Tell us why here...This customer purchased a used vehicle, and based on some credit issues, the only lender that would finance was Credit Acceptance, which carried a bank fee, that had to be passed on to be buyer. When the vehicle had issues, our managers worked to trade the customer into a new...

Chevy Sonic. The customers mother agreed to help, and the deal was completed this morning.

On August 3, 2013 Mr [redacted], Sr agreed to purchase a 2010 Chevy Silverado, VIN #[redacted]. The only lender willing to finance was Credit Acceptance. The terms required $[redacted] down, with a balance of $[redacted] to be financed. The terms were 60 months at $[redacted] per month. The vehicle was...

delivered, the paperwork was package and sent to Credit Acceptance. The package was received, but returned from funding to correct an error. Mossy never received the paperwork back, but discovered when reconciling the outstanding contracts. The customer was called to re-sign the paperwork. We have made repeated attempts to resolve. We have gone to the customers home, were told they would be in the next Friday, while Mr [redacted] drove the truck to the back of the property and parked it with his pit bulls. We were in contact with Ms [redacted] who agreed to come in several times to re-sign, but has never lived up to the commitment. We have text messages that can prove this. We have always been willing to show the downpayment, re-sign and begin the 60 payments, as agreed. The [redacted]'s refuse to cooperate. They are now willing to return the vehicle if we will refund the downpayment. This request is unacceptable, as they have had the use of our truck for 6 months($[redacted] x 6 months would be $[redacted] in payments). If we had rented them a vehicle for $** per day, they would owe us over $[redacted]. The complaint says they have attempted to make payments, yet not one payment was brought to Mossy. In fact, until the contract cashes, Mossy is the owner and lienholder.
I would recommend 3 alternatives. They can return the vehicle, and give up the downpayment. They can come in and re-sign, beginning the loan process. They can bring Mossy the 6 months, and Mossy will become the lienholder, filing with the clerk of court. Or, we will file a claim in civil court, requesting a writ of replevin and payment for use and any dimunition in value, seeking a judgment for damages.
We have an outstanding claim, for payment, of $[redacted], without interest. We want this brought to a conclusion. We are prepared to have a judge decide this matter, but we will file next week, if not resolved.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.
Regards,
[redacted]

We have been in contact with Mr. [redacted], and explained to his satisfaction why the title paperwork was delayed. The paperwork & check to the DMV arrived at 10:00 am, July 5, 2017. Although it did not go to the preferred DMV Office, Mr. [redacted] went to a nearby office in Pace, Florida,...

and the registration and license were completed the same day.We expressed our sincere apology, and thanked Mr. [redacted] for bringing the issue to our attention.

The insurance policies are through 2 different companies, and were processed separately. The extended warranty was for 7 years, although the factory warranty was only for 3, sold through OSI. The second policy covered tires & wheels, ding & dent coverage, and replacement key, sold through...

[redacted]. OSI requires paperwork being mailed to their office, which was done. That cancellation was processed, resulting in the payment to the customers lienholder. The second policy requires the cancellation being fax'd. That refund check was never created, we discovered today, although the customer was told the check was sent to Mossy. Now [redacted] informed us, upon inquiry, that they never received the cancellation notice. Our Finance Manager, [redacted], has sent the form via fax, this afternoon. I regret the delay, but steps have been taken to cancel the ultimate vehicle protection warranty, so a payment can be made to [redacted], the lienholder. I would expect that to take a few weeks.

Tell us why here...On May 4, 2015 at approximately 10:00, [redacted] came to Mossy of Picayune, to see a specific vehicle(2015 Chevy Silverado 2500 HD, Diesel). The vehicle listed for $59925, and we agreed to sell the vehicle for $45,855, a discount of $14070, including rebate. [redacted]...

[redacted] had a 2013 Honda Crosstour that we appraised for $17000. [redacted] said Honda of Slidell has offered her $22-24,000 in the apst while her car was in for service. In an attempt to make a deal, our Sales Manager told her he would go to $19,000, but it could be worth up to $19,500. [redacted] said she wouldn't take less than $22,000, and she was going to Honda of Slidell to see what they would pay. When our manager was told she wanted to trade for $30,000, plus her trade & $5,000 downpayment, we offered to show her a Silverado 1500, in order to make the numbers work. [redacted] said she needed a 2500 HD Diesel to pull a trailer. We then suggested to make the numbers work, she should consider a used vehicle. At no time was there a "bait & switch", instead we were trying to majke the customers numbers work. Unfortunately, we paid $55,947.85 to buy the truck from GM, and could not go any lower. Some time on the afternoon of the 4th, Ms [redacted] reached out to her salesperson to explain that AutoTrader said her vehicle was worth $21,262. The fact of the matter was the value they gave was sight unseen, based on the customers description of the vehicle. Under the section "Wear & Tear", [redacted] listed none. To be none, the vehicle would need to be showroom condition. When we contacted Mr. [redacted] at AutoTrader, he advised that the"offer" was subject to a checklist inspection. We have reached out to [redacted] to have an official "AutoTrader" inspection performed. She has agreed to come back this afternoon. Mossy will stand by the selling price presented yesterday, but stand by our right to pass on the trade at an unreasonable value. If the final inspection results in a value greater than we are willing to pay, we will agree to the AutoTrader value, and merely send the vehicle to an AutoTrader auction. We will try to find common ground, and reach a reasonable agreement.
