provided several false and slanderous claims in his complaint. Mr. Pools denies the claims in the complaint from Mr. [redacted]. We received a 5 page letter dated 9-6-12  from Mr. and Mrs [redacted] with 11 complaints. Attached is a copy of a response letter that was sent by certified mail to Mr. and Mrs. [redacted] dated October 3, 2012 for your office to review regarding his complaints.We tried to resolve the complaints however the consumer was unreasonable in his demands and the relationship deteriorated to the point that ultimately ended in the mechanic’s lien process to protect our right to collect past due money for materials provided and services performed. The lien was perfected.Moreover, Mr. and Mrs. [redacted] had the benefit of counsel to guide them in their decision process after the lien was placed.  Mr. Pools did receive a letter from his attorney dated December 10, 2012.  Per Mr. [redacted]’s complaint to the Ohio Attorney General’s Office under advice from his counsel he chose not to remedy the situation in court.  Mr. Pools did offer a discount of $475.00 which was accepted by Mr. and Mrs. [redacted] through their escrow agent at Maximum Title. The lien amount has been paid and a satisfaction to that lien will be filed.Now Mr. and Mrs. [redacted] collected on the improvements made by Mr. Pools and are upset because they were forced to pay for them.  Even though we provided a discounted amount Mr. [redacted] continues to slander our company with untrue accusations such as “Poor service/shoddy work”, “This company steals money and puts liens on homes” and “stealing money from lien process” and “placing illegal liens on properties” in an effort to tarnish our business name. While I understand mediation is a helpful tool to resolve differences in this case I hope the provided information and evidence demonstrates the consumer is both untruthful and unreasonable. We pride ourselves on our workmanship and our good and same name over 30 years in the pool business.  If I can be of any further assistance please contact me anytime. Sincerely,Robert *. However, the letter was not sealed and I am not sure If I received all the documentation. Enclosed in the open envelope, I received your cover letter about complaint #[redacted] and a page listing accusations from [redacted]. I assume [redacted] wrote it but since the document is not signed it is not clear. I bring this to your attention to make sure I have all the information so that I may file a complete response.To address the complaint response I will use the same letter format. A. He never sent us a letter= Mr. Pools did send a letter on October 4, 2012 and a copy was forwarded with our first response. B. False Lien= Mr. [redacted] had the opportunity to file suit and decided not to file. C. Liens many properties= This is libel. This is a false statement. Mr. Pools only places liens as a last resort to preserve our right to collect from non-payers for goods and services rendered. D. Did not respond to Mr. [redacted].= Mr. Pools did respond, Mr. [redacted] did not like the response. Balance due on account = Mr. [redacted]’s escrow agent requested an accounting of the past due balance and pay off amount that included interest and fees. Mr. [redacted] agreed to pay the past due balance and fees to remove lien. E. Is not answering all the questions= Mr. Pools does not know what this means. F. Never asked to prep for a new driveway= The invoice clearly states Labor to remove sidewalk to prepare  for police cruiser there are no charges for prep a new driveway. G. Attempt to contact- Attorney= Mr. [redacted] did try to refinance his property and the Mr. Pools mechanic’s lien was in the way at that time as well. Mr. Pools provided the pay-off amount and we did not hear from Mr. [redacted] until just recently 2017. Mr. Pools was not compelled to answer attorney letter because there was no case filed on the matter. H.Pictures/Slander=Mr. Pools does not have any pictures attached to this letter to look at.I.  Photos of fence agreed to fix=The fence was 7 years old and way out of warranty at the time additional work was performed and not paid for.J.  Multi-coat representative was on the site 5-1-12 per Mr. Pools notes in Mr. [redacted] file. I do not see any email proof attached that he was not there.With reference to the nasty comments about "Bob J[redacted] is a shyster and lyer" which are horribly misspelled. The only comments I have about that is [redacted] is a man with PTSD according to his wife's published comments. [redacted]In the article it describes how [redacted] has Post traumatic stress disorder moreover, the trouble he experienced on the Parma Police Force. Therefore, I believe he is an unstable and unreasonable person and feel that his statements misrepresent the facts in this matter.In conclusion, there is nothing to offer him in a way of resolution.  He believes that he does not owe the money even though he agreed to pay the final bill to sell his home. Mr. Pools is not interested in providing any refund as he requested. Mr. [redacted] had the opportunity , time and advice from legal counsel in 2012 but did not follow through his claims.  He now seeks to defame the good name of Mr. Pools and assassinate my impeccable character through Revdex.com's good service. Sincerely, Robert A. [redacted],I am in receipt of the complaint filed by Mr. [redacted] and I appreciate the opportunity to respond. I must sayin my 30 years as a pool professional I thought l have heard it all but this complaint is a new one for me.Mr. [redacted] says he had several problems with the pool closing but failed to make any reports or phone callsabout his issues for more than 7 months after the pool closing service. Then he schedules a pool Opening anddoes not complain. Then he purchases the parts to make the repairs himself along with pool chemicals to openhis pool and does not complain. In fact, Mr. [redacted] does not even complain about his pool closing issues to theretail store representative when he bought his chemicals or the replacement parts. in fact, in his own words andcomplaint it states " At this time I still did not tell them they broke it when they closed the pool in the fall." All ofa sudden after his, again his own words, "several unsuccessful attempts to fix their mistake” now he decides it'sa good time to complain about his pool closing service issues from seven months ago.All I have to say is really?Mr. [redacted] was advised that with the harsh winter temperatures we had this year many people had issues withabove ground pvc plumbing and unfortunately it has no warranty from the pool closing service. Since Mr.[redacted] did not report his claim in a timely fashion his request for a refund of $325 is denied. I would be happy toreschedule him for service since he cancelled his pool opening service for May 16, 2015 but it would not be free.It is disappointing to me that this matter cannot be resolved to the customer's satisfaction as Mr. Pools pridesitself on the outstanding pool services we perform.   I disagree with what Bob J[redacted]A) he never sent us a letter, I would like the receipt for it.B) it is a false lien he never notified usc) he told me he liens many properties and lifts it after payment without telling the ownerD) he never responded to me and I paid him $3000 cash and now he took it againE) we had a verbal contract he isn't answering all the questionsF) I never asked him to prep for a new driveway, to this date it is the same drivewayG) I attempted to contact him over the years to resolve this and when I found out there was a lien an attorney wrote him letters he never responded to H) look at the attached pictures. He forgot I took them, it is not slander if it is trueI) why do I have photos of the fence that we agreed on him fixing if he said he wouldn't?J) no person from multi coat was ever on the property as promised. I spoke to them myself and I have E Mail to prove they never came.  I have more photos. Bob J[redacted] is a shyster and a lyer and he forgets his own lies he does it so much. I do not even live there anymore and it makes me sick how we were treated and are still treated by this individual and his company.
