I am rejecting this response because:The response contains inaccurate details I only spoke with two sales people and they both assured me, as I was signing the form containing a 20% restocking fee signature, that I would NOT be charged the fee if a denial happened This made sense to me because the item was not ever removed from the premises, hence would not need to be restocked If an item is still new and in original packaging there is no grounds for the reseller to charge a fee to process a refund I will be pursuing this in small claims court

We just received the letter of complaint from *** *** I had some documents I wanted to attach to the response, so the Revdex.com gave me your e-mail so that I could send those along with the responseThe complaint number is 12128984.*** *** purchased a firearm from us on 4/20/17, he
explained that he has felony drug charges but that they have been cleared because of the new Marijuana laws in CaliforniaHe spoke to three of our employees about this and they responded that typically those felony drug charges do not automatically get dropped to a misdemeanor without going to court, but if he is sure that he is cleared then he SHOULD have no problem with Department of Justice clearing the backgroundThis is of course based of him stating his charges are clearedHe was then told, just as everyone that talks about felony charges is told, that if he is in fact denied there is a 20% fee that will be imposedWe also have a contract in which everyone that purchases a firearm reads and signs, and that policy is clearly stated at the top*** *** was verbally told about the fee, read the contract, and signed the contractI have attached a copy.*** has also made it sound like in previous correspondence that this is not a industry policy, when in fact its a standardI have advised him that he can call any firearm store in California and ask if they charge a fee on Department of Justice Denials and every one of them charges a minimum 20%I have personally called the stores listed below just in our area and they have stated they charge 20%In fact, Capital Gun Club charges a 50% fee and Just Guns charges 25%The fee is in place because we have to take the firearm off the market while it could have been sold to another individual, and the excess of paperwork that needs to be done by our employees because of the denialWe have explained to *** that more time and paperwork than has to be done on denials than average gun purchases, as you can imagineUnfortunately, he has not been understandingAs a business we cannot take guns off the market and pay employees to do extensive paperwork at no costIt is the customers responsibility to know if they are allowed to own a firearm. If this is an issue then it needs to be taken up with the hundreds of gun stores in California along with us.I would also like to point out that in his complaint he states that we charged him a 20% fee on $AND a $dealer fee, which is not the case20% of $is $which is the amount he is disputing, we never charged him a $dealer fee on top of that.I have also attached a copy of his complaint for youPlease let me know if there is any more information I can provide.Thank you,

Just received *** ***'s response in the mail and our reply is below.We have never nor would we ever tell a customer, including *** ***, that they are excluded from the 20% denial feeWhat we told him is exactly what I already stated in the previous responseWe would never have him sign a contract saying there's a 20% fee if there was no intent to charge him itThere would have at least been a written stipulation on it saying he was excluded, but he was not. Customers get denied by Department of Justice semi-regularly and pay the 20% fee with no issue, and comprehend the time and money it takes to process denials. *** is understandably upset that he is denied but the responsibility is solely on him*** continues to have an issue with the wording of a "re-stocking" fee, no where in our contract do we refer to this is a "re-stocking" feeAs you can read on the form I've previously attached it says: "There will be a 20% fee off total purchased for any cancellation or Department of Justice (DOJ) denial"We hope he's prepared to take this up in court with hundreds of firearm dealers with the same policy Thank you,___________________________*** **ManagerMosquito Creek Outfitters, LLCwww.mosquitocreekoutfitter.comPh:*** Fax: ***
