Review: The bank charge was twice as much as for the refinancing of my loan; the amount of $16215.03.

On January *, 2014, I call for a meeting in the meeting with the mortgage agent [redacted] and the lawyer [redacted]. They didn’t solve anything and lied all about. The lawyer arrange by the agent. The Taylor Abstract papered at the closing. I don’t know why they were there.

The extra or unauthorized charges were $ 4863.11 for Taylor Abstract

Unauthorized point of 1.75 $ 3062.50

Lawyers fee $ 950.00 (this already in closing cost)

Total $ 8695.11Desired Settlement: Bank must be refund this money back to me.

This complaint is utterly unmeritorious. It apparently has been filed by a disgruntled borrower who believes that contracts are to be negotiated AFTER loan closings. Specifically, this borrower presented for a loan on investment real property. The loan was approved based on certain conditions, including fees. The fees were set after a complete evaluation of the serious risks inherent in the investment loan. Written disclosures were presented to the borrower who signed same without objection. The borrower also sat through the closing in which the charged fees were exactly the fees enumerated in the signed disclosures. It was only AFTER the closing that the borrower demanded a change in the fees and a refund. This borrower had ample opportunity to reject the proposed loan package both before and at the closing. Post-closing objections are waived, as a matter of law, by full performance of the transaction by the parties. Thank you.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

This bank is not telling the truth. The lawyer arranged by the bank. Many time I told the broker if any problem let me know and I have another broker to do it. He always insists that he can do it. When I saw the closing cost $16215.03; I told them that I do not going to sign the closing. Then the lawyer [redacted] called the broker [redacted]. I asked him you told me that closing is 4% of the loan amount and why this too much. They both told me that; because this rental property and you are casing out and other reason.

They brought up the Taylor abstractor to the table without any knowledge me. The closing is done by a lawyer or an abstractor not both.

They charged $4613.11 and $250 for Taylor Abstract

$950.00 for lawyer

$3062.50 for additional point of 1.75 without my knowledge.

The lawyer showed the HUD -1 form after closing. These forms supposedly provide to the borrower at least one full day to review.

Review: This company started calling me a couple of weeks ago asking for someone who does not exist at this address. After numerous times I politely ask the person to please take my number off the list. I have made this request to 3 people already and the phone calls have not stopped, some days I get 2 calls a day.Desired Settlement: Please have this company take my phone number off their list..thank you

Upon receipt of Complaint ID#[redacted], we immediately blocked all of the complainant's telephone numbers from our telemarketing outgoing logs. The customer should not be receiving any further calls inquiring into her interest in seeking mortgage financing at the numbers she has specified in her complaint. If further calls are received, please notify us and we will similarly place a block on whatever additional numbers calls have been received upon.
