The tenant had broken the lease, moved out and did not return the keys when he vacated until over a week later.  We do not consider a tenant vacated until the keys are returned by the tenant.  We only charged what was in his lease agreement for utilities and rent until the home was...

re-rented.  Attached you will find the tenant's ledger and the line items that he is disputing.  We advertised and rented it as quickly as possible and returned the remainder of his security deposit by the 21st day after we received his keys.

Mountain Valley Property Management has stated clearly the charges and why.  We have no further comments.

[redacted] bills for two months back of use. So that bill on 5/9/17 is covering the time from 3/9/17 until 5/8/17. A bill was made on 5/9/17. My payments on 6/15/17-6/21/17 and 8/28/17 covered from 3/9/17 until 8/28/17. If they did not I would have gotten a penalty after I paid on 8/28/17 for not paying my bill in full, just like I got on 7/18/17. On 8/28/17 when I made my payment I told the clerk at [redacted] that I didn't live at the address anymore and inquired about my last bill. She told me that they or I needed to do a last read on the meter. I said they could do it and agreed to pay the $10 fee. My last bill came Friday 10/20/17, I've attached it also and you can see the dates the bill covered 7/18/17 - 9/7/17, I will pay that on Monday and email a copy of the receipt. So according to the [redacted] records I have provided after I make a payment on Monday from 3/9/17 till 9/7/17 will have been paid. The time I occupied the rental plus 10 days. Why does the [redacted] doc. not show payments for the amounts listed in the MVPM line item list? Side note, after I signed the lease I was informed by MVPM that I could not put [redacted] in my name because it was "to much of a pain to change" when I asked the clerk at [redacted] about this and what I had been told by MVPM he told me that was a "lie."   I have attached screen shots from my phone of text massages sent by me to the rep I was working with at MVPM, and her responses.  8/28/17, the day I had all my belongings out of the house. It only took me one day to move my things because I had another residence with my partner, so I never really got settled in at this location. On 8/28/17 I did not get a response from the rep at MVPM until 4+ hours later so there could not be a meeting that day. On 8/29/17 I sent another text to my rep and got a response, I have included screen shots of this. I needed to meet with her and through text we set a time and place. On this day 8/29/17 at Wild Flower Bakery I informed her that I had to unexpectedly break the lease due to force majeure (an insect infestation). At that meeting I was ready to give her the keys until the subject of the basement came up. When I moved in the walls of the basement were moderately covered in mold, there was also water running down the walls from the large amount of rain we had. I was told no repairs to the basement would be made. Upon moving in I painted the basement walls with Killz mold paint, but not top to bottom just in the middle of the walls to cover and kill the mold. The rep new this from a inspection she did in-between the time I painted and moved out, some time in May I believe. On 8/29/17 at our meeting I was told that if I did not finish painting "you would have to pay out of your deposit to have us (MVPM) hire someone to finish painting because you started the painting." (could not find anything about this in the California Renters Handbook) I can't paint if I can't get in the house so I kept the keys. I was also told that MVPM would be advertising the house for rent "immediately" not after I gave the keys back but "immediately"  You can see from the text massages what I mean. No mention of keys being handed in or what it means if I have the keys was discussed during this meeting. You can see from the text massages that the rep does not dispute the fact that she used the term "immediately" on 8/29/17. Why did the rep not say on 8/29/17 if you have the keys, im not listing it for rent, im not telling the owner, im not showing the property etc etc?? Why would you not tell the owner of the property what is going on? I think that an ethical thing to do would have been to say since you need to paint I will overlook the fact that we operate on the condition that if you have the keys your in position of the rental. If that is even legal after you give verbal and written notice. Or give me the keys so we don't charge you any more money and I can list the house for rent and I'll meet you there and open the door so you can paint, or leave a key under the mat etc etc. Many options, point being after this meeting I was lead to believe that my rep was going to leave the meeting and either advertise the rental later that day or the next morning. Is there a different meaning of "immediately"? I was also informed to send the rep an email saying I was breaking the lease and why. I have included a screen shot of this email sent by me on 8/31/17, including the reps response on 9/1/17. She asks about the keys, in a very casual way but no mention of not advertising the rental etc. I am still operating on the statement used at our meeting on 8/28/17, "MVPM would be advertising the house for rent immediately" Getting the house advertised is my main concern obviously and the word "immediately" puts my concern to ease. You can see from her response there is no objection to my email validating the subject matter of our in person meeting. You can see from text massage I notified the rep of the completion of painting on 8/31/17. You can see her response, mentioning telling the owner. Only after the first of the month does she mention any consequences of me not bringing back the keys. I am writing this because from MVPM's response to the Revdex.com I'm gathering they are using the 'keys' issue as a reason to charge the Sept. late fee, I'll include their vague email response to me about it. July late feeAgain referring to the text message screen shots for the next item. You can see on 9/6/17 the rep sends a text referring to the late rent for July that I own and the keys. From 8/31/17 till this text I, from the words and overall feeling of the meeting on 8/28/17  felt no pressure to return the keys. I owed back rent from July and a late fee and was waiting for a payment for work I had done and thought when I get the payment I'll return the keys with the money. In my mind why make two trips when its not necessary.  This brings us to the July late fee. My rent was $1900 per month,  I paid $1300 and owed $600 + $114 late fee, I made a payment of $700. $600 for the rent $100 for late fee they could take the $14 out of my deposit. I have attached a picture of my money order receipt with the amount and date. I also sent this to MVPM an got no response. When I made this payment I returned the keys. So why wait till 9/6/17 a full 10 days after our meeting to tell me that if they don't have the keys I am still in possession of the rental and they will not list the home for rent? On 8/29/17 it was "immediately" on 9/6/17 is was we haven't done anything. ???????????September late feeAttached is the reason in an email MVPM gave me for charging me a late fee. Which is really no reason, I did not pay the rent they did out of my deposit. So from the 29th to the 5th (when legally you have to pay the rent or you can get charged a later fee) MVPM could not do a transfer of funds from their bank account to the property owners bank account????? We have all done bank transfers, we all know how it works. It's not a week long processes. Walk in/call in/online maybe 20 min and depending on what time of day the money is there next day.  I'm sure if we could look at the bank records we would see the money got transferred before the 5th. Moreover if MVPM can't do a funds transfer in a timely manner why should I get penalized? I could understand if I was charged $35 for the transfer fee to cover the bank fee. How come I wasn't asked for the rent money on 8/29 or 9/1? I paid first $1900 last $1900 and deposit $1900 $3800, they had the money I was not in control of how and when they give it to the property owner. I also could not find anything in the California Renters Handbook about this type of late fee charge being what should happen. Prorated October 2017 $126.80 The new renters paid their deposit on 9/26 (see attached text massage screen shot)  If MVPM could not allow them to move in until Oct. 2 for what ever reason they had. Why would I get charged for MVPM not being able to have the rental ready? From 8/29 to 9/26 you could not have a house that needed no repairs ready for occupants? Even if it did need repairs MVPM had more than enough time 8/29 to 9/26 to do them. The fact is that I should have gotten money back for the month of Sept.  Once another party pays and does paper work the past parties obligation is over. If the house did need something that MVPM had to take care of they deal with the time line and the cost, it's cost of doing business. How much more blatantly obvious is that MVPM is operation unethically and is just making up reasons to steal money from One only needs to look at MVPM [redacted] to see a reputation of unethical business practice. If you go on the Nevada County Board of Realtors web site you will see how much they mention ethics and acting ethically, because of this I have been in correspondence with them about MVPM business practices. I have also reached out to the California Board of Realtors and they have asked me to forward all information to them regarding MVPM.
