I am rejecting this response because there is more to be settled than just providing a punch list and coming in and completing the unfinished work. Some of the unfinished work according to the contract has already been paid for, in addition to the finish work of $still owed. I refer to the initial documentation sent in this complaint and the contents within it for reference of items left to be discussed regarding, approximately items. I also refer to this documentation for a list of items under warranties where the contractor agreed to meet trade standards of good workmanship and that was not done, items. In addition there are several change order items that need to be reviewed, discussed and reconciled, also found in the initial documentation filed as complaint to the Revdex.com. Window insurance reconciliation needs to occur as well in this change request documentation. We are happy to make arrangements to meet with you at an agreed upon time to discuss in person and go over these items in an attempt to come up with agreed upon terms before you have to come back to complete the work and before *** is back from out of town, the first part of March. *** gives full permission for his wife to discuss on his behalf in negotiating these differences so change requests could be made for the discrepancies for his signature, as it is with him that you have the contract. If the contractor is not agreeable to this then the discussion will need to be delayed until *** gets back.

this is *** with Christian man construction per job in red rock Texas was in area on Decand received phone call from wife early dec,very ill so I took back home message job of situation and went home to be with wife during trip miss ***e was very up set with me trying to
reschedule her job on Dec 18 and as you can see in emails she was not agreeable she called me and ask if I can just send anyone to do job and I told her went it comes to plumbing and electrical I must be on sitethe bottom line was there was no money paid to Christian man construction and her behavior I told her we with draw form bid we have right to refuse work with anyonethanks *** ***

we left job in June due to septic and electrical lines to be hookup and as of conversation with *** *** sin decmember items still not dune and was told he would be gone January and February would be in Texas so this is a surprise to us we would like to have a punch list provided and we will
schedule a time for completingWe have no problem with completing just this fall here at Christian man construction and customer have been dealing with mager health issues it's has been a bad time for both of are families also about money left on contact During construction of this project there was a tarabile stom damage to broken windows and my trailerCustomer was payed from insurance and I never received and money for damages when adjuster was there was showed windows and my trailer and showed invoice for window and according to the contract customer is responsible to repay our lossTo sum this up there's parts of this complaint missing as I have told rusty dealing with health problems getting better and was expecting when he got back to Texas we are planning to finish project as per conversation in December he would be out of town January and FebruaryWill be waiting for punch list and need full power to building so can run a/c unit for testThat was why subcontractor has not been there to finish a/c but I have been in contact with them and told them also rusty would be out of town January and February so we both was wait for march to resume projectPlease have customer send punch list to *** and when be in Texas and we can finish.thanks***

I am rejecting this response because:As stated in my initial complaint, [redacted] and I DID have a contract. He was VERY unprofessional with his handling of this matter. Though, at this point I wouldn't even consider allowing him to do my project, I want others to know how he handled this and warn them not to do business with him. I found [redacted] through the website, BUILDZOOM. I will be posting a complaint on that site as well as communicating the issues to a BUILDZOOM representative.Below is the definition of a CONTRACT from the sba.gov website. I sent the signature page from [redacted]'s contract back to him on December 8th. And he agreed to receive a CASH payment upon his arrival to start the work on December 9th. There is no question that this was a "pledge to exchange these items," as stated in the definition below.THE FOLLOWING IS COPIED FROM sba.gov"Generally, to be legally valid, most contracts must contain two elements: All parties must agree about an offer made by one party and accepted by the other. Something of value must be exchanged for something else of value. This can include goods, cash, services, or a pledge to exchange these items."
