Review: We signed a contract to remove driveway and pave with asphalt for $4000. Contractor did not procure the proper permits from town. Code enforcement came and said driveway could be removed but driveway needed to be edged in a particular manner.

[redacted] Morrissey completed removal, kept our $2000 deposit and did the following:

1. failed to give us an updated price for driveway edging to be completed according to town code

2. failed to give us an updated price for shortened driveway length

3. left our home damaged (police report has been filed) by pulling on phone wire with the bucket of the excavator while removing driveway

While we continue to call him, he refuses to answer or return our phone calls.Desired Settlement: We want our home fixed and a return of the portion of the deposit not used for removal of the driveway.

I am rejecting this response because: [redacted]'s response is mostly false. I did not say I would take care of permits. As a contractor myself, I make sure that I do not perform any work without permits and I assumed [redacted], who has worked in the area for decades, would know what type of permits are required for him to do what he does for a living. When the town code enforcer stopped [redacted] and placed additional requirements on the project (concrete work), [redacted] said he could do it and would give me a price. That went on for a couple of weeks before he finally told me that he couldn't get a mason to do it. I told him I would find the mason but I still wanted him to finish the asphalt, however, the length of the driveway was significantly shortened and I requested a new price. He would not give me a price.After about a month of not getting anywhere, I got a new contractor to give me a quote. I gave [redacted] one last chance to give me a quote and he still would not. I let him know that if he did not give me a quote that I would hire the other contractor. He said he would call me back and hung up the phone on me. That was the last time I ever heard from him.Regarding the damage to my house, he knows he hit my phone wire with the bucket of the front end loader, his workers called attention to it and my neighbors and I were in the street when it happened. When he hit the wire, some of the siding and wood was yanked away from the house where the wire was attached. [redacted] was paid $2000, but did not do $2000 worth of work. He also damaged my house. I would have liked for him to have finished the job without me having to go shop around again, especially since he had already accepted a deposit, but he did not. He left us hanging and he owes us a balance of unused money from that deposit.
