[redacted] has signed a property management agreement with Northpoint Asset Management that clearly states that we will be working on her behalf to identify, screen and manage prospective tenants on her behalf. We reviewed in detail this agreement with her by phone and in person before she signed the agreement. In addition, I personally met with Ms. [redacted] on multiple occasion to tour her property, discuss rental rates, review whether she wanted to accept section 8 tenants, what the tenant would be responsible for and what she would cover. We then placed her home on the market for rent. As we began to receive applicants for her property, I again met with her to discuss that we had received an application from a section 8 tenant, which had been approved. I provided Ms. [redacted] a copy of our standard lease per her request prior to identifying a tenant for her property. She wanted to review what the Northpoint Lease looked like. At no time did Ms. [redacted] request to have final approval of the tenant. She was concerned that it had taken roughly 8 weeks to locate a tenant for her property but she did not ask to be involved in the screening process. In fact, she requested to stay anonymous throughout the process as she lives next door to the rental property and did not want the tenant to be made aware of this.Ms. [redacted] was informed that the new tenants would be given keys the week prior to their move in date to take care of painting that she approved. The tenants did not move in prior to their lease commencement date. I met Ms. [redacted] at the property the day before the lease was signed and keys issued to new tenants to review the status. I had multiple conversations by phone and through email to keep her informed of when the tenant would be moving in. She was also notified that it could take up to 6 weeks for her first payment to be sent from CMHA. I have had multiple conversations with her to review when she would receive payment from Northpoint upon our receipt of payment form CMHA. Her rental payment was sent to her immediately upon cleared funds. We are sorry you were not able to rent the house you were counting on and you had such an unpleasant experience with this rental process. The owner was moving forward with your lease purchase offer last week; unfortunately, before Mrs. P[redacted] and the attorney could complete all the contract...

paperwork required for your lease-purchase option, a new buyer presented a more desirable offer which was accepted by the owner since there was no signed contract and no deposit received from you.  The real estate market has been a very competitive seller’s market in the last couple of years and things happen very quickly which is very frustrating to many who are trying to buy or lease a home. Mrs.P[redacted] has a fiduciary responsibility to the owner which requires her to act in his best interest based on our property management agreement, the signed listing agreement, and real estate law.  We know you were counting on this house and we feel bad that you made all those plans before you signed the contract but the owner is allowed to change his mind up until he signs the contract which had not been finished. Please know that neither the owner or Mrs. P[redacted] ever meant to deceive or hurt you in any way but were instead just reacting to changing circumstances in a very fast-paced competitive marketplace. We wish you had a better experience and were able to move into the house you loved, but since the owner went with a higher offer, we will give you and your wife your application fees back to you and offer you our sincere apologies for the stress this has caused.

 Quite frankly there should have never been another offer on that house once we were made aware of the fact that we were offered the house. Mrs. P[redacted] was more then capable of giving us the paperwork on December 6, 2017 when we were offered it. We had the money and were ready to sign papers as soon as they were sent over. We were never given the opportunity to sign any papers so your point is invalid. This fixes nothing.
