Mountain Star Roofing Systems Response • Feb 28, 2020

Unfortunately, the area now leaking is on the second story which is the area we did not repair. As stated to consumer, warranty is on the tile section repaired. Customer was also advised that we would repair the interior damaged at no charge. Estimate provided was for the second story repair. We also offered customer a discount on additional repair.

(The consumer indicated he/she DID NOT accept the response from the business.)
The business, *** Star *** was hired to fully diagnose water leak in East wall of home and make offer to repair. Within one month of the finish of work performed, (paid in full.)..On Nov.20, 2019, ..that specific repair location broke open and poured water into our home. We called the business at approximately 540 am., again at 6 am and again at 740 am. We saved record of the cell phone calls to company on that morning. There was water all over the dining room flooring, furniture, etc. As of today, Feb. 28, 2020, no one has been out to attempt to make good on the warranty. Also, at that point, we expected to hear from the owner of company and haven't heard from this person(s) at all. Also, we came home when original repair was ending last year and caught one of Mt. Star employees loading all worker job debris into our personal residential trash bin. Of course, we paid the company to remove all debris themselves as standard. No one from this company ever followed up on that event. Note: we called several times between Nov 20, 2019 and Feb 2020 and left messages. No one returned our calls. Consequently, between Nov.20, 2019 and Feb 2020, , there is more damage to the interior wall of our home. We were waiting for resolution from the company who did the warrantied work... which makes business sense. They have a legal and an ethical obligation to make good on their work... certainly before they start sending out new cost estimates to the customer. We have a warranty from Mt. Star Contractor that expires in September 2020... Sept 2019 -Sept. 2020.

Mountain Star will absolutely warranty the area repaired by Mountain Star Roofing. The area leaking now is not the area repaired. Unfortunately, customer has a new leak. Our technician has assessed property and confirmed it is a new problem area. As stated previously, we will repair interior at no cost as part of original warranty. We have also issued a revised estimate to include a courtesy discount on the new leak area.

Mountain Star Roofing is definitely reliable, responsible, professional. From day 1, the company took ownership of the replacement of my roof 2,500 sq feet home. The roof estimator and workers are very knowledgeable and professional. I highly recommend this Company to anyone in the El Paso, Juarez and surrounding area.

The failure to inspect the roof properly before figuring out estimate would have avoided the extra charge or 37.50 % of the original cost of the roof.
I *** am complaining against Mountain Star Roofing resulting from the excess cost over the original cost of $15,759.00. The excess cost that they are charging after completion is $5,919.00, which is 37.56 % of original cost.
At the start *** stated that Mountain Star would have someone out to inspect the roof in order to have a reasonable estimate one closer to cost. He would let me know as soon as they would have the inspection completed, this never occurred. We have no communication or proof that an inspection transpired, nor did they communicate with me on this issue.
My wife confronted Mr. about this issue his reply was, "Not to worry, an inspector would be out later that day.") My wife took the day off from work to wait on the roof inspector. No one ever came to inspect the roof nor did we hear back from Mr. or roof inspector. The next day his non speaking English employees could not give my wife and answer about the estimate; they simply continue to work on the roof, they called Mr., and he assured her someone would be out there.
Later that afternoon my wife asked Mr. about the estimate and the copy of the contract he said he would have the office Email it. Mountain Star emailed me the financial contract from third party for the amount that they would finance $13,000.00, plus a cash down payment of 22,291.20 and a receipt for $15,759.00, for roof replacement.
Mr. did contact me at a later time to inform me that they need to replace 20-25 sheets of wood at an extra cost, including labor. Two days later Mr. called me again and stated that there would be an additional 75 to 80 sheets, at the time our home was exposed to the elements in a large area and it was going to rain. The following weekend my wife ask *** to meet with us and he told us again not to worry, that he would find additional funding and would ask management to help us out. This never transpired and we felt we were being held hostages.
In the begaining Mr. had offered a the first time discount and later offered to help locate additional financing, the work continued without this happening , no discount or additional financing. We didn"t hear from his we simply received a bill for and additional $ 5,919.00 due upon receiving it.
This situation was out of control my house and yard was a mess for over two weeks, the roof was left exposed every night taking a chance on the weather, one evening I had to call them to cover the exposed area due to rain and wind.
One evening a pedestrant complained about roofing material left on the public walk way in front of our home, plus debris scattered all over our property making it difficult and dangerous to get to the entrance of our home. This led us to believe that they were not professional roofers, the mess was ridiculous, and my wife had to ask them several times to clear the walk way in order to get to her car.
Once the roof was completed it took six days before they return to pick up the debris of the old roof they did not remount my cameras and they left debris all over my yards. Mountain Star representative/owner, Rand *** mislead us in stating that once they would have the roof inspected for replacement we would have and estimate closer to actual cost. Due to his lack of professionalism he was misleading in his actions. The lack of him actually inspecting the roof has caused us a hardship, our cost increased by 37.56% of the original cost of the replacement of the roof. This was a total unexpected surprise and hardship to bill us an additional $ 5,919.00.
If the company had actually come out early on and inspected the roof in a timely manner and seen the condition of the roof, siding, gutters and decking, they would have been able to actually given us a reasonable estimate early on

Desired Outcome

We believe Mr. failed to inspect the roof; we were informed he worked off satellite pictures we are asking that they give us a substantial discount on the Billing. His initial estimate to the Finance Company was based on labor, material, and square footage of the home causing him to mislead us on the on additional cost. If he would has inspected the roof the siding and the wood that was visualy damaged, we would have had an estimate closer to actual cost. We approached Mountain Star's management for consideration of a discount and they refused. maybe they will reconsider.

+1

Mountain Star did not complete work on the estimate I provided to them. They have made it difficult to bring the matter to conclusion.
I hired Mountain Star Contracting to do the work on the insurance estimate for roof replacement at my residence at *** Mr. ***, president of Mountain Star General Contracting, had been the main point of contact throughout my business with this company. Initially, all was well in organizing the project. Mr. asked for the estimate and agreed to perform the work. He supplied me with an invoice, which I signed. He assured me that he would waive any deductible, and that I would not be responsible for any out-of-pocket cost. He mentioned that he would "write a check to me" and I could "write it back to him" if there was any difference on the invoice.
On 12/18/2017, Mr. came to my home to pick up the insurance check to begin the work. His behavior was unprofessional and aggressive. He asked me if I liked to "party like a rockstar" to which I replied that my husband and I got out, though infrequently. He commented that he "liked girls with short hair" (I have short hair). He asked if my husband was in town and for how long he would be. By now I was uncomfortable having him in my home while alone, so I replied that my husband was in town though he was not. I told Mr. that my husband was on his way to meet me so we could go to a Christmas performance at our children's school, and attempted to redirect conversation to the project. This closed the interaction shortly, but he then initiated an unwanted hug before taking the insurance check and leaving. About 10 minutes later, I received a text from Mr. saying he felt he "got a flirtatious vibe" from me. This conduct and communication is, at best, unprofessional and inappropriate, and at worst, reckless and predatory. It is completely unacceptable.
I felt obligated to continue with the work despite my reservations because Mr. already had half of the insurance money and a signed invoice for the roof. The work finished on 12/26/2017 and I mailed in the final insurance check to total $11649.46. Not all work on the estimate was completed, including repairs to the porch and garage and clean up in parts of the yard. I then received a final invoice from his office, a Ms. ***, with a balance remaining of $950.54 via certified mail on 3/10/2017. I spoke with my insurance agent who advised me to have Mr. finish the work on the estimate and invoice the repairs in order to receive payment. He would then deduct that payment off of the remaining balance. I relayed this information, pointed out several errors in his invoicing, and included copies of the insurance estimates via certified mail to his office. I also pointed out that I felt incredibly uncomfortable communicating with Mr. because of his previous conduct, but hoped that we could resolve the issue as soon as possible. Despite this request for non-contact with him (he has all my husband's contact information), Mr. replied to me via email. He referenced an estimate he gave me for exterior painting as the reason why I would not have paid "out of pocket" for the roof, but that I refused to go through with it which resulted in a balance. He said that by asking him to complete the work and provide me with invoices and proper estimates that I have asked him to commit insurance fraud. He also now asserts that his estimate did not include roof tarp, primer, paint, drywall repairs, texture, insulation, dump fees or any repairs to the porch or garage despite the fact that this was all included in the insurance estimate provided to him.

Desired Outcome

I'm willing to pay the balance only if Mountain Star provides me with an itemized invoice of the work performed and an honest, detailed explanation as to why he elected to only perform part of the work repairs cited on the estimate I provided. I would like to request assistance in mediation since coming to an understanding with Mr. and his staff has proven difficult given the improper situation he has created.

Mountain Star Roofing Systems Response • Apr 25, 2018

Just to clarify, Mountain Star did complete all work on estimate. Estimate was for a roof replacement. A complete roof replacement was completed with in 4 business days.
On this particular estimate, there were no additional fees for additional work; ie: paint, tarp, dump, etc. MS only invoiced for the work it completed. At completion, client insisted we write them an invoice for work we did not complete. To company knowledge, this is an attempt to de-fraud the insurance co.
Unfortunately we are still still not willing to do so.
$12,600 for roof replacement. Balance due. $950. For the roof replacement. Still under their deductible cost!
Client is upset with the fact that we bid under what insurance company originally agreed to pay. Their insurance agreed to pay some 14k, we bid 12.6k. Leaving them the opportunity to still hire a company to do those repairs if need. They can submit a claim to their insurance as the original amount was already approved.

MS only expects to be paid for the roof replacement as all work was completed and invoiced agreed and signed.

Last note, 99% of these claims all arose after ms asked for final payment and client refused to pay " anything out of pocket".

(The consumer indicated he/she DID NOT accept the response from the business.)
Complete must be subject to interpretation. See attached photos.

I've already addressed the assertions of attempted insuarance fraud by Mountain Star. My insurance company is in full knowledge of the entire situation with them and has been warned against working with them in the future for all the reasons described in my Revdex.com complaint.

The figure Mountain Star bid of $12650.00 was based on the estimate I provided them in good faith (please see page 3 of estimate under "Total Amount of Claim if Incurred) for ALL THE WORK IN THE ESTIMATE.

The agreement we had for any balance due after insurance money was paid was not $950.54, but $0. This was confirmed by Mountain Star via phone and in-person with both my husband and I on several occasions. If Mountain Star is going to continue to insist on a balance due, I am entitled to a full, itemized invoice of materials and labor, which I have yet to receive.

These concerns over invoicing were brought to the attention of Mountain Star as early as 1/29/2018. While waiting to receive the final insurance payment from the notoriously slow mortgage company, I received an email from the Mountain Star office which included 2 invoices (see attached) and an advisory of intent to take legal action against me and my property. I called the office, but was unsuccessful in reaching anyone. For reasons previously described in the original complaint, when I received a text asking about the check from Mr. at 7:06pm, I asked him to contact my husband. He did so via phone shortly that evening and my husband raised EVERY issue in my certified letter to Mountain Star dated 3/20/2018 and the original complaint to Revdex.com. After this conversation I thought the issue was resolved. For this reason I released the final insurance check to Mountain Star on 2/21/18 and considered our business closed. It was surprising to receive a new invoice via certified mail 32 days later (3/9/18) for $950.54.

For all of these reasons described above, Mountain Star's response to my concerns remains unsatisfactory.
