I am rejecting this response because:If I said I talked to the owner of the store, I may have been mistaken in thinking Ann was the owner I've only had communications with Ann regarding this matter I did EXACTLY what I was told to do by her to start having our wine shipments delivered to the store She gave me two options: One option was to rent a mailbox for an annual fee and the other was to pay per wine shipment a charge of $ She asked how many shipments per year and when they ship I told her about five a year in the spring and fall She suggested I try the $charge per shipment. She took down my name and home phone number If she needed more personal information, i.e., address, e-mail, etc., she should have asked for it If I needed to be more specific with the labeling, I would have made sure that was done to specifics if I knew what they were I was told to put #on the labeling to reference I was not a mailbox rental customer, I did that, along with our last name and the address of the UPS store as it was listed on the business card Ann handed me when we set up our verbal agreement. I was NEVER advised to contact the UPS Store with an estimated shipment date Had I been so advised, I would have done so I would have never knowingly compromised the integrity of $1,worth of wine by having it shipped back and forth on a UPS truck up and down California.The wine boxes were NOT damaged I contacted the shipper to inspect the boxes upon return and were in PERFECT condition, quote, "not a scratch on them."Every single statement in this response is true and correct.K** ***March 29, 2016Complaint:

Mr. [redacted] indicated he has tried to work with the consumer on several occasions and the consumer is always dissatisfied and seemingly wants the business to continue to provide him with freebies. Mr....

[redacted] has  allowed the consumer to borrow an expensive mower at no charge to allow him to cut his lawn while the consumers mower was in for repair.
Mr. [redacted] is requesting no further contact from the consumer. If forced to, he will file a restraining order against the consumer. If the consumer has any additional questions he has been directed to contact the business' attorney, [redacted].

The statements made by this individual
are untrue and unsubstantiated therefore defamatory and will be submitted to
the business’s legal adviser if made public. 
This individual never had a conversation/interaction with the owner of
the business (impossible since owner is business entity...

and authorized contact
does not work on-site).  Upon speaking to
the manager of the business after her shipments were refused, she admitted that
she had spoken to the manager months before and did not follow the instructions
given to her to meet requirements to allow the UPS Store to receive her
shipment even before UPS policies changed (required to have enough
information/details about the recipient such full name and address as well as
contact information such as telephone number and/or email in order to confirm
the 21 year or older requirement was verified by the licensed shipper).  This individual also admitted that she was advised (according
to policy/script used by managers) to contact the UPS Store with the estimated
shipment date and details of shipment. 
UPS policies changed in mid-2015 and currently include several new UPS
programs (e.g. “My Choice,”  “Access
Point Shipment,” “Not at Home Shipment”) which require additional labeling to
be added by UPS in order for a UPS Store to accept a package from any
individual who is not a mailbox rental customer (all required information to
receive an alcohol shipment such as home address and copy of current valid ID
is on kept on file for all mailbox rental customers) and these programs most
likely accrue additional fees.  It was
explained to the individual that there wasn’t enough information on the
shipping labels to meet the current federal law requirements for such shipments
(allowing a UPS Store to accept shipments of alcohol for other than mailbox
rental customers) or even to contact her to let her know that policies had
changed and therefore help her to arrange for pick-up at UPS distribution
center nearby (shipping label had man’s name?, no address or phone #).  It was also explained to the individual that
one of the boxes had evidence of breakage which would have prohibited
acceptance of the shipments even if the labeling would have been sufficient.
Finally it was explained to this individual that UPS Store management would
have been in violation of Federal law (USC Title 27 CFR § 124, excerpt below)
if shipment was accepted, but this individual proceeded to submit fraudulent
information to the Revdex.com and make defamatory statements about the store manager.
[These rules are based on their requirement that only
entities who have signed a “wine shippers agreement”, which has special
provisions regarding liability and packaging requirements as well as reporting
components for deliveries into the other states.  These agreements are
only available to license alcohol retailers and wineries themselves.  A
primary reason for this is also the special handling and adult signature
requirements that are required for alcohol deliveries.  The goal is to
avoid any possibility of a package being delivered into the hands of a
minor.  Packages shipped under the wine agreements have to meet rigorous
labeling standards, and cannot be handled in the normal default manner of other
packages (i.e. adult signature (over 21 years of age) is required for delivery,
there can be no signature waiver, and packages cannot be left even with a
consumer signature request – the delivery must be made in person so ID can be
checked.) 
§ 124. Direct shipment of wine (a)
Conditions for transporting certain wine 1 So in original. Probably should be
followed by a closing parenthesis. During any period in which the Federal
Aviation Administration has in effect restrictions on airline passengers to
ensure safety, the direct shipment of wine shall be permitted from States where
wine is purchased from a winery, to another State or the District of Columbia,
if— (1) the wine was purchased while the purchaser was physically present at
the winery; (2) the purchaser of the wine provided the winery verification of
legal age to purchase alcohol; (3) the shipping container in which the wine is
shipped is marked to require an adult’s signature upon delivery; (4) the wine
is for personal use only and not for resale; and (5) the purchaser could have
carried the wine lawfully into the State or the District of Columbia to which
the wine is shipped. (b) Violations If any person fails to meet any of the
conditions under subsection (a) of this section, the attorney general of any
State may bring a civil action under the same terms as those set out in section
122a of this title.]
On behalf of our business, we
would like to assure the Revdex.com that we have made a good faith effort on several
occasions to explain the circumstances to this individual (she had no legal
right to receive shipments of alcohol at our business address and no legal
contract with the business to do so) and advise that her negotiations need to
be with the entity that shipped the wine without including her home address or
any contact information.  We appreciate
the opportunity to respond and would also like to assure the Revdex.com that this
individual has no legal claim against our business entity or any of our
business managers.  Thank you.
