Case # [redacted] Response to Complaint of [redacted] Respondent: MotoeXotica Classic Cars, LLC Dear Sir or Madam: We represent MotoeXotica Classic Cars, LLC ("MotoeXotica")Please allow this letter to serve as MotoeXotica's response to the above referenced Complaint filed by Mr [redacted] Mr [redacted] , by his own admission, is a licensed and practicing attorney in the state of CA, and, before submitting his complaint to the Revdex.com, repeatedly threatened to file suit in the U.SDistrict Court for the Central District of CaliforniaGiven his posture, and in light of his repeated threats to file suit, MotoeXotica retained this firm to respond to Mr [redacted] 's complaint with the Revdex.com As an initial matter, MotoeXotica disputes the factual assertions raised by Mr [redacted] regarding the Ferrari purchased by Mr [redacted] from MotoeXotica, including specifically that MotoeXotica made any fraudulent misrepresentations regarding the condition of the FerrariAs Mr [redacted] was fully aware, the Ferrari was manufactured in 1985, and thus is approximately thirty (30) years oldThe Ferrari, moreover, was sold 'as is, where is', subject to a general description of certain service work previously performed on the vehicle as provided in advertising, over detailed photos of the car and a video of the car runningMr [redacted] also waived the opportunity to inspect the vehicle Irrespective of lack of validity of Mr [redacted] 's complaints, and in the interest resolving this dispute, MotoeXotica offered to rescind the sale and refund Mr [redacted] 's purchase money, refund his shipping expense to CA and pay for shipping back to MotoeXotica from CAMr [redacted] had agreed to return the car, however, then refused, first demanding the sum of Five Thousand Dollars ($5000), and almost immediately raising his demand to Ten Thousand Dollars ($10,000.00) In short, MotoeXotica attempted in good faith to reasonably resolve this dispute with Mr [redacted] , but was unable to do soPlease let us know if you require any additional information Regards, [redacted]

The back of the check states the customer agrees to the terms. Scratching out the agreement and cashing the check does not invalidate the agreement.

no I do not agree with the company I was lied to about the condition of this car. I spoke with them on the phone and told them 1000.00 would resolve this issue as that was more fair for the repairs needed. They said they would send a check for 350.00 which I did not agree to.They also put a disclaimer on the back of the check which absolved them from any further action which I remover before signing the check as advised by my attorney because I never verbally agreed to that. As far as I'm concerned it would take a check from them for 750.00 to resolve this issue

Dear Sir or Madam:
We represent MotoeXotica Classic Cars, LLC ("MotoeXotica"). Please allow this letter to serve as MotoeXotica's response to the above referenced Complaint filed by Mr....

Mr. [redacted], by his own admission, is a licensed and practicing attorney in the state of CA, and, before submitting his complaint to the Revdex.com, repeatedly threatened to file suit in the U.S. District Court for the Central District of California. Given his posture, and in light of his repeated threats to file suit, MotoeXotica retained this firm to respond to Mr. [redacted]'s complaint with the Revdex.com.
As an initial matter, MotoeXotica disputes the factual assertions raised by Mr. [redacted] regarding the Ferrari purchased by Mr. [redacted] from MotoeXotica, including specifically that MotoeXotica made any fraudulent misrepresentations regarding the condition of the Ferrari. As Mr. [redacted] was fully aware, the Ferrari was manufactured in 1985, and thus is approximately thirty (30) years old. The Ferrari, moreover, was sold 'as is, where is', subject to a general description of certain service work previously performed on the vehicle as provided in advertising, over 90 detailed photos of the car and a video of the car running. Mr. [redacted] also waived the opportunity to inspect the vehicle.

Irrespective of lack of validity of Mr. [redacted]'s complaints, and in the interest resolving this dispute, MotoeXotica offered to rescind the sale and refund Mr. [redacted]'s purchase money, refund his shipping expense to CA and pay for shipping back to MotoeXotica from CA. Mr. [redacted] had agreed to return the car, however, then refused, first demanding the sum of Five Thousand Dollars ($5000), and almost immediately raising his demand to Ten Thousand Dollars ($10,000.00).
In short, MotoeXotica attempted in good faith to reasonably resolve this dispute with Mr. [redacted], but was unable to do so. Please let us know if you require any additional information.
