Review: At the end of January 2013, I moved from my townhouse because I could not afford to stay there. In February the realtor I was working with told me about this company, owned by [redacted] The company locates and supposedly screens people who are looking for a short-term rental. They pay a lower rent to the company, who is supposed to pay the HOA fees, some on back fees as appropriate and keep the property up. A couple with two children moved in before March 30. They did not keep up with their agreement to pay rent. I just found out tonight that Mr. [redacted] has only paid $375 to the HOA and it should have been over $1,000 for just the HOA fees for those 4 1/2 months. For each of those 4 months, the HOA added a $50 late fee, bringing the total to $1,288. Needless to say, I am very angry. In fact, the lady that was going to buy my home cancelled the contract tonight, primarily due to the fact that there was a lien on the property. If this money had been paid, the HOA probably would have released the lien. Mr. [redacted] has never been to the property and followed up on these people who were renting. I talked with Mr. [redacted] several times and at the beginning he assured me that he was getting the rent. He even told me a couple of weeks ago that he was returning their deposit to them. I thought people only got that money back when they left a place clean and paid their rent.

I want Mr. [redacted] to pay me the money that was promised in the agreement, plus the late fees that have been charged. Then, I will pay it to the HOA. After I get paid I will drop the complaint, but not until then.

The home is in foreclosure status. [redacted] was behind in payments to the HOA and already had late fees adding up before I met her. The contract that [redacted] signed with MovingUon states we do not pay late fees and back HOA fees. When the occupants moved in I contacted the attorney for the HOA and he had agreed to take 375.00 a month toward the HOA. I paid one month to him and then the HOA changed management and wouldn't accept the money any more. The HOA didn't want a renter anymore. The day the occupants moved out I met with [redacted] and I had a check made out to her that covered the HOA fees for the time the occupants were in the home and $100.00 a month late fees (Not Required per contract) for the time the occupants were in the home plus we gave her money to clean the carpet and clean the home, over $1400.00. [redacted] accepted the money. The home has been listed for five months and the only offer she received and accepted was while the occupants were in the home.

Mr. [redacted] did not address why the property was not left in the condition it was when the renters moved in. He was NEVER in my home before the renters moved out. My contract with him states the purpose for renting the property was: "maintaining the home, keeping utilities on and paying HOA fees where applicable." The contract also says: the manager is "to manage, operate, control, rent and lease the following described property (my address) for the purpose of preserving the property in saleable condition." The home was not maintained and considerable damage was done. The door on the pantry was off track, wood floors damaged, back storm door partially off hinges, carpet so dirty that when I had it cleaned it was impossible to remove the dirt so it will have to be replaced, and the plants in the patio were not watered and weeds removed. It was to be rented by "qualified renters," which these people were not. Mr. [redacted] stated that the people did not move in until the contract was signed. They moved in several days before. The reason I know this is because I went to my home to see that there were no problems several days before the contract was signed. I was surprised because someone had moved in. I was aware that someone was moving in but I was not told the specific time, therefore, it was a surprise to find out this way. Another thing that Mr. [redacted] would have known if he had checked on the property was that there was a male living there whose name was not on the contract the renters signed with Mr. [redacted] I was told this by a neighbor. Mr. [redacted] contract with the renters states: "No one over the age of 17 may reside in the home without being on the lease." This man was over 17. Also, Mr. [redacted] would have known how dirty the place was if he had visited on a regular basis, particularly if he had been there fore the people moved in. IT WAS NOT A DISTRESSED HOME when these renters moved in, but it was when they left. Mr. [redacted] collected a total of $3,450, none of which he earned according to what he was supposed to do as stated in the papers I signed with him and also the papers signed by the renters. He absolutely did nothing to make sure that it was in the same condition when they left as it was when they moved in. Mr. [redacted] contract with the renters also states: "Tenants must leave the property in the same condition as it was when they moved in and must make sure the house is neat and clean when vacating the house and must leave all appliances." Mr. [redacted] stated that my home is in foreclosure status. However, he failed to say that it is on a short sale also. Since the renters vacated the property and I cleaned it up the best I could, I have had several more potential buyers look at it. However, because of the condition it was left in, the price was lowered (partially because of how it was left). When the HOA refused to take any money, why didn't he give it to me and I could have paid the HOA? I probably can't do anything further, but I want this commplaint to stay on the record. If Mr. [redacted] wants it removed, he can pay me the rest of the money he collected.
