp I could  show proof of the date the photos were taken as they were taken on my phone. I also sent a screenshot of the photos on my USB drive and each photo shows the date/time each photo was taken. Regardless of that fact that the property address is not shown you can tell from the photos that it is in fact the property. I do have a date, time and location stamp on my cell phone, on which the photos were taken to show proof that they were taken at the property on the date we first gained occupancy to the property. Furthermore the the business argues that there were no time stamps nor address; however, the pictures that they sent me also did not contain an accurate time stamp as the camera time stamp did not accurately match the date in which the business indicated they took the photos. Their photos also did not include an address. One of the photos I sent is of the front of the house, although the address cannot be seen.  I would like to also note that I emailed all photos to the business in which the date/time stamp can also be seen. They claimed they did not receive these although I cc'd myself on the emails and got them with no problem. We completed a condition report upon moving into the property which also supports the photos that we took, and although the business accepted the condition report, they refuse to take that into consideration when considering  the condition of the property upon our occupancy. I also advised the business that we do have witnesses who were present when we moved in that can vouch for the condition of the property upon occupancy. It was not clean so I'm not sure what their contractor advised them, but they property was not clean as reflected in the condition report and photos. I'm perplexed that they are alleging that the photos may not be of the place and were not taken at move in, since they are the ones that have tried to scam us out of $500 of our deposit. They also inaccurately charged us for over $300 (in addition to what they still owe us) including stating that we had a dog on the premises and charged us carpet cleaning fees. We never owned a dog and upon making several requests to the business, they refunded us those charges. The  point here is that they have tried charging us for things that they should not have and this is another example of that. I have sent all necessary documentation to them on several occasions yet their only response has been that in their opinion, the charges are accurate. They refuse to even discuss this matter with me over the phone to try and resolve any confusion, which tells me they are not interested in resolving this, but only in keeping the money they legally owe us. We again, respectfully request a full refund of the remaining money owed. I do have the proper documentation for the photographs we took upon  moving in as well as several witness so if the business wishes, we can resolve this in court and I will provide the necessary documentation to show the date/time and location the photos.  were taken.
