agreement for an apartmentThe individual was informed of the approval on 7/3/in full accordance with our company's national practicesWe also contest the Individual's claim that we were not holding a specific apartment off the market for the individualWe in fact selected a specific apartment and we, as a business that relies on apartment rentals to sustain our existence, certainly relied on the full execution of this rental processAdditionally, we contest the claim that the individual was shown an apartment that did not represent the one that was set aside for the Individual100% of our apartments were fully remodeled over the past few years and this is represented In the model apartment the Individual was first shownThe individual expressed concern to our staff regarding the view or location but not the amenities of the apartmentThe individual filled out and application and signed it, The signature gave us authorization to process the application and served as acknowledgement the individual agreed to the terms stated on the applicationSpecifically, the Individual agreed to a section on the application titled "Application Deposit and Administrative Fee Retained by OwnerThis section states, "Owner shall be entitled to retain the Application Deposit and Administrative Fee as liquidated damages; in which case, all further obligations to lease the premises to Applicant shall be terminated if: (I) the Application Is withdrawn, for any reason, after signing this Application; or (ii) the Application is accepted, but Applicant does not sign an Apartment Lease Agreement as and when required by Owner; or (III) if the Applicant has provided or misleading information within this Application." As previously mentioned, the individual's application was processed and the approval results were given to the applicant on 7/3/The Individual informed us of his/her intent to cancel the application on 8/13/This means that we set aside a specific apartment and took It off the market for over daysIt Is not only reasonable that we retain the application deposit as liquidated damages in an attempt to offset a portion of lost revenue for this apartment, is It entitled to be ours per the signed agreement between us as Owner/Agent and the individual
Mr*** move out of the Mount Run Apartments on 7/17/and was sent his required notice on 8/16/to his forwarding address via USPS standard delivery and a statement was sent by email on 8/19/ As of 7/1/Mr*** had a credit balance $from a payment made on 6/28/
This covered the days of Rent ($547.84), carports ($16.45), Month to month fee ($54.84) and Pet Rent ( 10.97). Also due on July 1st was the utility bill for the 5/1/16- 5/31/services in the amount of $ Once possession of the unit returned to us we pulled his final utility bill for the 6/1/- 7/17/services ($75.16) and had apartment inspected and the carpet cleaned with pet treatment (originally $adjusted down to $50)We also had to replace stove drip pan ($5.00) We made contact with Mr*** on 9/13/and our notes indicate he insists we owe him a refund and refused to pay the balance due As a final customer service measure before we sent his accounts to a collection agency, we made an effort to work out the issues with Mr*** in January He again insisted that we owed him a refundWe sent him another break down of the charges and had a manager reach out to himHe continued to refuse to pay and finally we sent the account to the collection agency on 2/28/ At this point he will need to contact the collection agency, IQ Data at ***, to resolve the outstanding amounts and or work out a settlement
