Moye Fence Company was paid $6500 to install a fence with a double gate on my property. The fence and gate have stability issues. Moye Fence Company was paid $6500 to install a fence with a double gate on my property. The fence and gate have stability issues, and were installed incorrectly. These issues were partially corrected, however the gate is still not functional. I requested that this be repaired on 3/8/16, but the owner of the company refused. Desired SettlementI am requesting a refund in the amount necessary to pay a professional fencing company to make the required repairs.Business Response On 3/8/2016 I was informed by customer that the double gate had stability issues. Within a few hours of being notified, on the same day, I went to customer's house to check it out. The gate was inspected and the customer was told the gate was properly installed and the movement where the 2 gates closed together were normal and even showed the customer the next door neighbor's gate that was the same way. Customer was informed that additional hardware could be added for an additional charge but it would make the gate harder to open. The customer did not want that and seemed to be more concerned about the gate touching the ground when the gate was opened further than it needed to be and drug the ground due to the fact the customer had a tree cut down but did not remove the stump. Customer was informed the landscaping/grading in the area of the tree stump was his responsibility to correct. Please note, we had already adjusted approximately 70' of the installed fence because the customer wanted the fence closer to the ground.After receiving this complaint from the Revdex.com on 3/10/16, the customer's mother, which was our contact for this job, was contacted and we again offered to add additional hardware to the gate and if necessary we would even level the customer's stump area to appease the customer even though that was not our responsibility. The customer's mother could not believe he was not satisfied and agreed to talk with him and get back with us. The mother called back and said she thought we had done all we needed to do and that her son would make any needed adjustments. It is our desire that this issue be resolved.Consumer Response The information provided by the business is at best a work of fiction.After I explained the repairs that needed to be made, the owner immediately became belligerent and confrontational. He refused to accept responsibility for the faults in the gate, and suggested that I pay him again for services and materials for which he had already been compensated. This is obviously unacceptable.The gate does not open properly due to a combination of it being mounted too low and the fact that it is not level. This has nothing to do with the grading of the property, nor a tree previously being in this location. This also may be due to the fact that the owner decided to set the posts for the fence during a week when we received severe rain. The gate has stability issues because the right side is missing the necessary hardware. The owner had the chance to fix these issues when they were brought to his attention, but refused repeatedly.He was eventually asked to leave the property after he began screaming and disturbing the neighborhood. This was the last contact that I have had with the owner.70' feet of fencing was repaired due to extreme negligence during installation. I didn't arbitrarily request that the fence be lowered; there was a massive gap between the bottom of the fence and the ground that effectively made the fence useless.The owner actually contacted my mother to complain that I had submitted a claim to the Revdex.com. He has called me in the past, so I don't know why he didn't call me directly. His recollection of the conversation he had with her is incorrect. At no point did she make any of the statements the owner claims. She advised him not to return to the property, a decision I agree with considering his deplorable behavior. The owner is clearly unstable, and having him return to the property to make the necessary repairs constitutes an unreasonable risk that I am unwilling to assume. This issue will be resolved when I receive compensation for the necessary repairs. I have contacted Seegers fencing company and after a careful evaluation, they concurred that the gate was improperly installed. They are preparing a quote for the cost of repairs that will be submitted with this complaint at a later date.Final Consumer Response This case can be closed. The business made the necessary repairs on 3/23/16.
