You stated that MSW started to garnish your wages and that you have excellent and clean credit and do not owe money to any company. After our review, we agree with your belief that you do not owe any money to MSW Capital. To give you some background on this situation; MSW Capital, LLC is a passive debt-buying company meaning that we purchase charged off accounts and outsource the collection effort to our collection agencies or law firms. MSW does not collect nor garnish on any account directly. This account in question was purchased from [redacted] in 2010 and placed with [redacted] in January 2013. [redacted] went through all proper and legal procedures following Florida procedural law in regards to this debt to obtain judgment and enforce the judgment. The law firm legally served an employer to verify the proper name and SSN listed on the court documents and enforce their judgment. In our thorough review, it was determined that the employer erred by not reviewing the court documents properly and allowed the garnishment to proceed and withdrew monies from your paycheck. Florida law allows the employer to withhold funds until a court order is issued to release the funds to the plaintiff. Complaint: [redacted]I am rejecting this response because:As I stated earlier, my agreement with [redacted] did not state any of the practices that MSW Capital, LLC.  My credit report reflects [redacted] nothing reports MSW Capital.  You illegally bought my account under the terms between [redacted] and MSW.  [redacted] says they can do anything with a "closed account".  I'm an active duty soldier and moved to a new assignment.  [redacted] didn't want to work with me on my new position.  Thus, the agreement between MSW Capital and [redacted] voids my agreement between [redacted] and the account holder.  I am not liable to any interest or the amount due.  I paid [redacted] toward my [redacted] account, not MSW Capital.  You are a third party that never consulted me on my account and/or the agreement. Thus, I am not responsible for any amount paid that you had "purchased" through Credit One.  You have NO RIGHT upholding an "agreement" that I had never signed, nor agreed upon.  I demand a refund of all of my paid to [redacted] because it isn't going to my [redacted] account it is going to MSW Capital, a third party consulting firm. Regards,[redacted]

I am rejecting this response because: MSW Capital lied about the purchase, erroneously charged interest on the account, and gave [redacted] false information on the account.  I have spent way too much time trying to correct this matter.  However, MSW Capital still feels there was no error and has received MORE than the origina[redacted] account.  If MSW Capital would have provided ALL information in a timely fashion, I would not had to go to great lengths to rectify the errors.  I am owed for my time, the errors of MSW, and the overpayment of th [redacted] account.

that you closed the account at the amount of $1,250 but the account continued to accrue a balance. You stated that you never agreed to this. MSW Capital, LLC is a passive debt-buying company meaning that we purchase the accounts and outsource the collection effort to our collection agencies or law firms. This account was purchased from [redacted] in January 2013 and placed with ** [redacted] in May 2013. Your account was already closed by [redacted] bank prior to us purchasing the account. Your account was charged-off by the bank on December 14th, 2012 due to non-payment with a balance of $1,306.81. The last payment they received from you was on July 20th, 2012 in the amount of $43.00. Even though your account may have been closed your account will continue to accrue interest and fees. Once the account was sold, your account continued to accrue interest per your legal contract rate within the initial contract agreement when your account was opened with [redacted] Bank; your account was opened on May 8th, 2008. Our goal is always to try and assist every customer in resolving their accounts in accordance with the FDCPA and all other Federal and State laws and guidelines. While we cannot always agree on a mutual outcome we appreciate you bringing this to the Revdex.com and allowing MSW Capital, LLC a chance to review your case thoroughly. Sincerely
