As owners of The *** Apartments, we have the legal right to take back possession of any unit, provided we have given at least (30) thirty days notice to the resident.We did provide the above resident at the above address the minimum of a thirty day notice to vacate, as we notified him on June 1,

Called several times over the past three months about one of the bedroom windows leaking when it rains I have moved my curtain rod over times now because the wall.gets wet that it caused my curtains to fallThey had maintenance come out and all they did was spray paint around the window seal where there is black mold and put cocking but on cocking where the window is actually leaking at Our air conditioner has been acting up for three months maybe longer maintenance has come out to look at it maybe times out of the times I have called about it and every time they have a different excuse as to why they can't fix it or they don't see anything wrong with it they have no idea what their doing and just like today one July 31st I called office and *** *** says she will send maintenance out and nobody ever shows which is not unusual

They *** meBack a month ago I attempted to contact the head of *** *** *** ** *** in an attempt to find out prices for the next years leaseI called several times and even shown up in person on a Saturday after work and a few days before workAt no point did I receive any information backI wrote a letter and turned it in on the 24th of July stating that I was looking for a house and was interested in month to month until I could purchase oneBut in the event that I did find a house that this letter is meant to be my "day notice." Well after no one contacted me back after some time I spoke to a previous resident who said he just kept paying his rent even after his lease was up in a month to month fashion until he bought his homeSo I assumed that was the case in my situationWell August 14th I received a phone call from my girl friend who was up at the office trying to make contactThey informed me a week and a half BEFORE my lease is up that my

Moving in on September 25, so this has been resolved

Review: I lived in [redacted] Place apartments which is owned by M&R Ventures. When we moved in the apartment was different and not as nice as the one we were shown in the tour. The carpet was disgusting and we filled out the pre-move in paper work stating the issues with the carpet. When we moved out, M&R Ventures not only kept our $150 deposit but then billed us for an additional $105. The apartment was thoroughly cleaned by ourselves before we moved out. Spoke with the management and they said they paid someone to come in a clean the apartment after we left and that they had to pay for the carpet to be cleaned,Desired Settlement: I want my $150 deposit back. That is all. We did not wreck the apartment and cleaned it upon moving out and still have the signed checklist from before we moved in that is signed by their management and placed in with out contract.

Mr. [redacted] was not charged for any item that was on his move in inspection at time of move in. However he was charged or cleaning that was not done when he left the apt. and the basic carpet cleaning for it so this did add up to the amount we send him on his final account statement. Thank you. Review: I rented an apartment from M and R ventures back in November. I lived at apt ** at one of their property's called [redacted]. When we first moved in the apartment had not been cleaned at all, the toilet was backing up, and the tiles in the bath room were sealed down. After dealing with this we called the repair people, maintenance man came and said that the toilet just did that, and recommended a plunger. As weeks went on I started to get really sick, extreme head aches, diarrhea,weight loss, difficult breathing. I went and bought a mold test and when it tested positive, I left I had been sick for over a month, after leaving I faxed in a letter stating why I would no longer live there with pictures of the mold next to the furnace which I still have. And 2 1/12 months later they are now sending me a bill for over $2000.00. When I called the health department, this is not their first problem. You may think this is just another person leaving and not wanting to pay, I have rented since age 18 and would be pleased to provide a list of reference just to clarify this is about unlivable conditions and an unhelpful staff.Desired Settlement: I will continue to fight untill there is a 0 balance, I have paid enough to live in those conditions.

No work order was ever called in for this unit. Resident is no longer a tenant at [redacted] Apts.

Review: I have been refused to be given my full deposit back.

Management and multiple employees there have now told me that I will not be given my full deposit back, due to the fact that the apartment was not in "move-in ready conditions".

I asked what exactly they meant, and what the 65$ was going towards.

They stated the money would go towards the wear and tear of the carpet, even though nothing was excessively dirty, stained, or damaged.

I advised I cleaned the carpets myself when moving out, including shampoo and vacuuming the carpets.

They advised that I am not allowed to clean the carpets, and only a corporation or business must clean it, and give them a copy of the receipt for cleaning services for the 65$ charge to be waived.

I asked if the 65$ charge was stated on my lease, or the fact that I had to have it cleaned professionally, and they stated, and I quote "No, the lease states the Apartment must be in move-in condition when the tenant leaves"

My argument is that the carpet was cleaned, and the apartment had no damages. Also the law in Indiana (as per: http://www.in.gov/legislative/ic/2010/title32/ar31/ch3.html at IC 32-31-3-13 "use of deposits") that the deposit can be used "for actual damages to the rental unit or any ancillary facility that are not the result of ordinary wear and tear."

There was nothing excessive, more than "ordinary wear and tear".

I feel this is defrauding me as a customer/ tenant of theirs, and I have even addressed this section in the law with them, and they advised me "this is normal, we do it with every tenant, if it wasn't legal, we wouldn't do it"

This, from my understanding, is not legal. Can I please have clarification on this?

is a requirement that carpet be professionally cleaned and in move in

condition or the landlord will assess a $65 charge, the fee which they

pay to the professional they hire to clean the carpets. The tenant may

use another contractor to clean the carpets but must provide a receipt

which will result in a waiver of the $65 dollar fee. If a receipt from a

professional cleaner is not provided the tenant will be charged $65.

I understand the response. However, it still does not make it legal for the complex to with old for regular wear and tear. No where in my contract does it state that I agree to pay for professional carpet cleaning. The only thing in contract is that I agreed to have the apartment in "move-in-ready" condition. No where did it state that I couldn't clean my own carpets and had to pay someone else.
