We have attempted to come to an agreement with Mr [redacted] Our resolution was that he would owe us nothing for the newly constructed driveway and we would not be responsible for his aged and deteriorating drivewaySatellite views from show that his driveway had extensive damages and the concrete had been patched with AsphaltUpon inspection of the driveway Mr PatchandRepairs could see no substantially new damage that created a hazardAll the substantial damages are aged and continue to deteriorate due to heat, drought and substandard constructionIt is our belief that Mr [redacted] is looking for a completely new driveway at no costWe cannot agree to those terms considering the extent of the deterioration and age of the existing driveway and we believe that our offer was more than reasonable

On May 4th, we entered into a written/verbal contract with [redacted] Please see attached signed quote as well as the Contract Service agreement signed and dated by our foremanThe Contract was delivered to Mr [redacted] he refused to sign it but he was presented this document as well as the Quote for work to be performedThe current condition of Mr [redacted] 's driveway is no worse than it was before we began working on the newly poured sectionAs we stated before we were given permission by Mr [redacted] to drive the equipment onto his already deteriorating drivewayThe original driveway is merely inches of concrete with substandard rebar and is over 30+ years oldWe can present photo evidence that the cracks in the driveway all appear to be very agedAll changes in the original Quote were made verbally by Mr [redacted] and in no way were performed without his consent We will send a representative over to talk to Mr [redacted] to discuss the payment difference still owed to us, but we will not be performing any further work

I have receive a letter from Mr Patch to relieve him of all lost damage to my place if I would sign a waiver to that effect, that I take the money and fix my trouble drive way.That looks good on paper but to repair the drive way is about three times that cost, and what his company has done for me is cracked all ready and has to be replace, so this is not a done dealHe has not got good help, the supervision likes a way to go, I wish him well THANKs *** *** PS I am not very happy

*** *** I did not ok for Mr Patch to drive cement truck on the driveway I do not have a invoince for the work done are a bid sheetIf that is the way that he wants to run his businessI will take the moneys and patch my own drive wayI though he was a better man then he has show:s to be, I did not say the slab was to be larger than we talked about it was his crew set that up not meWhen the job is complete as we agree up the I will pay what he and I agreed But he can walk across the street and talk to me, that is still open Thanks

with my complint I am still open. All he has to do is walk across the streetBut if he has trouble saying that the personal was wrong by bring the big truck on my drive then the problem is not solove yet

I am rejecting this response because: I did not get a quote sheet for my file from Mr Patch & company but they have one now, all I sign was a sheet with a sum of $5000.00 to replace a slap in my back yard  20x30 to formed up by his company. I ask if I could have a extra day to install some electric piping for future use, and we had a little trouble but I though we had that worked out. They was going to pour on Friday morning but could not a truck till late Friday about 3;30 , they poured and finish by 6;00 pm . The slab is not the best but it done, the help left a mess for me to get from car to house and back. I spent all day with a water hose cleaning the drive so we could get from car to house from house to car the cement dust was inch thick on the drive way, I am in a wheelchair what I go over ends up in my house on the floors and in our beds. That is all of things that people do not worry about handicap persons and a busted drive does not seem to trouble them good feet and legs walk in my shoes you will see things different. We can still talk, come see me

We were not able to come to an understanding with the homeowner. We, Mr. Patch and Repairs, has a verbal discussion with said homeowner before the project was started. We also received verbal approval from the homeowner to drive the cement truck and the dump truck through the drive way. The...

homeowner was aware of how damaged his driveway was before we started. As it is written in his statement, he is in agreement that his driveway is in fact aged and we are not responsible for the original state that it was in. "[redacted]" is not an employee in our company, so we are not sure who he is referring to. As for the project itself, 6 inches of base were used, and the final size of the concrete was larger than 30 ft by 20 ft. Throughout the project, upon the owners request, changes kept being made. the original size that we quoted him for was a 30 ft by 20 ft and he altered the sizes in the end. The "rough estimate" was given for $5000.00, which was a starting price depending on his adjustments. The finalized price was $6500.00 and the homeowner did not pay the full amount, nor did he pay the "rough estimate". The check that he made out was for $3500.00. That check has not been deposited, nor are we going to deposit it since it is not the correct amount due.

Satellite views from 2013 show that his driveway had extensive damages and the concrete had been patched with Asphalt. Upon inspection of the driveway Mr PatchandRepairs could see no substantially new damage that created a hazard. All the substantial damages are aged and continue to deteriorate due to heat, drought and substandard construction. It is our belief that Mr. [redacted] is looking for a completely new driveway at no cost. We cannot agree to those terms considering the extent of the deterioration and age of the existing driveway and we believe that our offer was more than reasonable.
