Review: This complaint involves a $500.00 deposit I put down on a car at this dealership and they are refusing to refund my money.

On 7/25/2013 I entered the lot at the dealership with the intention of possibly purchasing a vehicle within the next day because it was close to closing time and I was borrowing my daughters vehicle and it was close to the time I needed to pick her up from work. I was greeted by Mr. [redacted] and let him know what my situation was and asked if they did in-house finance which I was informed they did. He proceeded to ask what I was working with for a down payment and I told him around $1, 000 he then showed me vehicles that would fit in that down payment range. There was a Toyota Solara that caught my attention and after sitting in the vehicle and starting it and asking a few questions about the A/C working ect. I got out of the vehicle and he suggested I drive it which I decided to take it on a short test drive. Upon my return I decided that it was a vehicle I was interested in and I had half of the money on me and the other I needed to get the next day from the bank. After discussing the payments I inform him that I had to pick up my daughter, but I would leave a deposit to hold the vehicle unit I could get the rest of the money and get back to the dealership he agreed that that would be okay so I pulled out 5 $100.00 dollar bills at which point he wrote a receipt and grabbed an application and highlighted every area I was to complete and bring it back with the other $500.00 at the time of purchase. Mr. [redacted] never mentioned during this transaction any possibility should I not come back or if in the event there were a problem my money would be kept by the dealership. The next day while checking the balance of my account I was informed that the money was not available because it was frozenfor taxes so I could not get the additional money that I needed for the down paymentat which time I started making phone calls trying to find out how to free up the money. On 7/29/2013 I called and left a message on the dealerships voice mail informing Mr. [redacted] of my situation and letting him know that I would not be able to get the car at this time and would need my money refunded and once I got things straight I would be in to possibly get a car at a later date. My main concern for this was because I did not want the vehicle held when it could be sold even though I had not yetppicked up my money. On Friday 8/2/2013 I called the dealership and asked to speak with [redacted] and the person who answered the phone indicated he was [redacted] so I went on to tell him who I was and asked him if he got the message I left on his voice mail and he then went on to say "oh yeah your the one that was supposed to buy the Toyota from me". I replied with yes and his immediate response was that he would not refund my money because he could have sold it 3 times and he took it off the internet he then told me that he was busy with his kids and was rude and hung up on me. I immediately called the Motor Vehicle Enforcement Division to ask them for information on filing a complaint and was told the steps of how to do this. After speaking with the lady at the MVED I called the dealership back and asked if [redacted] was in and was told he was not so I told the person to give him the message that I will be filing a complaint with the MVED at which point the person was actually [redacted] told me that he needed to do some things with his kids and asked me to do him a favor and call him back tommorrow after noon to discuss it. Desired Settlement: I would like a full refund of my $500.00 although the car was held for 3 days there was no real equitable damage suffered by the dealership and if they had the opportunity to sell the car they could have called me for the status of my funds at any time. I feel this practice is un-fair and immoral for a company to take advantage of someone who is financially struggling already and try to steal their money.
