normal; word-spacing: 0px; background-color: #ffffff;">First, the complainant is not one of our customers. The complainant was the client of another broker.
Second, the disbursement of earnest money in a (failed) real estate transaction is subject to the contractual provisions in the state-mandated forms and subject to the Wisconsin Administrative Code. The broker (First Weber) is not a party to that contract and has no authority or discretion to disburse one way or another just because one side (the complainant) so demands.
I will not go into detail here, but the complainant was a would-be buyer who failed to close. The parties could not agree who should get some or all of the earnest money. The sellers believed themselves entitled to at least some of the earnest money as liquidated damages. The complainant refused to agree, but instead began pestering and threatening our agent. It was explained to the complainant on more than one occasion, and explained to her agent, that the broker cannot simply ignore the parties’ contractual terms or state regulations just because the complainant wants it to be resolved differently. We have no obligation or ability to force the sellers to agree with the complainant.
Third, I am informed this was resolved in the meantime by agreement between the parties. That resolution was voluntary, between the complainant and the sellers, and occurred after the complaint was filed but before we received it.
I trust that the fact this was resolved by the parties’ own agreement can be confirmed by you, and the complaint dismissed.
