We disagree with *** *** and this is our response.MrRooter Plumbing completed all obligations per the written contract. MrRooter Plumbing went above and beyond the written agreement. The contract clearly states that the excavated area will be tapered in lifts and
mounded. Nowhere does the contract state that MrRooter would restore the excavation area and the contract does not state that Mrs*** paid for that service. MrRooter is in no way responsible for her llawn or landscape as outlined in the signed contract and Invoice. Mrs*** perfectly describes and provides photo's of the "Mound of Dirt from house to city sidewalk" exactly as the proposal and invoice read. The statement she makes regarding the tree that stands over her sewer being trimmed without permission in not truthful to say the least. The discussion about the tree was "remove only what is necessary. She then had the tree trimmed extensively and to her liking. Again, MrRooter never contracted any tree trimming repair per our contract in an effort to relieve her flooding situation. The grief Mrs*** has experienced over the mound of dirt and trimming of her tree afford her no relief of pay for the services she contracted with MrRooter Plumbing

I am rejecting this response because:(Revdex.com - converted from original document.  See files.) I have reviewed their response to my complaint and I am NOT satisfied. I am providing you with my son's number in which Mr. Rooter's manager on my job Joe,  G[redacted] & Brent?, [redacted], verbally told him, over the phone, that the outside of my house would be completely cleaned up and put back to the aspect that we would never know they were here to dig up my yard. My son asked Mr. Rooter to provide him with he [redacted] permit and inspection. My son then talked with Joe or Brent on 4/09/2016. At this time Brent or George told my son he would fix the leak in my hot water tank that occurred AFTER the men worked in my basement and he would address the tree and mound in the yard as well. My son's cell # is: [redacted], Mr. [redacted]. When I came home, the men working outside DID NOT identify themselves and followed me into my garage telling me to sign papers. Where are these papers? I had to call the company to stop these men from pounding on my front door and the secretary heard me yell for them to stop trying to open my door! I refused to sign these papers because these men DID NOT finish the outside of my yard, and why, why, would I give these men permission to CUT UP my father's memorial tree? Sad that Mr. Rooter says that I gave them permission to CUT UP a memorial tree. If they needed to TRIM a few inches from the bottom to dig I can understand. BUT, to cut up a tree over 10 feet, SAD, Again, where are these papers that I did not sign, from these men? I do have the paper that states the following in regards to my yard, "Excavation will be mounded slightly to area for settling. Then will be seeded and strawed." I am enclosing the paper with this information on it. The mound outside, as you can see from the pictures, is NOT slightly mounded, and the seeded and strawed was so poorly done that only weeds and dirt remain. Joe G[redacted] stated to my mother, myself, and then called my son and said, "We will complete the outside as soon as settling is done and you'll never know we were here". Call my son and he will tell you wmanager, Brent or Joe G[redacted], said he would do for me in regards to my outside lawn. The lawn work was to be done in June or July of 2016, and the manager even said, "I know a man that works with trees and I personally will come out and fertilize your tree. " NONE of this was completed. To the aspect that Mr. Rooter states they went "above and beyond the written agreement" is NOT correct. These are the following reasons why they DID NOT go above and beyond: 1. The company DID NOT put up any barriers to stop the dust and dirt from going all OVER my home. The basement wreck room side was white with dust and the door, floor, rugs, and stairs were filthy. My washer and dryer were filthy as well as all of my school supplies on the basement and wreck room side. I am enclosing pictures of these as well. Therefore, the company had to hire someone to clean up their mess. The first company came out and the one cleaning man took a chunk out of the sink Mr. Rooter had to replace because the men doing the digging CRACKED my original sink. MY original sink had NO cracks in it and DID NOT LEAK. However, the men not only cracked my sink, but they ALSO broke my hot water tank valve. Yes, Mr. Rooter HAD TO FIX THESE ITEMS because THEY broke them! This is not going above and beyond the contract. Also, Mr. Rooter's men CUT my PHONE LINES! Therefore, once again, Mr. Rooter had to call someone to FIX THEIR MISTAKE, and again, the man left a mess and I had to tell him to clean up the small pieces and staples so my animals would not be harmed by their mess. That sink picture is also enclosed. The men also broke my father's Ivory Handled Umbrella! Then the men hid this umbrella and the manager, Joe G[redacted] himself, found it in the mess his men left behind in my basement. 2.          Mr. Rooter ONLY CLEANED UP the messes THEY CREATED! They did NOT go above and beyond; they cleaned up their messes! 3.    The contract for the outside paper was NOT signed by me because the men DID NOT finish the work. Where is this paper/contract? Mr. Rooter's personal secretary heard me say I will not sign the papers when I had her on the phone trying to stop the men trying to pull open my front door., 4.    My mother was present also when all of the outside and inside contracts were both verbally and written into the contracts. She will also witness that the manager said, "When we're gone, you will not know we were here inside or outside." Well, you can see that by the pictures, in which Mr. Rooter also can witness, shows the work outside is still NOT DONE over 6 months later. The mound is NOT "mounded slightly" and the grass and straw was a JOKE! What I want to do is proceed with this matter and have my payment reduced because they DID NOT finish the outside job. I am greatly disappointed in their service, meanness, and lies. I am making sure that EVERYONE who asks me, "What happened to your yard?" knows Mr. Rooter did NOT complete their job. The Proposal contract paper 1 signed stated a slight mound and the yard to be seeded and strewed. Also, Joe G[redacted] stated that my yard would, "look as if we were never here". None of this was completed. Therefore, the Proposal paper states $9,200.00 due upon completion. The job is not complete so% of that is ONLY due. $4,600.00 should be subtracted from my bill; I will pay ONLY for the work that was completed as stated both in the contract and verbally stated to my family by Joe G[redacted] & Brent. Therefore, a payment of $15, 100.00 is ALL that is due to Mr. Rooter. I DO NOT WANT THIS COMPANY anywhere near my home AGAIN! Please, publish this report as needed to ensure that NO ONE else has to be put through the mess, time, and rudeness of this company. Again, I will not be bullied by a company that has made promises, and then lied and not followed through with the work. Please, contact the manager, Joe G[redacted], and see if he has integrity to tell you what he or Brent told my son, mother, and myself would be done for my home. I am also enclosing my notes of 04-09-16 that states "small mound of dirt", and fix tree and mound along with notes of my son's conversation with Joe. On 04-04-2016, I again wrote the notes, "mound of dirt? layered and compressed in "small" mound that was stated to me by Joe G[redacted]. and/or Brent. Respectfully, [redacted]
