Review: My family has owned an eight grave family plot at this cemetery for over one hundred years. I am the last survivor of the family. My mother passed away last year, and the cemetery sent a list of services that they offered.It is obviously an old cemetery and the graves all have ivy planted on them. The cemetery refuses to plant the ivy because I don't want a $375.00 "seasonal trimming and planting" done to the plot. There is no need for this service, as I was just there and the plot is fine. I don't want them to do anything but put the ivy on the grave that it will match the others.Desired Settlement: Plant ivy on the grave, without having to pay for additional unneeded work on the plot.

This letter is in response to your notification of complaint dated July **, 2013.

We have reviewed the account regarding the Hertz Family Plot as captioned above. Seasonal Maintenance (care) is an optional service and the family is not obligated to pay for same. However, in accordance with rule #34 of the General Rules and Regulations of Mount Carmel Cemetery, under the section of "Care" in part states:

"Only grass or approved plants may be used. A grave or lot owner may arrange with the Cemetery office for the planting and cultivating of trees, shrubs and plants on the grave or lot by the Association. No orders for the planting of trees, shrubs or plants on a grave or lot will be accepted unless provision is made for seasonal care thereof."

In order to avoid payment. for care, the family may plant the ivy on the gravesite themselves. The family must make an appointment with the Director of Operations of the Cemetery for his inspection of the ivy and the family must present a certificate from the grower stating that the plants are disease free. The ivy must be planted in conformance with other ivy graves in the Cemetery.

Without payment for care, the family may opt to hire a private gardener to plant the ivy. The gardener must contact the Director of Operations of the Cemetery prior to commencement of work as insurance requirements must be met as well as proper permits from the family and a certificate from the grower that the plants are disease free.

When seasonal care is paid, the Cemetery cuts and trims the graves and plots from May through October of any given year. The work is done on a rotation basis around the Cemetery several times during this growing period. Ivy graves are also weeded. The Cemetery does planting of ivy in the spring and fall of the year. Enclosed is a photograph depicting the appearance of the plot today. The charge for care of the plot is approved by the State of New York, Department of State, Division of Cemeteries. The charge is based upon the size of the lot, the type of planting and the number of interments therein.
