M&S of Pawling

Review: I purchased an automobile from M & S of Pawling pursuant to an advertisement on their web-site as well as an ad they placed on cars.com. They advertised that the car had air conditioning. When I first talked to the sales rep, (maybe the 2nd or 3rd conversation of many) he volunteered the information, that the "air conditioning is cold as can be and is working fine." When I received the car in North Carolina, (as I did purchase it without seeing it,) I thought the air was not working. When I contacted the dealer, the sales man said "its not working, oh no, did you put it on cold? It was working, I don’t understand what happened. Let me talk to my supervisor and I will call you back." Thus, at that time he believed that the car came with air conditioning. He did not call back so I called him the next day. I asked him what he found out. At that time, he explained that as far as they knew the car did not come with air conditioning, that it was an option and it never had it. I am confident they advertised the car as.. with.. a/c. I asked for a copy of their ad, so as to confirm that it stated there was A/C, and they said they did not have a copy. Living in NC, where it is hot 8 out of 12 mos, I would never purchase a car without air conditioning. I truly believe the sales man knew that he represented the car as with a/c, but obviously will not admit it now.Desired Settlement: I would like the dealership to do one of two things. Either take the car back, shipping cost at their expense, or pay to have an A/C installed. The car as it stands, without A/C, is much less valuable than one with A/C, and will be impossible for me to sell without taking a significant financial loss. Thank you.

This car (1993 240sx Convertible) did not come with A/C. We never stated that it had A/C. Our Listing agency confirmed we never advertised the car with A/C. A copy of the vehicle listing has been provided to Ms. [redacted] showing that A/C was not a listed option. In 1993 no 240sv Conv. came with factory A/C. They were only available with dealer/port installed A/C, which this car didn't have. Ms.[redacted] sent us a list of questions about this car prior to the sale of the veh. We can provide a copy of this list of questions which does not mention A/C. She never asked if the car had A/C.
