Mr. [redacted] purchased a 2005 Volvo XC70 from Torch Light, Inc. on July 26, 2016. At the time of purchase, Mr. [redacted] was offered a 90-day engine/transmission catastrophe warranty. Mr. [redacted] waived said warranty and purchased a 36-month warranty from a third-party company. [redacted] Auto Service is...

an independent service center at which Mr. [redacted] took his vehicle to be repaired. Pursuant to the complaint at hand, Mr. [redacted] issues are with [redacted] and the handling of alleged repairs for which we cannot comment since we do not have any interest/ownership of [redacted]. If Mr. [redacted] has issues with the repair of his vehicle, he needs to speak with the people who repaired his vehicle.

As Ms. [redacted] has confirmed in her complaint, she did purchase a 2011 Audi Q5, in the amount of $15,990.00, from our establishment. Further confirmed, Torch Light, Inc. did provide a three-month/1,000k mile warranty. She further confirmed she drove said vehicle over 6,000 miles in the two...

months of ownership. For Ms. [redacted] to assert that Torch Light is "doing bad business" is a grossly malicious statement. I spoke with Ms. [redacted] and she advised that the had the vehicle serviced at 5,000 miles due to the fact that she was driving the vehicle an excessive amount of miles per month. Thus, if there was a problem with the vehicle, one would conclude that her mechanic would advise her.

Ms. [redacted] absolutely knew the warranty provided was for one month, 1,000 miles.  Not only did she sign paperwork supporting same, but she and I had several conversations where this was confirmed. Furthermore, Ms. [redacted] egregious statement that "Jeff did a bad business and was aware that something was wrong with car" is reprehensible.  The vehicle wasn't sold to Ms. [redacted] with problems.  In fact, as previously stated, Ms. [redacted] drove the vehicle over 6,000 miles prior to this happening.  Thus, if there truly had been a problem, the vehicle would never have been able to drive.  Also, I asked Ms. [redacted] if she had the vehicle serviced since purchasing it.  She said yes, it went in for routine maintenance.  Therefore, if there had been a problem with the vehicle one would conclude that the service center would have advised Ms. [redacted]. In closing, if there had been a problem with the vehicle it would not have been able to be driven. Jeffrey L[redacted]

I am rejecting this response because: The law says that the seller is responsible for all repairs needed if the car cannot pass inspection within 14 days of purchase.  We purchased an additional limited powertrain warranty for $800.  This does not absolve absolve Jeff L[redacted] of his seller's responsibility: either get the car to pass inspection, or take the car back for a full refund.  I owned the car for three days, drove a total of 40 miles before it stopped working. It would not go past 20 mph. I took it to my local [redacted] in W Orange. They diagnosed it same day; new throttle body, programming and electrical. Their estimate: $1000.  We called Jeff. He said [redacted] would take too long, and they don't know Volvos as well as his guys ([redacted]'s). Jeff L[redacted] offered to pay for the repair at [redacted]'s, saying I would pay only $100. I had it towed to [redacted]'s at my expense ($50).  The car sat at [redacted]'s for 20 days.  We called daily, and contacted Jeff L[redacted] regularly. Finally on June 11th [redacted]'s realized they can't fix it, had the car sent to the [redacted].  The cost to repair the car is $270 to [redacted]'s, and $1400 to Volvo.  Jeff L[redacted] offered to pay $500 toward these bills, but he is responsible for paying the total repair bill so that we can get our car inspected.

First, rather than reiterate our first response, please refer to it. Second, Torch Light is not responsible for consumer's repair. As the Revdex.com is aware, according to NJ law all vehicles sold with over 100,000 is sold "as is". Furthermore, consumer signed the "as is" form and they waived NJ inspection and dealer's obligation by signing same on the Bill of Sale.
