company does not provide contract. paid for what I was told was a year's contract (fall of '14-fall '15) and they did not provide any services.2011-2013 we had a contract with the company for installation of their equipment and servicing. They wanted 100% payment up-front. We thought this was unusual so we questionned it. The owner agreed for us to pay balance when service was complete. We paid. Appr. a year went by and we had no renewal or contact from the company. In fall of 2014 when I called to ask for new contract, was told "contracts are mailed in January, send a check for certain amount of $ and you will be all set". I sent the check before the end of 2014 and never received any services. In 2015 I received a "contract" which looked more like a bill so I did not pay it. I have had active termites during and since this time and never gotten any of the value of the money I sent in the fall of 2014. I want the company to honor the payment and provide services or to refund my money and pay for the damages to my home for the failure of their company to honor their "contract".Desired SettlementSince I expected my payment in 2014 would still be in effect till 2015, Id like them to either honor their "contract" and make restitution for current damage to my home, refund my money and make restitution, or provide me with an ongoing contract from date of the settlement of the issue for as long as the value of the contract equals the cost of the remediation of the damage to my home costs me.Business Response Mr [redacted] signed a termite treatment contract with American Pest Solutions on May 16th of 2012. The initial treatment was completed on May 30 2012 warrantied through December 31 2013 all stated on the contract. All of our termite service agreements require full payment upon completion of the initial service. The [redacted] did not pay us in full at the time of the initial service and made installments for the next 19 months which is not our standard practice at all. The contract allows for a warranty renewal in 2014 for the fee of $315 annually. Our process sends warranty renewal bills out at the end of December, if no response the bills are sent out again 2 more times, then we try to reach customers by phone. If no response is received we cancel the warranty. The [redacted] did not send in the warranty payment until August 14th of 2014, technically we did not have to renew the warranty since it was 8 months after the expiration date but we did any way.Sent warranty renewal bill out in December 2014 for 2015 warranty renewal. Did not hear back from them. Called and left messages on 02/25/2015 and 04/09/2015 with no response. Account has been deactivated.We have treated hundreds of homes and this is the first time I have encountered this type of situation.
