I take that as omission to her trespassing Since she paid the remaining $40, but put in her letter that she doesn't think she has to, appears to be "wash." She also wanted a refund of $110; however, like I stated before, my prices are approved with the state, insurance companies, and law enforcementI worked with Mrs [redacted] s as much as I could and it appears she took advantage of that as well

RE: Case #***; *** ***
I'm writing in response to the complaint filed in the referenced case above
On January 14th, 2016, I pulled Ms*** and her boyfriend out of the ditch and presented them with the amount they
owed for the serviceIn her complaint, she reported that it's a high tow billMy service amounts are approved with the state, insurance companies, and law enforcementHer and her boyfriend proceeded to tell me that her boyfriend just opened a company and wasn't able to pay for the bill right now because "money is tight" and he doesn't "believe in credit cards." I, as an entrepreneur, could understand the struggle and worked with them on paymentAccording to Minnesota state statute, if a customer doesn't have the money to pay for the service, the vehicle can legally be impounded for non-payment; otherwise it's considered theft of services
I left Ms*** and her boyfriend with their vehicle, being very nice on my partOn February 1st, 2016, I called Ms***'s boyfriend and asked when they'd be able to pay meHe said he was out of town and wouldn't be back for a few days and then would send paymentI told him ok but I would need it as soon as possible, which he assured me he would send it out immediately once they returned homeAfter a week of not hearing from them, I called her boyfriend again and got no answerI was unable to leave a voicemail, as it wasn't set up
Between Ms*** and her boyfriend, I spoke to them a total of three times over a monthThat does not even legally constitute harassmentAfter speaking to Ms*** the last time on February 18th, 2016, where she cussed me out and called me every name under the sun, did I put something on FacebookAs a business owner and knowing my customers use *** Ford of Superior, Wisconsin, I feel they needed to be warnedI'm highly concerned she's in the customer service business when she can't pay a simple tow bill and was given over a month to do so and signed the tow slip guaranteeing that she would, and then became aggressive with me when I call her back to see about getting paymentIf her and her boyfriend couldn't pay for the bill, they should have told me instead of giving me the run-around saying they would by a certain time and then I'd follow up once that time came and went
Lastly, in her complaint, Ms*** wrote "this tow truck driver was already out on the road and had a van on the back of their tow truckWhen pulling out the Truck they took the chain off the tow truck that was holding the van there and put it on our truck to be pulled outThis does not seem like very safe protocol." There are no "protocols" or rules that were brokenThe chain that she's referring to was an extra chainThe van was attached at points underneath it on the flatbedIf she was concerned about safety, I wish she would've said something at that time, as I would've been happy to show and explain to her; instead of using it in her complaint to bolster her argument
In terms of a resolution, a very nice man from North Dakota called and said that he heard about what happened and actually paid the bill in FULL because he said, "that's not right what happened to us" and $for a winch is cheap!" As far as I'm concerned, Ms*** can keep her $money order, which I will be sending back to her, as she now received a free service from our company
Thank you
Initial Consumer Rebuttal /* (2000, 8, 2016/03/03) */
(The consumer indicated he/she ACCEPTED the response from the business.)
I'm completely appalled by the amount of lies told in the statement aboveIt definitely concerns me knowing MrsMac towing is out on the road taking advantage of people in vulnerable situations and getting away with itThere was three people in that vehicle that day and witnessed everything that happened and presenting the tow bill amount before the tow happened was definitely not one of themAlso I'm extremely shocked that this man would lie and say I cussed him out and called him every name under the sunWe both know that is a complete and total lieWhen I was contacted at work, I told the man that I was not paying for the whole bill and I thought he was a scam artistAfter this was said his voice started to raise and I realized we were not going to be able to resolve this so I told him I was reporting him to the Revdex.com and to have a nice day and then hung up the phoneSoon after this things were posted on FacebookThis type of defamation of character is ridiculous and uncalled forI just hope other people are aware of the scams tow truck drivers like to pull to get some extra cash in their pocketsYou should truly be ashamed of yourself

RE: Case #[redacted]
I'm writing in response to the complaint filed in the reference case above.
In her complaint, Mrs. [redacted]s reports that she was told to pay "$340 cash plus sign the title over to them before I could...

get access to the vehicle." This is untrue. I told her cash OR credit, which is standard. She even reports in the complaint, "I went with $300 cash and the young man was nice and let me get my stuff." Therefore, her initial comment is now null-and-void.
In addition, Mrs. [redacted]s lists out the specific amounts she was charged. These are standards rates that are approved by the state, insurance companies, and law enforcement. In comparison to my local competition, my prices are low.
As Mrs. [redacted]s states, she was not paid storage. I very much could of charged her storage, but I didn't. When she explained that the amount was 1/3 of what she gets every month, that is unfortunate. However, that is not my problem. I have many high bills that are associated with this company, if I didn't charge or cut everyone a break, I wouldn't have a company. Also, I'd like to reiterate that my prices are LOW compared to my competition.
Once a tow service is provided, I legally don't have to let someone have access to their vehicle, unless they've paid the bill in full and/or have signed the title over. I felt bad for Mrs. [redacted]s and let her have access to her car to retrieve her items, and didn't request the full amount before letting her do that as well, like I could have.
As for Mrs. [redacted]s wanting reembursment for the "Other Services" that she doesn't know anything about we decline that also. The other services she was charged for are outlined in her itemized bill she received the day she retrieved her personal belongings and are not covered by the $125 towing Charge.
However, Mrs. [redacted]s neglected a huge point from her complaint. On 2/24/16 , she called and said that she was at the impound waiting to get the rest of her items. I told her that you're supposed to call ahead of time, as the impound is not guarded. She said that she is there now. I told her I could be there in an hour. Once I arrived, I saw that she wasn't there. I went into the impound lot and saw that there were footsteps around her vehicle, and only hers. I took picture and am happy to provide them upon request. This is a closed gate and that is considered trespassing! I called her immediately. She didn't answer so I left her a message asking her to call me back. I never heard from her. I called her again and left her another message saying that if she didn't call me back to discuss this, I would call law enforcement to report trespassing, as she took her items without paying the rest of the bill and signing over the titled. Later that day, I was told by Lisa, that Mrs. [redacted]s showed up to our mailing Location, and dropped off the remaining $40 owed and the title reporting, "please tell him not to call the cops." I take that as omission to her trespassing.
Since she paid the remaining $40, but put in her letter that she doesn't think she has to, appears to be "wash." She also wanted a refund of $110; however, like I stated before, my prices are approved with the state, insurance companies, and law enforcement. I worked with Mrs. [redacted]s as much as I could and it appears she took advantage of that as well.
