Initial Business Response /* (1000, 7, 2015/04/29) */
This customer Has purchased the vehicle at his or own costHe agreed to purchase the vehicle on his own and had wired the money at his or own cost and expenseThe vehicle was brought in by a shipping companyWe inspected the vehicle and told
the customer what parts he neededFIrst of all this statement is against a dealershipDealerships do not repair vehiclesIts a auto repair shopSecond This car you have purhcased was never from a used car dealershipYou purchased a car through a website that does not include any dealership informationThe parts we have ordered we have our own invoices which by law we do not have to show the customers*** *** was given a car while his vehicle was getting repaired and drove over 5k miles on our rental vehicle which he never was asked to pay forThis was a favor for someone that wanted to purchase a carNow he is making a fake claim against this Automotive Repair shopThere will be no refund givenYour vehicle was purchased by yourself and you knew you were purchasing a "salvaged" VehicleThe vehicle is not a lemon law buy backIt is claimed as salvaged which has been in a accident but if fixableWE even called the customer and let him know that we would fix whatever the problems with the vehicle were at our own costbut the customer just demands a refundThe family of the owner of the vehicle buys and sells cars from private party which is illegalWhy did you not ask your family member to purchase a vehicle for you? It is not a great thing to do to make a fake claim agaisnt someone out thereFor the all the customers that can see this response just know this is the first claim against our repair facility in over Years
Thanks
Initial Consumer Rebuttal /* (3000, 9, 2015/05/05) */
(The consumer indicated he/she DID NOT accept the response from the business.)
1) This is not only a complaint against a dealershipThis is a complaint against the dealership Motorcars of Ca as well as Grand Auto Repair, which are located in the same address in ***, CA and owned and operated by the same peopleThey function as one unitMotorcars receives customers, and if there are parts that need to be ordered, they are ordered through Grand Auto RepairGrand Auto Repair is only involved in this case because the parts were ordered through that repair shop using fraudulent receiptsMr*** led Mr*** to believe that the parts were "original" parts, and gave Mr*** "receipts" that the Infiniti dealerships concluded were fake receiptsSo if anyone is committing fraud here, or doing anything illegal, it is this so called "dealership" that claims to offer quality service
2) This dealership claims to function legally, and while it may claim to treat some customers well, it certainly has not done so with allThere have definitely been other complaints against this dealership, yet unfortunately no one was willing to take it far enoughWhen Mr*** came to purchase a car from them, they recommended he consider a car from an online website, then they agreed - verbally - to order parts for the vehicle and initiate repairs in order to get it to a safe levelFor a dealership that claims to be honest, they never put this in writing and accepted money from Mr*** in cash, yet never followed through on their promisesThey proceeded to have Mr*** wire money to the online website through the Dealership's account with the website
3) The dealership claims that it had nothing to do with the vehicle or the repairsYet Mr*** had no problem accepting thousands of dollars for parts that he was supposed to order for the vehicle - none of which were actually ordered until Mr*** demanded a refund months later
4) It is also not a coincidence that the person who interacts with customers at this dealership, and who sells cars through random websites then defrauds customers out of their money, is a man who has declared bankruptcyThis means that he operates hoping that he will not be financially liable because he is bankrupt
5) Mr*** did not demand a refund because he was being difficult or unreasonableHe waited months for this vehicle to be repaired and it never wasThis dealership took thousands of dollars from its customer, misled him to believe that it was ordering parts for his vehicle, yet it was actually just pocketing the moneyThen when he asked for a refund for the money he gave to the dealer, as he is legally able to do, the dealer sat back and said they no longer had the money
6) The dealer states "WE even called the customer and let him know that we would fix whatever the problems with the vehicle were at our own costbut the customer just demands a refund." That is blatantly falseThe dealer was given many options aside from a refund, including installing the parts he promised he would install, and making the repairs that he charged Mr*** for, yet the dealer refused to make any repairs because at that point he had already pocketed the moneyFurther, the dealer demanded even more money in order to put in the parts that Mr*** had already paid for
Finally, and most importantly, this dealer claims to be in the right, and claims to be honest, yet when confronted about his failure to meet his promise, he wrote a check for Mr*** in the amount of $12,000, which is what Mr*** paid the dealer...yet, the check bouncedWhat honest dealership would cut a check
This claim is not a "fake claim" but is a perfectly valid, documented, and supported complaint from a hardworking student who was defrauded out of thousands of dollars by someone who is supposed to be functioning as an honest and reliable dealershipUnfortunately, this customer is not the first person who has been given a dysfunctional vehicle by this dealerThis complaint is to help make sure that this dealer cannot defraud other customers out of their money
